Private Tape Recording, ‘Litigants in Person’ to be awarded legal costs and the Crushing of Family Court Cartels

The future of our UK court administration, if not already a night mare, is a pretty grim one right now with the lack of funding for expertise and the extra work caused by the withdrawal of legal aid.

One’s inability to find a truly independent lawyer these days with ever mounting unexplained costs incurred, should you be so lucky, is why I am adding to the problem by having to act alone.

Also, if my current Cardiff court action is typical of a ‘litigant in person’ floundering around in a quagmire of both regulation and custom with fast aging faculties barely keeping his head above water, then what is the future of our law courts when many more are forced to do the same?

In order for ‘litigants in person’ to achieve anything from the clear futility of it all then to further break down lucrative and unfair cartels, as currently practised in UK courts, is what each of you must strive to do and share the information from your mistakes.

May I suggest we remain vigilant in what is to be ultimately achieved, significant reform of grossly outdated money driven judiciary and not to allow our own court cases to over shadow this primary objective, the clinching of that man made concept, justice for all parties.

2. Your recorder be placed with the clerk of the court who will only record evidence on oath

3. As to its use then it is for the presiding judge to so order where appropriate

The main danger and need for current legislation in banning the indiscriminate tape recording of court proceedings, from the public gallery for example, is because other private conversations may be picked up when so often it is privileged.

If my current Cardiff court action is typical of a ‘litigant in person’, floundering around in a quagmire of both regulation and custom with fast aging faculties barely keeping my head above water, then what is the future of our courts when many more are forced to act alone?

My appeal, re private tape recording, is listed for 7^th June 2013 in the Royal Courts of Justice if I do not withdraw from it following the apparent black mail move by Mr Justice Morgan, again, in ordering the South Wales Police to attend to further try in having me made bankrupt .

What has them worried is the fact that Barbara Wilding, the then Chief Constable of South Wales Police is yet to give evidence in the three month running trial , in Cardiff, as was she, with a few other ring leaders, who used the public purse (misfeasance) to feather their own nests and carry out Guernsey's wishes .

South Yorkshire’s top judge has called for children to be removed from dysfunctional homes to end the ‘frightening’ cycle of crime.

Judge Alan Goldsack QC, Recorder of Sheffield, revealed he is now dealing with the grandchildren of criminals he prosecuted or defended 40 years ago.

The judge spoke out as he retired after 43 years in the legal profession.

He said: “Some people become criminals because they enjoy crime and think it’s a good way of life and if they don’t get caught they think they can have a good lifestyle.

“But a frightening thing is the number of people I see who are the grandchildren of the people I have prosecuted and defended 40 years ago – because crime runs in families in the same way that being a doctor, teacher or lawyer does.

“We have to get in on the ground and remove young babies from the families that are going to produce the next generation of criminals, and that is why I did family law right up until the end because I think it is very important work.

“I have read so many pre-sentence reports where I said to myself ‘why was this person not adopted at birth? All the signs were there’.”

Judge Goldsack said prisons are full of criminals who are products of a failing care system, where children are removed from dysfunctional homes too late – at an age when it is difficult to find adoptive parents so the youngsters end up in care.

“A huge proportion of people that we see at court are products of the so called care system and a huge proportion of those in prison are a product of that so called care system,” the judge added.

“Family is all important if you want to prevent people becoming criminals - a stable family life prevents most people from becoming criminals.

“The care system is not working as well as it should be by a long chalk.

”Once children get beyond the age of four or five, what do you do if you bring that child into the care system?

“There is a shortage of parents wanting to adopt children of that age or above, so only few will be found homes, and if you a child you leave until they are nine or 10 the care system can’t do much for them at all - they can up going back home because there is nowhere else to put them.

“Children removed from home at 11 or 12 will invariably end up in a children’s home, which is why we have to get in early.

“It’s not uncommon for a dysfunctional family to have £250,000 spent on them, but if we got in early and removed children from these homes we could save thousands.”

