Not just South Wales Police Chief, Barbara Wilding, is taking early retirement but now John Smith MP!

I come back from France to arrest Barbara and Adrian, the latter could not be found in Dolmans, Cardiff, nor could the former, on my visit to Barry Police Station being told Inspector Rice will not see me for a witness statement! Sgt Rice, as he was in '97, burst into Barry Magistrates with a van load of excited coppers upon my insistence. Sirens could be heard all the way from Gladstone Rd Police Station to the court house, as I shook Crown Prososecutor, Stoffa, by the scruff of the neck, as my Jack Russell would kill a rat.

Warrant for Adrian Oliver's Arrest

Further to previous letters on the state of the Vale of Glamorgan Police let me summarise the fairy tale:

With the lawyers for Barbara Wilding stating several magistrates court cases "NEVER HAPPENED", I have filed a private prosecution on Adrian Oliver withholding proof of the criminal conspiracy.

Given assurance, subject to a payment of £40 each, the court will furnish me with a ‘memorandum' of each of the court cases in my 16 year running claim for damages. 130 charges were brought against me, police losing around 121, incurring false imprisonments and assault by her officers, while having to endure a sometimes, 24/7 surveillance on my Barry Veterinary Hospital, unable to tell a soul, not even my wife, for fear that, should it ‘get out', my veterinary practice would be dead overnight.

Meantime, back in Noddy Land, the Barry police station, first refusing to take my statement of complaint of Perversion of Justice and Contempt of Court, due to "lack of recourses", they have now offered me an interview, in a week's time, refusing to allow it to take place at the police station, but in ‘my home' some 15 or so miles away, which will tie up at least two officers and a police vehicle for most of the day!

The convictions obtained by the very same police were used, in 2002, to have me struck off for life. Adrian Oliver refuses to identify the 40 odd police recorded 'incident' numbers, I keep sending to Barbara Wilding, all relating to intense police harassment and my inability to obtain legal representation.

My 5^th Application, to practice veterinary surgery, refused in November 2007, took eight months to reach open court even when filed under ‘emergency procedures', at extra cost. Appeal from that refusal, now with the Court of Appeal, remains dormant despite protests from me. Why, Mr Smith?

My 6^th Application, refused again by only one member of the Royal College of Veterinary Surgeons in 2008 has still not even been listed for my lodged Judicial Review Application, my 51^st, it must be now.

All Jon Owen Jones MP, David Mclean MP, Jenny Randerson AM and Alison Halford AM were harassed by Felicity Norton for ITV to put pressure on the college to cause serious false information to go before the College's original Preliminary Investigation Committee in June 2001 causing this nightmare result.

The facts are before you. There will be violence in the Vale, if this scandal is not immediately sorted.

Further to previous letters on the state of the Vale of Glamorgan Police let me recite a fairy tale:

I was kept waiting 56 minutes at Barry police station, this afternoon, just to make a written complaint of Perversion of Justice and Contempt of Court by a lawyer, Adrian Oliver of Dolmans, solicitors, Cardiff.

He indicated, in writing, two Barry Magistrates court cases had never taken place!

1. When the first police case collapsed I arrested the HM Crown Prosecutor, Mr Stoffa and while I waited for the police to arrive he failed to break my grip of his collar as he was shaken by the neck as a terrier kills a rat, a rat being exactly what he is.
2. A photograph fell from the CPS file he was desperately trying to withhold from me.
3. The photograph was that of my employee caught by police speed camera but I was ‘the boy in the dock' for it, despite my having furnished my employee's name and address as the driver.
4. We heard the police sirens from Barry police station all the way to the court with hoards of ‘men in blue' come bursting into the court, Sgt Rice to the for, at full gallop [see recent downloads].

5. Sgt Rice, Adrian Oliver says, remembers no court case and the court office has no record of it!

6. The other case, he also denies ever happened, was not dissimilar; I am in court for no insurance.
7. CPS had overlooked the fact that PC O'Brian had failed to issue me with a traffic ticket to produce, having been on the surveillance team 24/7, staked out earlier in the road, to watch me and those who came in and out of my veterinary hospital. Police did this for several years!
8. Upon information from Guernsey, of all places, I have the letters to prove it, they then tried another Noddy Land prosecution only for it to be stopped, mid flow when the magistrates realised it was yet another stitch up, the police finally lost 121charges, but who is counting?

