Does Technology come to the Rescue? In and out of Jails & Courts and up and down their Stairs...

It takes geeky persistence and perseverance to get photos off a battered phone and up to this site that acts as monitor and observer, if not as a kind of 'social conscience' for the trials and tribulations of one Maurice J Kirk BVSc. No scriptwriter could make it up. Only real life can write these stories of LOTS of people 'only doing their job', denying and lying and committing crimes to cover up crimes - against one individual. No matter how you may want to criticise any victim, 'the system' always consists of many people who victimise individuals.

Here we see the stairs that Maurice was kicked down - in 2011, we think - by Court 'security'.

And we see the restaurant in which he was arrested after having been out of jail recently for barely 24 hours. It's a miracle that Maurice can chronicle his own experiences and remember dates.

As an observer of MANY white collar crimes and criminals, my current summary is:

his punishments without crime cannot be compared with any of the bankruptcies, child snatching and having to flee the country to escape imprisonment or mental hospitalisation - because every victim can only cope with their Legal Abuse Syndrome in their own particular way
his courage and audacity to take on what is clearly one of the worst Police forces in the country can only ask for admiration
his commitment to advancing the cause of Litigants in Person (LiPs), whether in prison, in Courts or simply 'back home' might only make a difference thanks to technology.

Whether web, phone or video technologies:

if courts didn't have anything to hide, authentic, unadulterated video and audio recordings would be available to whoever needs / wants them;
if LiPs were treated as lawyers, they would not suffer as much as they do, for they would get 'disclosure' of any document;
BUT LiPs are not 'part of the club'; hence they don't get 'club protection'...

I wonder whether 'the system' will begin some 'positive PR' and publish cases where people actually did get justice and compensation? Meanwhile, I put my hope on 'technology for good': An illegally arrested mother was saved by her phone.

Will these photos suffice as 'evidence' in the minds of 'club members'? Or will they bank yet more on Maurice ageing, while public officials 'just doing their job' take early retirement to make room for the next generation of victimisers and white collar criminals?

Where I would simply say this actress is a BL**DY LIAR because her conversation, at her door of her house, was tape recorded and the rest is a fairy tale. Her subsequent conduct was also witnessed by several, including my self when I took photograghs anticipating the shallow attitude such a woman would make of this family's tragedy.

As publisher of Victims Unite, I had received many emails about the Musas before starting a website to publicise their ordeal, whilst caring for my mum in Germany. Eventually, I received a ‘gagging order’ from Haringey Council – the third one to wear with pride... For I’m a systems analyst, mathematician and computer scientist. I look at Punishment without Crime and note that the Musa case is acknowledged to be the worst of all child snatching cases known to all experts in the field.

Why should International Business Times be interested in either Michelle Collins, Haringey Council, Nigerians or child snatching? Or is it simply the summer trough that needs to be filled with sensationalism?

Still, should you be interested in more biased, truthful and ultimately investigative reporting, I’d be happy to supply you with more information, including a photo of the 23 files of documentation that Haringey Council produced to keep some lawyers busy...

Who benefits, must always be the overriding question, it seems.

The hearing at Westminster will be simply to 'send' the case to the Crown Court. Most likely Southwark Crown Court.The BBC have confirmed coverage of this case, cameras will be rolling outside the court house. Do try to attend if you can as this case could have massive implications. Bring placards and banners and show your concern for the failure of the state to hold the police to account.

The discredited Independent Police Complaints Commission

As many of you are aware, I have reported that the Deputy Chair of the IPCC, Deborah Glass to the police for perverting the course of justice and misconduct in public office. The nature of the offence relates to evidence I presented which demonstrates a willful failure to investigate the criminal conduct of the Metropolitan Police. (effectively the supposed primary purpose of her role)

I have had confirmation from the Metropolitan police in two letters that this investigation is indeed underway. The crime reference attached to this case is CRIS 2314237/12 and is being investigated by the 'Specialist and Economic Crime unit SC09'.

These supported facts went out in a press release stating that the Deputy Chair of the IPCC was currently under criminal investigation as of the 3Aug2012.

Predictably the IPCC then issued threats of legal action if a retraction is not made, typical bullies using public money to threaten us into silence. Well I suggest you may wish to email amanda.kelly@ipcc.gsi.gov.uk Director of Business Services and tell her what you think of the IPCC. Maybe you also think there should be a full criminal investigation of their role in covering up the criminal behavior of the Police.