‘Frustrated Maurice’

I am sending to the Crown Prosecution Service (London) samples of tape recordings, similar to those on my website blog, of Cardiff Magistrates original 1^st December 2011 conviction for ‘harassing’ the Caswell Clinic doctor. He had, without appropriate medical qualifications, recommended I be sectioned under the 1983 Mental Health Act and to be incarcerated, as a MAPPA Level 3 registered victim, without my knowledge, to Ashworth High Security Psychiatric Prison, most like likely for life.

The Cardiff CPS had told the 2^nd December 2009 judge, caught on transcript, that this doctor, all on his own, had further stated I that I had both irreversible and significant brain damage causing me to be categorised as being one of the UK’s 5% most dangerous individuals.

Cardiff Crown Court refuse to allow me to hear the CD record of the redacted 2^nd December 2009, 1^st and 2^nd March 12 Crown Court , the appeal from the original 1^st December 2011 District Judge John Charles , Cardiff Magistrates’ ‘harassment’ conviction hearing or that of the 2^nd May 12 Trial by Jury, the subject now before the Royal Courts of Justice, a breach of a restraining order never ‘served’ on me in the first place!

1. Did you receive Cardiff Court instructions, as I am given to believe, that on each occasion the respective Cardiff judges, His Honour Judge Neil Bidder QC, HHJ Hughes and HHJ Curran QC, that one or all three had your original transcribed records changed?

2. If so, which ones and what were changed?

3. Will you send me copy of the redacted portions in order to avoid a ‘class action’ in an English court against your employers?

I have spent thousands of pounds, over the years, on transcripts and ‘being corrupted’ has been the usual court clerk’s excuse for my not receiving the expensive full transcripts and significantly at variance to those of my own record of court proceedings in both Crown an Royal Courts of Justice courts.

The doctor had originally, on 7th August 2009, without even examining me, successfully applied to having me sectioned under the 1983 Mental Health Act as having a ‘paranoid delusional disorder,’ having a fixed false belief unameanable to reason, in that I believed I was being persecuted by the South Wales Police and its Cardiff judiciary.

The omitted oral evidence, recording I was not allowed to have my legal papers, give evidence or call witnesses, some waiting in the building, is urgently needed for my appeal listed before the Criminal Court of Appeal.

Tomorrow at 10am at Cardiff Civil Justice Centre, disguised as a Kirk v Kirk divorce proceedings, a huge team of local lawyers and judges will commence the next stage in obtaining my my bankruptcy.

Why?

For the sole purpose of stopping my three month trial damages claim, due on 18th February, from even starting. The Breton affair is an indication, the machine gun and MAPPA registration in order to having me short ave all miserably failed.

The falsification of family property by chosen taffia is the least I expected in tomorrow's proceedings

I will be asking for a Mackenzie Friend and the tape recording of it under MY Control and AOLL CASES should be heard OUTSIDE WALES' den of iniquity

Cardiff Crown Court continues, of course, to refuse to let me listen to the 4th May13 jury trial conspiracy, originally hatched by a string of 9 Park Place Chambers, Cardiff, barristers, back in the 90s, in a ring with key police officers to have my name removed from the veterinary register.

The trail judge was a party to criminal proceedings culminating in police asking the RCVS to have me struck off.

Back in the 2000s 9, Park Place chambers, barristers were caught in a lucrative ring reliant on prisoners in Cardiff police cells being charged, using the same defence teams, back hander to the duty sergeant, to dictate the poor sod's fate.

Cardiff judges, often from those chambers are known to visit the juries, during their private deliberations, stating whether they should bring a 'Guilty' plea or not

It stinks, doesnt it?

STATEMENT OF EVENTS ON THE 24/01/2013

IN THE VILLAGE OF MERDRIGNAC FRANCE

After having lunch at a cafe Maurice kirk and myself walked to another cafe for coffee ,where we made a video involving an old gentleman and his opinion of the UK in Europe.

Having left there at approximately 1.30pm we then walked to a butcher shop, purchased some pate and then carried on to the council office, after this we proceeded to the police station.

Whilst and the police office Maurice tried to explain that the squatters in one of his properties had destroyed some valuable antiques for fire wood to which the police started to laugh and treat Mr Kirk with from my opinion great disrespect.

The police then insisted that they could not understand or speak any English and refused to take Mr Kirk's complaint. Mr Kirk then proceeded to become agitated with his treatment and shouted at then calling them Nazi bastards to which I heard laughter, at this point I suggest to morris it would be wise to leave which we did.