Ah, but is it you, Mr Smith? Today, in Barry police station, the acting inspector, surrounded by reinforcements with video camera running in one hand while the other rested on the CS gas canister, having been told I was "appearing to look menacing", simply apologised that he could not take a complaint as did not have ‘the resources' and I should make my complaint to the Law Society!

Not unfamiliar with the wickedness of "The Memorandum of Understanding between Law Society and Chiefs of Police" his comment fell rather on ‘deaf ears' as he refused my statement already prepared!

The daily 'Abuse of Process' enjoyed by too many lawyers is ultimately Parliament's responsibility and that means your MP of whatever colour, creed or political persuasion.

I drove an old £350 banger to collect my tired old D-Day Piper Cub, of 30 years ago, registration G-KERK, in a snow storm on Monday in Suffolk and towed her, after two punctures in the blizzard and with no car heater, down through London for an appointment with my local Member of Parliament, Mr John Smith MP, where I highlighted malfeasance across the board in the comic but tragic world of our British Judicial system and came away encouraged....... but not holding my breath!

Back in sunny Brittany putting stairs and log fire in the house for that party bash for life long friends, in Bastille Week, with no water or electric, save a little generator, at the moment while I try and type out a 'wee missive' for Mr Smith to work on.

Tomorrow is to be spent selling, I hope, one of the houses plus pony paddock for just 25,000 Euro in order to pay for G-KERK's sophisticated gear to possibly reach the top of Mount Everest.

Then I have to prepare a legal action against a Frenchman who stole my £20,000 aircraft engine off my almost new but slightly scratched Cessna 172R. Monsieur Phillipe Chaudet of Lyons may not have the Gendarmes calling just yet. They usually refuse to investigate an Englishman's plight, maybe because they have never forgiven us for 'La Guerre de Cent Ans'. Rather like in South Wales at the same time, I suppose, with their Owen Glendour but Chaudet is about to have a shock and far more trouble close to home now so many aviators, injured before me, are coming forward.

Abuse of Process

Thank you for seeing me at the House of Commons yesterday and promise that you will look into these initial issues concerning our bizarre British judicial system currently milking and running circles around the UK tax payer. Malfeasance, by those in positions of privilege, is your responsibility.

‘Vexatious Litigant' Investigation by HM Attorney General.

Until such time as this action is before a court with prosecution by Her Majesty's Attorney General, you, my parliamentary representative for the Vale of Glamorgan, should investigate my complaint of the thorough disruption this ‘required' investigation has caused to my 17 year running court actions for damages against both the South Wales Police and Royal College of Veterinary Surgeons. I have only just heard that the HM Treasury Solicitor has employed a team of Whitehall lawyers for the last seven years for this scandalous but lucrative exercise!
The manager of HM Administrative Court in the Royal Courts of Justice features in my appeals in 2001 and onwards when, for example, police took my unlocked car, full of dangerous veterinary drugs and for six weeks left the car on the edge of a public road near Cowbridge. I was later convicted for the related motoring offence, in my absence, due to post operation complications.

The court manager, referring to the above police incident, well over 50 on your patch, involving over 120 charges they have lost, is identified in that memo of 2003 I gave you, the manager stating:

"This and other applications merely (and are, it seems intended to) delay the appeals which should now be determined)". [I have lodged over 50 Judicial Review Applications, many clearly not even opened].

This manager had medical evidence of my inability to attend that Appeal, but was still minded to write what he did with the trivial motoring conviction later used to have me struck off the veterinary register.