If Deborah Glass wishes to take me to the High Court for a defamation case then she can be my guest. I am happy to confirm that I reported her for what I believe is criminal conduct, the cover up of clear blatant criminal behavior of the Met Police. I am happy to confirm my communications with the Police, that they have confirmed that this criminal investigation is underway.

Should the case go ahead (which I doubt very much, even they wouldn't be that stupid) I will be calling upon other victims of the IPCC to give evidence of the IPCC and their cover up of police criminal conduct.

Ms Glass states that the fact she is under criminal investigation is 'damaging to her reputation'. I would suggest as the head of a widely discredited organisation, her reputation is like that of the IPCC, severely under doubt. Indeed if she was an honorable individual she would have tackled police criminality when presented to her.

Indeed if the IPCC think this is not the case, I guess their problem lays with the Metropolitan Police and their communication on the matter. Maybe they could put in a complaint....... see how far they get with that! lol

Defamation case

The Metropolitan Legal team still need more time, always delaying and the window for mediation rapidly closes.

Parliamentary Inquiry into the Independent Police Complaints Commission (IPCC)

The Parliamentary Inquiry into the IPCC has started back in July with it's first hearing. Giving evidence was a representative from the Police Action Lawyers Group (PALG), Deborah Coles from INQUEST and Doreen Lawrence (mother of murdered teenager Stephen Lawrence).

They were scathing of the performance of the IPCC......

Finally, the new head of the IPCC, Dame Anne Owers gave evidence. She was instantly made aware that the committee had already heard some very serious criticism of the IPCC. Dame Anne Owers was very much on the back foot and offering her own ideas on reform of this much maligned organisation.

My opinion remains, the IPCC must be abolished, a new organisation formed made entirely of civilian investigators. I am willing to take up the post of head of investigations. I will be fearless and act without favor in my pursuit of criminals acting in the post of constable.

A number of people have now been called to give evidence infront of the Committee, including our much loved fellow campaigner Ian Puddick.

SEAN RIGG INQUEST

I have been attending the Inquest into the death of SEAN RIGG at the hands of the Metropolitan Police in Brixton Police station. SEAN's death happened in August 2008, like all deaths at the hands of the police, the families are facing an uphill battle to find the truth behind the death.

The inquest was shocking and the jury, much to their credit, delivered a damning verdict against the metropolitan Police for their involvement in the death of Sean. For example they stated;

"whilst Sean Rigg was in custody, the police failed to uphold his basic rights"

Still, everyone of those officers is still in full employment with the Met police, indeed many have had promotion. Of course once again the IPCC's hand in covering up the circumstances behind the death of Sean is evident. It is alleged that on the evening of Sean's death, IPCC investigators' attended Brixton police station and in conjunction with Met police professional standards officers instructed all police involved NOT to make any statement about events!!!!!!

This is clearly so that they can prepare statements once they have gathered all evidence, statements to present a benign narrative to events. Of course, officers were caught lying on oath at the Inquest. (there is currently a separate investigation into this) As with all lies, they have short legs and generally go belly up under the slightest of scrutiny.....

The Rigg family are an inspiration and a true example to all those fighting the injustice of police corruption. I met Sam Rigg about 3yrs ago and from her impassioned speech about her brother's death, you could instantly see she and her family have what you need to get behind the police lies and uncover the truth.

Please support the Rigg's in their continued quest for both justice and accountability.

Police accountability

I attended the very interesting evening put on by "Defend the Right to Protest" titled 'policing on trial - How do we get justice?'

I suggested we ignore the IPCC and they sham police investigations into their own conduct and prosecute them in the criminal courts ourselves. Quite simply this is the only way, as with all SELF REGULATION, it never works.

hi -

Helen called Marcus and the asst. solicitor has pointed out
that we should get Glorias side to what happened today Sunday 12 Aug at
Holloway prison during the planned visit with her. I must say this may be the
only time ive actually listened to what the guy has said.

Perhaps we should wait and see what Gloria has to say on
Tuesday, or if nothing is forthcoming, reassess the appalling situation then.
This does not help her get medical treatment though, which must be urgent if
she is issuing blood clots from her stomach. The prison is clearly covering
things up perhaps in the hope she disappears completely out of their
jurisdiction in the worst possible way. Helen says she has not heard from her
since Tuesday - perhaps as she cant get to the phone and the employees refuse
to help her get to the phone, or let her have the use of a wheelchair.