We had walked out of the police station past the butchers when I notice the two young officers who laughed at Mr Kirk in the first instance running down the road past us and pointed this to Maurice, Maurice was involved in a conversation with a local at this time.

I started to walk towards the car and spoke to the ethnic police officer as he ask where we were parked, at this point Maurice came around the corner and told me not to speak with them which I did. The police attention then focused on Maurice and several officers were present, two young ones and two older ones.

Maurice was then marched back to the station with an officer on each arm.

Whilst Maurice was being processed an officer approached me and asked what the problem was in English and I explained the whole situation regarding the squatters and the damage that had been done, I then asked why they did not help Mr Kirk resolve this situation and was informed that the police didn't have the man power due to cuts and that Maurice was a well known crazy man that will be sent to an asylum .

I explained we had a booked ferry and that surely they could overlook this and try to understand his point of view but he insisted that he would have Maurice taken to a Hospital to be sent to an asylum.

I then left for St Malo.

I was locked up for a while and then taken to Pontivy hospital, central Brittany about 30 miles away.

The police tried to persuade the doctors, three of them, to admit me as a mental patient.

After 30 minutes or so more nurses arrived and one said,

It's the ‘flying vet' he was here to have a hip replacement, insisted he could fish from his room in the river below! ......he crept out far too soon after the operation on his crutches, in his pyjamas and flagged down a taxi and went off to the horse races!

What is he in here for?

Police said, to have him sectioned and sent to an asylum.

A huge amount of laughter followed with comments like, " You will have a job sectioning Maurice, he had the doctor (Dr Maimar?) in fits of laughter with his stories of flying old French wooden aircraft, with out paperwork, out of Pontivy across the channel, some 30 years ago.

I was then forcefully dumped in police vehicle driven back to Merdrignac where I was locked up until 9 am next morning.... Showed with questions, refused any paperwork (South Wales Police style) and kicked out.

The three month trial is booked Feb 18^th but with crutial hearing on Wed 30^th Jan for the issuing of 60 odd witness summonses on top of their 70 or so police defending/ including Barbara Wilding and rogue psychiatrist I am not allowed to name.

Interesting, this is the fourth or fifth time booked to start in past 12 years only for myto be mysteriously locked in prison each time just weeks before the trial is due to start.

Interesting, a solicitor, purportedly helping me......disappears off the map for weeks before Christmas. And now 15 e-mails all at once with clear indication my Tues 28^th Jan divorce case, machine gun case, rogue NHS psychiatrist (both one million pound claims) are being discussed with him with kept entirely in the dark with all parties ignoring my e-mails phone calls etc etc

I visit my ex wife's divorce lawyers to try and settle some issues on valuations etc to simplify court hearing tomorrow.

-- I have only recieved your e-mail this week end, to read, due to squatters getting into our second home, St Doha France and my being sectioned under the French Mental Health Act regulations just 30 miinutes after talking to Morgan Cole, solicitors, re 30th Jan 13 Cardiff County Court hearings re machine gun scandal, before the imminent three month trial judge to apply for witness summonses to be issued.

Clearly, the age old based conspiracy, between barristers in 9 Park Place Chambers, Cardiff, specific senior police in area police stations, certain law firms in Cardiff and judges serving both in the civil and/or criminal Cardiff courts means new evidencew has come to light re the police forensic Caswell Clinic psychiatrist, Barbara Wilding and abuse surrounding my MAPPA level 3 registration and police repainted Lewis Machine Gun.

This, together with serious valuation irregularities having been commented upon in my divorce hearing, due tomorrow, by the case mangement judge, means that there are still further reasons why I need, in the interests of fair play, for all my cases being moved out of South Wales.

My latest blog on www.kirkflyingvet.com gives a hurried account of just how far the evilness I have witnessed , over the past twenty years, in Cardiff police stations, courts and prison, of the accepted nafarious practises by so many and now protecting a rogue doctor but only because he is in the pockets of the notorious South Wales Police.

situation can be summed up in 63 words.

‘The Law’ in Britain (The Police & the Courts), deliberately
deny me the protection of the law, & deliberately block
me from seeking a remedy in the courts for crimes &
other wrongs committed against me.