The ‘common purpose' to have me certified was to prevent my legal right for disclosure of evidence of the hatching of a conspiracy when South Wales Police first complained to the Royal College of Veterinary Surgeons in 2001. Neither party disclosed their respective investigations into my affairs. The college went so far as to refusing any disclosure at all of their contemporaneous notes, created when their team of lawyers swept across the Vale of Glamorgan interviewing my own Barry Veterinary Hospital clients and your local police. The RCVS examined police confidential records, contrary to Home Office Regulations 45/ 1987.
More disruption caused by the manager of HM Administrative Court is highlighted in the internal memos referring to my complaint to the Criminal Cases Review Commission. I showed you documentary proof that my above named defendants were to be taken into the HM Attorney's ‘confidence' to disclose any material that may secure my certification. The Extended Civil Restraint Order, ECRO, was handed down by the manager to block disclosure so, together with the 17 months delay to the Court of Appeal, to finally set down my Appeal for a jury trial, due to the HM Attorney spiriting away to lose or steal files, there was still more malfeasance.
Over 130 files, bearing my name, were rounded up just in the Wales area alone and distributed to numerous lawyers and defendants, no doubt, with some going ‘missing' so that when I employed a barrister to examine the relevant files, the HM Cardiff court was made to admit, in writing, they had disappeared. I have photos and other record against HMCS to prove it.
Disappearance of files from Cardiff County Court included one labelled, Maurice John Kirk - Potential Vexatious Litigant, containing clear evidence of malfeasance by too many government departments, all dependant on the immunity bestowed on them by ‘Her Majesty's Prerogative'. Mr Smith, your comments on the HM Partnership issue were particularly disturbing to me.
If ‘exhausted legal remedies', is a likely reason for your inability to investigate my complaint, it is a matter of court record Lord Justice Thomas, in the presence of my McKenzie Friend, Patrick Cullinane Esq., refused me a jury trial or An Abuse of Process Enquiry.

I was refused ‘leave' to the House of Lords on such a fundamental Common Law and Human Rights issue of being refused a civilian jury. Police harassment case is simple and ‘document light'. His Lordship said it was ‘hopelessly out of time' when clearly the court date stamp indicated it was not.

The HM Treasury Solicitor, RCVS and Barbara Wilding all plead ‘legal professional privilege' not to disclose evidence relating to this 7 year investigation and 10 years of police harassment, with my being gaoled and made to produce motoring documents 35 times. It all stinks, doesn't it?

Independent Police Complaints Commission

The Commission refuses to properly investigate or show disclosure as to what is being done about:

my complaints to various Metropolitan Police Stations of proven perjury before both the Judicial Committee of the HM Privy Council and Royal College of Veterinary Surgeons by lawyers.

Despite proof from numerous JR hearings the Privy Council clerk refuses any further Humble Petitions.

my ‘recorded delivery' complaint, returned as ‘not known', from Cannon Street Police Station, listing criminal conduct by Penningtons, solicitors, of Gutter Lane, London.
my complaints to the South Wales Police, including perjury, arsons, thefts, assaults, break -ins into my veterinary surgery, false imprisonments, perverting the course of justice etc., etc.

Only this week, I am told Barbara Wilding, Chief Officer for the South Wales Police, is signing a sworn affidavit that she knows nothing of my being taken to court saying there was no court; she knows nothing of her police breaking into my surgery with a crow bar to re-instate a police inspector's daughter in my flat; she knows nothing of my being sent to Cardiff prison due to her police ‘being unable to identify' me; she knows nothing of the deforestation caused by the paperwork created in the years of her letters with road fund tax and insurance departments in frantic attempts to get me off the road to prevent my practicing veterinary surgery; she knows nothing of her inspector signalling to his colleagues in the witness box, under cross examination, causing the jury to complain but with my subsequent imprisonment when I complained.

The IPCC documents, on this issue, are to follow this letter when I can find them secured in Brittany.

HM Information Commissioner for the 1966 Data Protection Act

This bizarre complaint to you is the way the RCVS have managed to refuse disclosing the content of their investigation, to remove me from the veterinary register, before the manager of the Administrative Court. RCVS protection under the 1967 Royal Charter orders each HM judge to do just that, while I am fighting my corner relying on the 1966 Veterinary Surgeons Act, 2004 Schedule, specifically stating: the RCVS must disclose the findings of their enquiry and must place me before a court within three months! So just who drafted and who ratified both totally contradictory legislation and who is ultimately responsible if is not your government?
How can the IC rule in favour of the RCVS without even looking at the evidence withheld?
How can the RCVS get away with falsifying a magistrate's evidence without police investigation?
How can the RCVS Registrar get away with obtaining hostile police to be my ‘defence witnesses' despite a Court of Appeal Order, by Mr Justice Sullivan, still ringing in her ears?