I got home at half past eight
As I said to Helen and John although I did not manage to see Gloria the visit was not completely wasted as I have now been completely convinced re the ongoing corruption at Holloway

We got through the screening process without any problems and sat down in the Visitors Hall. Gloria was nowhere to be seen. I asked a female warder at the desk whether Gloria would be coming soon and she said she was ringing to see what was the problem. This fair-haired prison officer ( John has her number)said she was able to walk but would not. I asked whether they had any wheelchairs and was told no. We sat down and had a cup of tea and Helen advised that we should stay to end of the session so that the authorities couldn't say she turned up after we went.We noticed two extra people were positioned near to us. John and Helen went and asked to speak to someone higher and were pointed in the direction of one of these people , a Mr Attard. I thought three people might have been a bit much so when John came to sit down I went up to him. He told me they DID have wheelchairs and apparently according to him she had been seen by medical services the previous day and told she was fine. I explained that I had worked as a biomedical scientist and if that was the case she must have had a haemoglobin and an x-ray to be able to say this. Ok, I know, but by this time these people were really irritating me. Then I got the privacy of information bit. We just left at the end of the session.

Helen had previously said Don Marcus was going to visit Gloria on Saturday. After she left she rang him but couldn't get through. I should imagine she will ring tomorrow. We needed to know whether he had visited, whether he had seen Gloria and also had she been in a wheelchair.
My mind is now going round in circles trying to decide what to do next. Helen has said that she is very worried as the last time she spoke to her which I think was Tuesday Gloria wasn't very coherent and was saying she was feeling dizzy.These are symptoms of anaemia.

Lynne will speak to you tomorrow and hopefully by that time will have a reply from Helen with the info re Don Marcus's visit.

£800 claim for four futile visits to Caswell Clinic attempting to obtain copy of medical records

Dear Sir,

A Mr M Bowen informed me that he attended the last court hearing as my Mackenzie Friend, in March, to find HM Court Service had ONCE AGAIN interfered with justice this time by withholding documents from the judge that I had sent due to my inability to attend.

Had Mr Bowen not had the foresight of the games Welsh courts seem to play with me and had already photocopied my pleadings, that the case should be stayed, to be moved to a higher court, the judge would not even have known about it!

One such document that was not read by the judge, in the time available, his anger for HMCS interference being obvious to all in the court room, is yet to be confirmed.

I have therefore lodged a Judicial Review Application with the Administration Court for the purpose of Their Lordships, outside South Wales, becoming more aware of the clandestine behaviour so often metered out by HMCS in South Wales.

Enclosed my 10th March position statement following the court hearing needing your response

Leaked internal memos, enclosed, between the manager of Cardiff Civil Justice Centre and the HM Treasury Solicitor is but one example of your apparent unlawful conduct to pervert the course of justice.

Please identify the document, to which I refer, in order that there is proof of all this for the Court of Appeal and explain why the judge was not supplied with my comprehensive pleadings by HMCS, sent to your office days before the hearing by e-mail?

This is a marvellous post, as it shows the poster that Maurice used when he stood for election in Guernsey some 20 years ago. He nearly made it to make a difference on that tax heaven!

The post also shows the video interview that was taken while he was on Jersey: a nice summary of where he is at in these "exciting times"...

It is blindingly obvious that the reason they will not produce your medical records is that you do not have a brain tumour, & never did have: That it was a complete fiction by that evil man 'Doctor' Tegwyn Williams to give an excuse to lock you away for life, at the behest of then Ch. Constable Barabara Wilding who, as Chairwoman of a Big Lottery Fund, was able to hand out large sums of money to Williams. In Cardiff Crown Court on October 1st 2009 I stood up & likened him to the Nazi Dr. Josef Mengele. That is NOT an exaggeration. Nobel Laureate Solzhenitsyn said "To put a sane person in a madhouse (his word) is worse than the gas chamber: the torture is more cruel, death takes longer". So it was for Andy McCardle.

Please forgive me if I now mention my own case, but it IS relevant. After four years in prison for a NON-EXISTENT 'crime', I had 'paid my debt to society' & was due to walk free. Instead I was unlawfully carted off to Newton Lodge Gulag 'Hospital', Wakefield, a most evil place. When I asked the Home Office by what authority I was taken there, they said 'Two Doctors' had said I was suffering from some (un-named) 'mental illness'.

For more than five years I have been asking for the names of those doctors, but without success. Nor have I been allowed to see my medical records during that time, in spite of many requests. The reason is of course, the 'two doctors' do not exist. There are in fact THREE doctors who DO exist, all of whom said I was NOT suffering from any mental illness!