That being so, & it IS fact, then that same ‘Law’
CANNOT be used to punish me.

Indeed, both Police & Courts have themselves
committed serious crimes against me, & do so with
impunity.

The content of a series of 1st December 2011 Cardiff Magistrates tape recordings, [examples in previous blogs], mirror the omissions in the later 4^th May 12 transcripts, for ‘Breach of Restraining Order', deliberately doctored by HMCTS and Cardiff's Cabal to repeat the CPS David Gareth Evans lying to the court.

Lawyers and police, when in court, are both immune to prosecution by the ‘Memorandum of Understanding' between police chiefs, Law Society and Bar Council.

The Criminal Court of Appeal have been given statements from the 4^th May 12 jury trial public gallery, for ‘Breach of Restraining Order', that the CPS barrister told the court there was a ‘draft' restraining order , witnessed from the public gallery, being hand written on the 1^st Dec 11 by District Judge Charles and sent to show me to agree or not. NOT give to me as a final order.

Months later, in the jury trial, the witness BECAUSE it was that that was shown to me in the cells at lunch time and not public gallery then heard the prosecution barrister admit he may need to be a defence witness

The FINAL Order was never served on me..

The guard, Lee Barker, whose evidence it was that he came into my cell and left me with the FINAL court copy is nonsense. My cell was opened for release was 5.15pm any hours after Barker was on duty!

ALL CCTV in cells, court logs and custody logs have been withheld because 5 burly guards threw me out of the cell when I was demanding paperwork of the court case outcome, conducted in my absence

NORMAN SCARTH and I are campaigning to be allowed to take tapes of court proceedings.......supervised.

Why are we always refused? In order to cover up the wide spread corruption in our courts and complete disregard for human rights

......My appeal , shortly to be heard in the RCJ, is classic.

The transcript of Cardiff Crown Court proceedings omits the fact my witness names were asked by me in the cells.

Yet another case I did not attend in protest as, again, I was refused witnesses , my legal papers in court or cross examine the same complainant the Caswell Clinic's police psychiatrist who had fabricated seriously worrying medical records.

WHY? In order to have me sectioned to Ashworth High Security Psychiatric prison.

IF my tapes of the original 1^st Dec 11 District Judge John Charles Cardiff magistrates are allowed to be heard at my RCJ appeal, shortly, I will win and a number of prosecution witnesses and the prosecutor stand a very serious risk of themselves going to jail

I have today, Monday, received by post the Attorney General's bundle of 141 pages, 15 dividers & one CD.
He & his gang may have nothing better to do than produce all this garbage (& receive vast amounts of taxpayers' money for doing so) BUT, having seen some of it before, & noticed the many lies, I am CERTAINLY not going to waste my time reading it again!

This is my Final 'FINAL STATEMENT'.
Accused of 'Contempt of Court', how on earth can I 'defend' myself, when I have made it abundantly clear that I have the utmost contempt for those who currently run our courts.
What I seek to show is that my contempt (& that of a growing number of people) is justified.
The Attorney General seems to think that my contempt will be lessened by his savagery in trying to put me (completely sane) in a Stalinist 'Mental Hospital' for what few years are left to me to live. Could anything be more sadistic? (I send again as an attachment the Andy McCardle document.)
I am rather disappointed to learn that Mr Waldman 'handed up' my Statement at the previous hearing, when I had specifically asked that it be read out, & I again ask that he reads out my Statement of Facts, with addendums etc.
This is important, bearing in mind that one of my arguments is that the Official Transcripts cannot be trusted. I am being more than fair in giving an opportunity for the courts to show that, on this occasion at least, they CAN be accurate.
I ask you please to hammer away at the totally irrelevant lies in the Skeleton Argument & Affidavits (put in purely to blacken my character), & the malice of the Attorney General Dominic Grieve, he being the man who had me thrown out of an Election Selection Committee Meeting in 2008, before he come to power.
As regards this hearing, I am in the fortunate position that I cannot lose. If the case goes against me, it will be more proof of the truth of my words. If (as I belief he will) the Lord Chief Justice rules against the Attorney General, then that will indeed lessen my contempt for his profession.
In which case I ask you to remind him of my request that he should use 'The Inherent Jurisdiction of the Court' to order an investigation into the 17 years of persecution, this action by the AG being only the latest. Also that he use that same 'Inherent Jurisdiction' to reduce the obstruction to my own attempts to use the law to seek a remedy for serious wrongs committed against me.
An example(a comparatively minor one) has just arrived by post today, Monday. On 17th September 2012 I made a 'Small Claim' against the Chief Constable of West Yorkshire. Twice, the documents were returned to me for some fictitious fault. Sent in again with the 'fault' rectified, I heard not a word until today, when the letter arrived. With it was a Notice of Issue, saying that the Claim had been sent to the Defendant on 15th January 2013.
SO, IT HAS TAKEN FOUR MONTHS TO HAVE A VERY SIMPLE 'SMALL CLAIM' ISSUED!.
Was this just incompetence, inefficiency or laziness? Or deliberate delay against the hated Litigant In Person? I am tempted to think the latter.
I ask you to hammer away at all that which is above at the hearing.