You may note the word ‘Freemasonry' was never mentioned by either of us.

I am neither ‘street wise' nor appropriately educated to fight such deceit in a ‘gravy train' fuelled on tax payer's money, there being no accountability for those in HM ‘frilly knickers' other than to Their Maker.

As I enter my 18^thlitigation year with your South Wales Police they have still not released Barbara Wilding's promised ‘sworn affidavit' and even refuse to serve their witness statements, also contrary to Court Order, in the hope I will run out of money, run out of steam or simply die.

I enclose my letter, 11^th June 2001, just as a reminder for you of the conduct of your police and your HM Crown Prosecution Service (CPS) destroying evidence and especially HHJ Griffiths Williams, insulting my intelligence with a name like that, promising me a fair trial. He refused to secure what was left remaining, contrary to previous orders for the police to disclose by HHJ Vosper QC, HHJ Bishop and many others and considered it a big joke by CPS barristers, at the time, laughing in front of my secretary in Newport Crown court whilst evidence was shredded.

I refer to my previous letters regarding the police deliberately destroying custody records despite applications within days of my arrest to retain.

Today, in court, Judge Griffith Williams argued for over an hour trying to overrule a previous Judge's orders of 4th June, to make the prosecution produce custody videos, notebook records, PNC printouts on vehicles etc, some within 5 days.

The prosecution admitted they had not even actioned Judge Bishop's orders and admitted that various videos had been destroyed.

Clearly this hurried hearing, fixed by telephone late Friday afternoon, has followed from what these records reveal and clearly indicates a conspiracy.

Mr Smith, this very same, now Mr Justice Griffiths Williams, went on to refuse my Crown Court Appeal for ‘common assault' on the security guard, the conviction used by the aforementioned RCVS lawyers to have me struck off the veterinary register for life. Mr Griffiths Williams ordered £11,000+ costs against me which were repeated with the RCVS £66,000+ awarded by your HM Privy Council despite the following simple facts:

1. Retired Cowbridge police inspector, Howard Davies, was made to admit before him, he struck the first blow, hard across my face, sufficient to mark and cause me to lose my balance whilst having attended as Honary Veterinary Surgeon at the Cowbridge Agricultural Show, witnessed by 20, all too frightened to intervene.
2. At Magistrates court the CPS refused to produce Davies's original statement.
3. Not one member of the agricultural committee, some clients and one my own father-in-law, knowing the vital eye witnesses, would help identify the witnesses, many being registered stall holders at the scene. Such are the politics in Wales.
4. Bridgend magistrates made written record for the Appeal that the 18 stone security guard admitted he came running down the hill to strike me from behind causing me to be knocked to the ground and witnessed by 40 plus, none of whom would testify despite the £1000 reward offered on pamphlets scattered later from an overhead by aircraft. Your environment, Mr Smith, your patch.
5. The barrister for the CPS wrote to the Royal College of Veterinary Surgeons, following the college's refusal for him to give evidence on my behalf, confirming in unambiguous terms the above facts and had he known the relevance, before the Appeal, he would have refused to fight the case for the Crown.
6. I was actually charged with a ‘breach of the peace', extinct within a year and a day but the CPS, many months later, drummed new charges burying the original despite falsifying the ‘charge sheets' by altering those originally written out by the only straight policeman in this saga, the one(s) he tried to put before the first sitting magistrates. Jackie Seals, the CPS on the day, had other ideas and refused, "for fear of incriminating myself" despite HHJ Gaskell's remarks, when I last had her in the witness box on an earlier but futile Abuse of Process Application in Cardiff Crown Court.
7. I was denied the opportunity to be ‘bound over to keep the peace' in Barry court and was served the new charges AFTER the Bridgend case had already started!