Tegwyn Williams could not take action against me for what I said in Cardiff Crown Court, but he can now that I have repeated it outside. He can either sue for defamation, or apply for an injunction to stop me repeating it. I invite him to do so. To their shame, the GMC are as bad as Williams, protecting the evil ones among them, just as they did with Harold Shipman.

Dear Leon,

I am writing to you in connection with Mr Maurice Kirk, currently serving a prison sentence at the States prison, Guernsey. I appeal to you on humanitarian grounds and in the interests of justice to use your powers under section 26 (2) of the Criminal Justice Act 1961, to transfer Mr Kirk to a mainland prison for the remainder of his sentence.

The prison governor has freely admitted that the building and staff are incapable of providing Mr Kirk with minimum standards expected by a court. Mr Kirk is kept in solitary confinement. All his mail is censored, thus denying him confidential communication with his solicitors in England. In addition numerous letters to his solicitors and MP's have been confiscated due to what the prison has described as "of indeterminate length".

As a result of what Mr Kirk sees as prejudice, his health is deteriorating and you will know that he has spent much of the past few months on hunger strike. In addition he claims that medical attention has been refused him from 3 separate practices on the island. These factors have contributed to a great strain on Mr Kirk's wife.

According to people who have met the Kirks, both are close to breakdown and see transfer to a mainland jail as the only hope.

You are aware of my criticisms of the islands and of their constitutional relationship with the U.K. Please appreciate that my appeal to you for an urgent transfer for Mr Kirk has no direct link with these criticisms. It is on humanitarian grounds and in order to ensure Mr Kirk a fair hearing.

PARLIAMENTARY UNDERSECRETARY OF STATE

Dear Janet [Fookes MP]

I am now able to reply to your letter of 11th July to David Waddington with which you enclosed this one from Mr Maurice J Kirk in connection with his recent legal proceedings in Guernsey. I should say at the outset that since you wrote, Mr Kirk has been convicted on a charge of contempt and sentenced to a term of eight months imprisonment. I understand that he has lodged an appeal against conviction and sentence.

As you are aware, Guernsey is not part of the United Kingdom but a dependent territory of the British Crown, which, in general, is responsible for its own domestic affairs. The administration of justice in Guernsey is, by constitutional convention, wholly within the competence of the Insular authorities and it would therefore be inappropriate for the home secretary to seek to intervene in individual cases.

I am however assured by the Guernsey authorities that in accordance with established procedure in Guernsey, Mr Kirk was given the opportunity to select an advocate for his defence, but I understand that he took the somewhat unusual course of selecting one from the 27 offered by picking a name from a hat.

Mr Kirk subsequently indicated that he did not wish the advocate to represent him and made no attempt to engage the services of another.

With regard to Mr Kirk's claims that he was denied access to law books and facilities for the preparation of his defence, I understand that the Guernsey prison authorities responded to all his requests for books, but that not all of these requests were available. They do not accept that he was denied any reasonable facilities for which provision is made in the prison (Administration) Ordinance 1959.

In October,1984 having apparently exhausted all local remedies I went on hunger strike for the second time for reasons outlined in the following letters:

Dear Madam,

I am on hunger strike because

1) I have applied to a higher court in the U.K. concerning my conviction and vindictive sentence and your insular authority REFUSE to send me to appear in person because you say it is TOO EXPENSIVE to travel there. (See newspaper report)

2) False information was given to the jurats before sentencing by Day, the solicitor-general, concerning time on remand thereby affecting my release date. This could be notified without further delay.

3) A charge of OVER 17 MONTHS AGO against me will not be brought to court because the evidence will expose the conspiracy of the authorities and others to sell my building and contents in 1983.

4) The various authorities will not answer letters and supply transcripts and tapes of hearings - ALL PUBLIC DOCUMENTS.

ANY OTHER PRISONER WOULD BE ON PAROLE AFTER SUCH AN INJURY CAUSING HOSPITALISATION.

I attach for your information a copy of an article from the Guernsey Evening Press and Star of 17th April, 1985 about Mr Maurice Kirk, a well known correspondent from Guernsey, concerning his wish to appeal to the privy council about the Jersey court of appeal's decision which is outlined in the article.

As you will see, the possible case is some way off, but I thought that you might wish to be aware of it.

This one was attached to the 5 September 1984 letter from the Privy Council to me.

The Privy Council registrar continues to refuse to conform or deny their authenticity.