South Wales Police will not admit as to just which statement(s) of the targeted victim have been submitted to the Professional Standards Department!

My IPPC reply to 18^th June 12 South Wales Police Professional Standards Dept. refusals to properly investigate my many complaints arising from one decommissioned Lewis Machine Gun attached to my Farnborough DH2 WWI fighter display aircraft.

1. The police letter exudes bias in many paragraphs and quite erroneous about their conduct.

2. The gun was used to prosecute me under Section 5(1)(a) of 1968 Fire Arms Act.

3. The gun was used to have me remanded in custody for nearly eight months.

4. Used to have me imprisoned under Section 35 of the 1983 Mental Health Act.

5. Police have not even re interviewed the owners despite their new August 2011 statements!

South Wales Police accept in their original August 2009 gathered evidence that the new owner had painted the black gun to part silver immediately after their 2008 purchase from me.

The police then returned the gun, after my 2010 successful trial, even in a different shade of silver!

I had sold the gun as ‘all black' just as the gun was then presented in my 2010 jury trial and in my August 2008 U Tube video, also shown the jury, having been filmed an hour before it was collected.

6. The ‘investigation' was wholly disproportionate because:

a) I faced a minimum five year prison sentence on each of the remaining charges

b) I was registered MAPPA level 3 at level 3 management, meaning 24/7 armed surveillance

c) aided by their forensic psychiatrist, also using falsified evidence and quite unqualified medical reports, stating I had ‘significant brain damage' and possible brain tumour

d) allowed the police to ask His Honour Judge Neil Bidder QC, on 2^nd December 2009 (transcript available), I be further sectioned under the 1983 Act in order I be further incarcerated to Ashworth high security psychiatric hospital, IPP, meaning possibly for life

e) Inspector Richard Holder continues to refuse to let me finish or even give me copy of my part written signed witness statement, for the IPCC, I made in Cardiff prison on 7^th February 2012 in the presence of his colleague, Inspector King.

f) Aircraft mechanics, when I owned it, Civil Aviation Authority and Lincolnshire museum licenced mechanics, all state it was decommissioned and that the barrel was blocked.

7. The police admit firing the gun only after the new owner's August 09 statement that it was blocked when the police took possession of it on 22^nd June 2009, on the day of my arrest.

8. Since this IPCC inquiry started solicitors for the police have only, this month, now disclosed but only by a court order from an English court, all previous orders from Cardiff courts having been ignored, that my arrest had been instigated by Dolmans, solicitors, defending in a 20 year running civil damages claim for numerous other malicious and failed prosecutions.

9. Since this IPCC complaint was registered I have established that seven MAPPA monthly meetings were only conducted within the knowledge of police and NHS (Wales) staff at Caswell Clinic, Glanrhyd Hospital, Bridgend. All documents proving these facts are available.

Under Cover Tactics

11. ‘Foxy' was the name given at the 2010 Cardiff Crown Court trial to the anonymous screened off male police officer I was denied, as with others, to properly cross examine.

He pretended to be the officer who telephoned each time when attempting to purchase the machine gun. He knew, full well, it had been advertised on my web site for almost ten years and had been sold a year earlier!