Another police incident, on your patch, just to indicate ‘common purpose':

I am face down on the tarmac in the middle of Cowbridge High Street , blocking the traffic, with two burly policemen on top of me applying handcuffs for yet another, later proved, trumped up motoring charges, the 34^th time I was made to produce documents!

I shout, as is my custom, for witnesses and get them this time and see a Volvo car with door open and ladies beside it appearing clearly shocked at the spectacle.

When cautioned I quoted the car registration number to be checked and written down.

Your South Wales Police then blatantly lied when I asked to call that registered owner and/ or driver to say what she saw. Police 'persuaded' your magistrates they could not ‘find' the driver, registered owner of the Volvo or the vehicle itself that regularly parked at the incident next to their very own sleepy police station.

The magistrates compounded malfeasance, as they have done over 118 other failed police charges, by instead of ordering disclosure, simply dismissing the case to protect.

Would the same have occurred across the border in England, I wonder?

I enclose, as promised in my last letter, a random IPCC missive for your reference. Timothy Ashton clearly also feared to tread on the toes of the ‘supreme high priest', with rolled up trouser leg, in charge of Barry's Masonic lodge, the heart of all this deceit.

South Wales Police disclosure of confidential records to Royal College of Veterinary Surgeons

Dear Sir,

1. Around 5 months ago I gave consent to the IPCC to freely investigate and disclose any material given to them of unlawful conduct by the South Wales Police in their dealings with the Royal College of Veterinary Surgeons.

2. They have both apparently satisfied the Information Commissioner, for the 1998 Data Protection Act legislation, would you believe in writing, that the police and my clients of the Barry Veterinary Hospital were, between 2001-2004, ‘clients' of the college! This gives them, they say, the excuse of ‘privilege' for failing to disclose favourable witness statements, under their joint control from the ‘clients', prior to or during the RCVS and Privy Council hearings between 29^th January 2002 and July 2004. They denied they existed but now some of those witnesses have come forward to confirm perjury and fabrication of forged statements.

3. The police and college say it gave them the right to call 10+ South Wales Police to give evidence at the 2002 RCVS hearings, some without even witness subpoenas, despite the Court of Appeal Order stating they could not attend.

4. This excuse of ‘privilege' [qualified or absolute] goes further. The Police disclosed my confidential records and statements of witnesses to the lawyers, Penningtons of gutter lane and lay staff of the college, the records being sufficiently incorrect to have influenced the trial. They included criminal convictions that did not even exist. Their action was also contrary to Home Office Regulations 87/45 but who's counting?

5. At the Court of Appeal Lord Justice Thomas of South Wales obviously refused my Abuse of Process Application in this matter whilst refusing, in the same breath, any ‘legal representation' or ‘right of appeal' from his predicted decisions.

6. In 5 years I have heard precisely nothing, other than acknowledgments of receipt of my around 100 written complaints to either the South Wales Police, Privy Council, your predecessors, numerous government departments and now you.

Dear Sir,

Further to your e-mail of 1^st August 2007 I will first attempt a summary:

1. On the 19^th January 2004 before the Judicial Committee of the Privy Council in London the Royal College of Veterinary Surgeons (RCVS) were Respondents in my Appeal from being removed from the veterinary register on the 29^th May 2002.

2. The RCVS had produced evidence by forging witness statements and presenting them to me as if originals.

3. The RCVS falsified witness addresses in order that I could not find them.

4. The RCVS withheld identities of favourable witnesses, interviewed by their lay staff, including all contemporaneous statements of all witnesses contacted.

5. The RCVS, in 2002, falsified information by way of plain verbiage relying on the decisions of a mentally ill, retired High Court judge, Sir John Wood , deliberately given the position of Legal Advisor to the RCVS hearing. His decision was relied upon at the Court of Appeal to prevent me from having any witnesses of fact, also contrary to law, relating to their ‘charges' (11 minor convictions, 5 of which were motoring).

6. The RCVS relied upon these convictions to have me struck off on the pretext, told by their lying barrister, Alison Foster QC, to the Downing Street entourage, because I had ‘disrespect for authority'.

7. The RCVS obtained policemen to attend the hearing, overnight, on the pretext they were defence witnesses when the Court of Appeal had already ordered none of them were allowed.

8. In October 2006, for the first time, the RCVS admitted being in the possession of favourable statements for me but they had not been disclosed as they were ‘believed' to be ‘privileged' [qualified] between their client, the South Wales Police and their Penningtons, Solicitors, Cannon Street, London.

9. Similar statements were withheld from me, even from my own veterinary clients, when the vast RCVS investigation team had descended upon South Wales.

10. The RCVS were disclosed police confidential records of my dealings with the police, the complainants in 2001 to have me struck off some of it incorrect..

11. Police records available but not all revealed, contained unlawful conduct by a small handful, to begin with, of police driven only by vengeance following their loss of 130 prosecutions based on harassment.

12. Police caused around 16 false imprisonments.

13. No veterinary surgeon has ever or will ever again, be subjected to such sustained unlawful conduct for such trumped up nonsense.

14. Penningtons, acting for an honourable profession, conspired to pervert the course of justice from day one.

15. Penningtons even attempted to introduce the usual ingredients to have someone struck off, namely, DISHONESTY and/or MISUSE OF DRUGS and/or DRUNKENESS and/or MALPRACTICE but failed on the lot.

16. As you are only too well aware these lawyers relied on the ‘Memorandum of Understanding between Chiefs of Police and the Law Society' to guarantee them immunity to prosecution

You refer to my numerous detailed complaints in the past about the South Wales Police shuffled and binned by the Police Complaints Authority.

They were a total waste of time and were there for political purpose only.

Just why the IPCC is different and not there just to hoodwink the general public into believing there is an ‘effective remedy' only you know?

The current scale of unlawfulness in the judiciary will never be reduced by the IPCC

I will throw you just 2 complaints for starters:

Complaint A) relates to the above 16 marked paragraphs.

Both the Metropolitan and South Wales Police have refused to properly investigate or request ‘further and better particulars'.

I have received no replies from the Metropolitan Police at all.

The recorded delivery letter of complaint to Cannon Street Police Station was returned, marked ‘unknown'!

In the 6^th October2006, other police stations in London, Scotland Yard and Paddington, were visited and both refused to even write anything down with one referring me back to the RCVS court!

That same complaint was forwarded to the South Wales Police who have responded receipt and no more.

Complaint B) This is a complaint of Abuse of Process part of which is set out in my letter of complaint of the 27^th July 2007 delivered to the Barry, South Wales, police station. Their reply of 7^th August 2007 indicates no action will be taken. Am I expected to be surprised?

All dates of my communications and police identifications can be supplied by them by South Wales Police ref CJ/KE/32/M1.119/2007 of 7^th Aug 2007 letter from Bridgend HQ.

1. Today I am informed the Chief Officer of South Wales Police, Ms Barbara Wilding, is to sign a sworn affidavit that her police did not break into my veterinary surgery with a crow bar and sledge hammer and put back the daughter of one of their inspectors in the overhead flat with a local drug dealer, nor does she have any knowledge of the incident.
2. Madam is to sign a sworn affidavit that her police did not take a statement from Christopher Paul Ebbs who informed Special Branch I had been smuggling pigs into the Vale of Glamorgan from Eire in my 2 seat Piper aircraft leading to a memorable court case, nor was she aware of the incident.
3. Madam will also be mistaken, if she states that her police did not leave my confiscated BMW for 6 weeks on the road side and unlocked, with Immobilon veterinary drug on the back seat, sufficient to kill a three figure number of the general public passing through the Vale of Glamorgan.
4. Madam will be complimented for her terminological inexactitude, should she state her police did not arrange the theft of my veterinary ambulance nor did they prosecute me in Barry Magistrates on this foreign vehicle for ‘no MOT or road fund tax' saying "there was no court case" and she has no knowledge of the incident.
5. Madam will again be 'economical with the truth' if she states she did not know of the unlawful conduct in Cardiff Crown Court causing direct intervention from the jury leaving my trial dead in the water and the wrong person sent to prison.
6. Madam will again be 'telling fibs', if she states that her police had no recall of record, subject to CPR court disclosure, of some 50 to 60 incidents against me and my veterinary staff despite carrying police ‘occurrence' numbers for reference.
7. Madam will be a blatent liar if she states that her police failed to identify me while Cardiff Magistrates remanded me to prison to stay until some passing pigeon may ‘recognise me'.
8. Madam will again be telling 'porky pies' if she is to sign a sworn affidavit that her police did not conduct a campaign of harassment, my having to present my valid driving documents 35 times with their harassment stopping almost to the day, 29^th May 2002, when my name was removed from the veterinary register by their complaint to the Royal College of Veterinary Surgeons in the climate of 120 failed police prosecutions. This, despite the current stench of our UK judicial system controlled by HM Attorney General, HM Government and HM Partnership.