Female police communication to me included a telephone call to my then wife, Kirstie Kirk.

The police have not even interviewed Kirstie Kirk following my current allegations to the IPCC.

Police refused to disclose evidence recorded during her original interrogation, during ‘Operation Chalice', for the machine gun coinciding with ‘Operation Orchid', the latter being to coerce her into signing a witness statement that I had a history of mental health issues.

It was for the purpose of ‘snatching' our ten year old daughter on behalf of the Vale of Glamorgan Social Services following the 8^th June 2009 discussions at the clandestine MAPPA meeting at Barry police station with only police and Caswell Clinic staff in attendance.

13. As for the 8^th June 2009 minutes, leaked from Caswell Clinic, the document clearly indicates I would be shot should I again approach Barbara Wilding, the then Chief Constable, as I had done following her 26^th February 2009 now proven to be false sworn affidavit on disclosure.

14. Crown Prosecution Service advise was recorded in the minutes to the effect that my intentions to expedite the ‘mutual exchange' of witness statements, in the on-going civil trial, appeared legitimate. Dolmans, solicitors, it was disclosed, were giving contrary advice.

15. His Honour Judge Seys Llewellyn QC's refusal to order further disclosure of the monthly minutes he confirmed only yesterday in that his responsibilities were only for the civil action.

16. My private prosecution applications, except via Bristol, in anticipation of the usual negative response by those ultimately responsible, have also been blocked in all the criminal courts.

Parliamentary Inquiry into the Independent Police Complaints Commission

Tomorrow (18/7/12) sees the start of the Home Affairs Select Committee hearing into the future of this much maligned organisation. Called to give evidence is the new IPCC boss, Dame Anne Owers (i've heard good things about her from trusted sources), Doreen Lawrence (mother of Stephen Lawrence) and the Police Action Lawyers Group.

20 Year Running Civil Damages Claim for Countless South Wales Police Malicious Prosecutions Continues on 9th July in Cardiff County Court

The last case, an interim appeal against 'strike out' , on 23rd April, was in Cardiff's High court before Mr Justice Morgan when I was, again, refused my right to have it heard in England by lawyers.

HM Prison again refused me my legal papers in court, as in recent criminal hearings, His Lordship, refusing me an adjournment, dismissed my appeal , out of hand, thereby blocking the politicaly sensitive court cases being examined. In the 90s Cardiff courts used them to have me struck off when all were riddled with the usual refusal to disclose public records or for court officials to have them altered or back dated.

The tactics, therefore, used by HM Court Service (Wales) in the May 12 'Restraining Order' conviction, when the clerk of the original 1st December magistrates court lied alongside the custody officer, saying that they had served the court order, on me personally, is nothing knew for these vermin that dominate Cardiff courts.

So I slipped a bail application in at Bristol Crown Court, from Cardiff prison and this was the astounding result:

His honour Judge Seys Llewellyn QC will again be reminded , on Monday, when the Cardiff prison, in order to wriggle out of a £50,000 Court Judgement, for my false imprisonment in 2008, simply had the HM Court Service (Wales) tell theie appeal court they had no record of serving the Particulars of Claim but had banked the court fee!

If an englishman chooses to climb down into the gutter with Cardiff court criminals then what do you expect, justice?

That is the routine filth we have to regularly experience in Cardiff courts, but then my father warned us , all six of us, while at Taunton School, of their inherrent culture based on deceit and intrigue.... remember the rhyme, "taffy was a welshman, taffy was a thief".....

Never saw it in my veterinary clients, though or my friends made over these past two decades.

There must be a JR hearing this week , sometime, re 1st December 11 'harassment of a doctor' but having tendered eight witnesses to police, re conduct of District Judge Charles, Judges Hughes and Curran all refusing me prosecution disclosure, my own legal papers from my prison cell, any witnesses, even legal papers from my English lawyer, the right to cross examine or re examine, why do I bother? Crown cockoo land and a thorough disgrace to the name of Great Britain.

I even took witnesses to the police station, car loads, three times and each time Cardiff police refused to take statements knowing it to be all true......disgusting but in keeping with their past record and worse is planned.