Oh yes, I almost forgot. Nor does she have knowledge, the published affidavit next week will reveal, of the 30 odd incidents in the 4th and 5th Action for damages, currently blocked from disclosure by HM Partnership but her planned retirement before we go to court, my being refused a jury trial of course, is unlikely to deter my issuing the occasional witness summons.

Today I was also informed I am to pay the costs of my application for above disclosure should I lose the trial in some year hence and I ‘appear' to be 'out of time' to appeal it, despite the draft court order never being agreed. So I am yet to receive a ‘sealed order' upon which to appeal.

[To the new reader on this site I must explain. All my court actions in the past 15 years have been spirited up/down to the HM Attorney General, his team of Whitehall lawyers and defendants interrogated, in order to prevent my disclosure application being heard. The RCVS/SWP/HO ‘relationship' all relies now on Section 42 ‘legal professional privilege'! HM Attorney General and HM Government are, we are repeatedly told, independent of HM Court Service and HM judges nor could they influence the 1967 RCVS Royal Charter despite admission by the RCVS it is, in itself, in clear breach of the farcical 1998 Human Rights Act both ratified by Her Majesty in Council].

This new blog site is designed to keep off my 'fun blogs' any future serious anecdotes, heavy documents or evidence of malfeasance and scandal witnessed in the dreary but scary world of deceit and treachery, our UK law courts. Driven by avarice the tax payer funded 'gravy train' is clearly out of control. The fact that it has destroyed much of my life, searching for that man-made concept, 'justice', and, some believe, has seriously damaged marriages and prime time with my children, in their formative years, is a stark warning to others, maybe, contemplating the idea of 'throwing stones at men in tall towers' when unable to get independent legal representation.

Both my father and mother insisted we six kids had a duty to pass on our privileged education and knowledge of life to others, less fortunate or not, who may benefit but without fear nor favour. Sadly, the legal world is not what it was in the 'good old days' when mum was asked to be a magistrate!

Apologies for my English grammar and spelling throughout this web site. I gave up Latin very early on at school for the sciences and obtained only 45% in O Level French, English 'language and liturature', the bare minimum for a university place!

I receive a message today from the House of Commons fixing a meeting with my Member of Parliament who has been kept in the picture ever since the day I sat at our last meeting, in 2002, complaining the very same issues as they are today!

As the Piper Tomahawk, from Cardiff Flying Club, flew over our head, I pointed out Christopher Paul Ebbs, a villain in the general aviation industry and immune to prosecution by the CAA, would have signed the aircraft out for 'pleasure flights'.

Later the local police, hot foot from falsifying evidence at my RCVS enquiry to have me struck off, were made to state to Mr Smith that Ebbs, a thief and fraudster to boot, was immune to prosecution, due to his long periods in a mental home!

I decided to deliver my urgent letter to HRH Prince Charles, personally, but was thwarted by two burly policemen at the entrance to Highgrove House, Tetbury, Gloucestershire.

I was originally going to deliver it by 1943 Piper Cub, registration G-KURK and land her just outside the prohibited zone to walk the short distance to his Royal Highness's residence. Kirstie suggested that that was not such a good idea, bearing in mind my recent protracted stay in Texas State Lunatic Asylum, in Austin and subsequent deportation. This followed my failed attempt just to leave a 'thank you letter' at the front gate of President Bush's Crawford ranch, for saving my life. [US Coast Guard helicopter after my ditching in Caribbean near Haiti].