Some other High Court automaton, no doubt, will be wheeled out later, this week, to go through the motionsall *** scared of going against the HM prerogative.

"Just, fair and reasonable" or the justification of legalised violence?

I'm new to "legalese" and have only read as many of Maurice's documents as I deemed necessary in the attempt to understand the big picture and to clean up his website so that I could promote it.

Today's 40-page "judgment on preliminary issues" is most fascinating reading. So far, it has revealed the following - in order of my consideration of significance and importance:

to urge that, on principle, justice is most likely to be done if pre-access is had to all relevant documents is pointless, for it carries no weight in our adversarial system of law……”; to change the adversarial system into a truth-seeking one, is the campaign of the author of Our Corrupt Legal System
“the one great principle of English Law is, to make business for itself…”; this principle is clearly working for solicitors, barristers and judges, especially when they're paid by the public purse or gravy train, as Maurice would put it; however, to draw out stages of argument such that an action for civil damages that tries to argue the malicious intent behind 18 years of harassment is clearly not in the interest of a litigant in person
the word "principle" appears 48 times in the judgment. So I thought that his 'legal battles' now change into a 'battle of legal principles'; however, HHJ Seys Llewellyn mentions many principles without necessarily giving them names.
So what are "principles of law"???
Which are the principles at stake for Maurice?
Which are the principles that HHJ Seys Llewellyn feels he needs to defend?

The essence of harassment is that it consists of more than one incident. Whether it has been dealt with in legal actions is irrelevant.They have all taken place. They are real.

Here is the core of my arguments:

Given Maurice's medical condition, it is inhuman and barbaric to conduct any hearing. What prevents HHJ Seys Llelwellyn from ordering the release of the medical records from any of the 5 possible sources that we mention in our online petition?
To go into the details of each incident is not nearly as important as to look at the overall picture of compounding the behaviour of harassment by South Wales Police:

motoring incidents
false imprisonments
the non-investigation of crimes
MAPPA surveillance
non-disclosure of critical documents
the use of judges' discretion rather than judgements of a jury.

"Public policy" cannot be used as an excuse when an "organisational policy" appears to be in operation, i.e. orders to target an individual in his place of residency and professional activity by a particular police force.
In all cited cases of precedence, the offenders are individuals rather than an organisation covering lots of individuals.
The Chief Executive of this organisation is likely to be part of the Association of Chief Police Officers who have a Memorandum of Understanding with the Law Society not to Investigate Crimes.
The only people benefitting from drawn out court procedures are the legal professionals involved. A litigant in person would like actions to be over and done with.
The fact that the harassment has been going on for such a long time is the reason for actions having been put before various courts for a long time - at a success rate of nearly 90% for Maurice!
Given the adversarial system, the sources of money for the legal profession and the extreme and unusual circumstances surrounding the litigant as well as the Police, Maurice is seriously disadvantaged.
The petition WANTED: Fair Trials and Compensation shows the Court of Public Opinion is distinctly in his favour, especially given the comments.
The petition Stop the Oppression of the British people also created lots of comments in the same spirit:

the legal profession is not trustworthy any more
the legal profession protects HM Partnership
as a law enforcement agency to keep the Queen's peace and a professional oath of allegiance to HM The Queen, the Police is part of HM Partnership

The three websites (in order of chronology) Room 14 - A Foundation for Change, Enforcement of Bank of England Act 1694 and Victims Unite! all paint a picture that acts as Court of Public Opinion instead of a jury and represent, in attitude, victims of legal oppression and manipulation, rather than justice and truth.

Trial Day 7: Friday Sept 17, 2010: adjourned or not adjourned - that is the question!...

Friday 17th Sept 2010

I went to Magistrates, yesterday but refused to enter the court. Hence I simply handed in my original medical report from my own GP, which was not accepted by the Trial judge despite being backed with previous Dec 09 transcripts and Dr William's reports etc. I was given immediate adjournment.

Despite my late arrival due to the Magistrates, the trial progressed, the Judge allowing the police to put in legal pleadings to 'strike out' all three claims.

I brought it to the notice of the court that the police had done all this, some fifteen years ago, and had managed to have about three or four of the thirty odd incidents struck out. I discharged my Bristol lawyers for having 'wrong police force' or wrong facts in Particulars of Claim, despite countless reminders, appealed and had some restored. The judge stated all this was 'new to him' as the police legal team remained silent.

The court adjourned on the argument I was not 'not fit'. Dead right but I was 'not fit' all month!

Extra medical reports, lodged this week, caused the judge to adjourn, for around six months, the rest of the proceedings, as I understood it...

So I am even more confused now being told the trial will continue on Monday/Tuesday/Wednesday at 11am COURT 1, Cardiff Civil Justice Centre.

I did manage, however, to obtain His Honour's assurance that the MAPPA Executive Summaries, written in the past few weeks, under Dolmans guidance, be duplicated and given to District Judge Phillips by 4pm. This was the deadline for me to show the HM Prison HAD received my summons and application for judgment for £50,000, last summer, as they were referred to in the minutes of the monthly MAPPA meetings with prison, police and Caswell Clinic 'well represented'.

I also managed to ask that the HM Governor's 1st July 2010 prison document, denying any knowledge of my being under any MAPPA procedure, whilst in prison last year, be also duplicated and given to Judge Phillips before the 4pm deadline.

Reminding the court that Barry Magistrates, Cardiff Crown and now, this judge, had, so far, ALL continued to refuse to order either Dr Tegwyn Williams or Professor Roger Wood to reveal, on oath or statement, the information before Judge Bidder QC, required by my surgeons, His Honour suggested I have a new brain scan!

Catch 22 But this had been refused by the Cardiff hospital on the pretext my 'released' medical records did not cause the need!

My own 'petty debt actions', ONE, against Dr Williams, for costs incurred, in three wasted journey,s travelling to Caswell, Bridgend, on his 'assurances' the relevant documents would be 'handed out at the door' and TWO, for the Chief Constable delaying the renewal of my shot gun certificate, could not be suppressed any longer, within their silly little world and their respective response is as follows:

The Dr's Defences for petty debt hearing, due 2.30pm, Friday, 24th September 2010, disclose many before 'unseen' medical records under the control of NHS and the South Wales Police, some triggered following my 16th February 2010 MG11 written complaint of criminal conduct.

Interestingly, the police, on receit of my complaint, have never come back, refused to inform me of Crime reference number, progress or seek further information. Deja Vu?

Police have been always been willing to arrest me, on Dr Williams related matters, [roof of Caswell, 'Airborne delivery' of the evidence to Judge Cooke, top shirt pocket 'delivery' of Court of Appeal 'grounds']. But once confronted in the police cell, each time, on the matter of the fabricated medical records, at the original behest of CPS and police and am I 'fit to be interviewed'?, the police have simply slammed the cell door, thus cutting short the 'basic rights' afforded to an accused, like being medically examined after police assault and entitlement to be interviewed, under caution, while evidence is fresh for their duties on 'preservation'. Deja Vu?

If it were not for 'the right arm not knowing what the left arm is doing', in the South Wales Police none of these damning documents would ever have been disclosed. The police have been 'perspiring' over this application, for quite some time now, thus causing my petty debt action for damages leading to a favourable judgment. The Chief Constable knew full well, any disclosure needed to defend it, in the Cardiff Justice Centre, despite having that place 'completely buttoned up', or any High Court Appeal, next year, in London, should he be so minded as not to 'renew' my gun licence, will cause a' very real risk of' hidden unlawful MAPPA covert surveillance evidence being disclosed.

This is still urgently needed to be put before His Honour Judge Seys Llewlyn QC, for the current 10 week civil trial. That evidence would further prove the unlawful 'machine gun' imprisonment was utterly dependent on Dr Williams and Professor Wood's false medical evidence suggesting 'significant brain damage' and Barbara Wilding's Feb 09 false affidavit, she being the Executive Chair or her Deputy, at their irregular run monthly MAPPA meetings.

The police, I remember, told the 'machine gun' jury, in January trial, they had 'no record' of my ever having held a 'fire arms certificate' let alone a shot gun licence with the jury telling me afterwards, in the resteurant, they all concluded the police were obviously lying.

I must go back to bed now and get some rest, for I have a few other problems to address, the consequences of collateral 'machine gun' damage.