The police and I left on the best of terms but with their parting suggestion that I could always take the letter to the Post Office in Tetbury town raised the problem as who would be paying for it, if it were to be posted without a stamp bearing Her Majesty's portrait?

Anyway, I did not leave empty handed. There on the ground was a fine *** bird for the pot most likely one of the household's birds not picked up after the recent pheasant shoot!

It was then a drive down to Hampshire to continue work on the Cub for the flight to Cape Town or Mount Everest?

HM Partnership and the state of our Welsh Courts

Twenty-one times the Guernsey Authorities locked me up in prison, invariably but for a few days, before charges were dropped. Generally they were of a trivial nature, created for but one purpose, to disrupt my single handed veterinary practice and to bankrupt me.

My sick partner had already left the island, almost penniless, for me to attempt redress through the local courts. He also had suffered under the feudal system, by his premises and our business and personalty having been fraudulently obtained by another veterinary surgeon, Alistair Macrae, only achieved by the unlawful conduct of lawyers waived through their incestuous system by HM de Vic Carey, the then current HM Procureur. Both Nicholas and I were denied United Kingdom legal representation.

De Vic Cary later, in 1987, gave evidence against me before the Royal College of Veterinary Surgeons, but his evidence was disproved causing the case against me to collapse. De Vic's grandfather, incidentally, during the Nazi occupation identified to the enemy young Jewish girls working in the hospital and on farms guaranteeing their fate in the gas chambers. Sir Winston Churchill wanted the man hanged but, with a change in government, he instead was knighted. I published copies of his collaboration papers and other evidence as to just why the Channel Islands were never to be trusted for the D-Day landings.

I left Guernsey abruptly after my life was threatened by the in-house freemasons, there being an ever increasing number of us now exposing to the world the appalling state of so called ‘British law and order' in both Jersey and Guernsey with their exploiting ‘insider dealing' and the drug trade.

Therefore, Your Highness, when I settled in the Principality of Wales and bought a veterinary practice in the Vale of Glamorgan, I expected some semblance of order and sanity. Instead over thirty law firms refused to act for me against the South Wales Police, once their ten years of harassment commenced.

Racial discrimination was palpable. This police harassment originated from Guernsey, as ‘disclosure' of documents later revealed. By way of example I was made to produce my perfectly valid driving documents well over thirty times and spent many days in police cells only to have cases repeatedly laughed out of court, while surveillance teams broke into my surgery and communicated with Guernsey where I had had my telephone tapped continuously (loud speaker in police station) for over two years.

In 1993 I had been dehorning beef cattle on Your Highness's farm at Boverton, Llantwit Major, only to find myself, within hours, locked up in some Cardiff police cell before prison for days on the pretext I was in possession of a ‘stolen motor cycle', a ‘garrote type instrument' and ‘could not be identified'! I had been bundled into a police car, in handcuffs, from the steps of my very own surgery with one old lady, I remember, clutching her sick Pekinese in her arms saying, "What are you doing with our vet?"

Fifteen years later, with all charges dropped and still no facts before any proper enquiry, the HM Home Secretary's lawyer now admits, in a Cardiff Court, that there is an ongoing six year investigation in Whitehall as to whether I am to be certified as a ‘vexatious litigant' or not.

HM Court Service, HM Treasury Solicitor and others have been made to confirm that at every major stage in my litigation, to obtain damages for over one hundred and twenty failed criminal charges and police conspiracy with the Royal College of Veterinary Surgeons, to have my name removed from the register, HM Partnership was ordered to intervene, informing all parties but me.

For example:

1. HM Attorney-General, in around 2003, ordered all my civil and criminal cases, past and ongoing, be collected up from around the country and sent to his team of HM lawyers in Whitehall.
2. This meant my Appeal to the Court of Appeal for a Trial by Jury, a basic civil right, against the South Wales Police, was delayed for seventeen months with no explanation or apology.
3. This meant that when I employed a barrister, to brief him on the Cardiff court files, they were not there but more to the point no one would admit some are now lost or with HM lawyers.
4. This meant both Mr Justice Kay and later, Lord Thomas, stated my appeal from Swansea court was ‘hopelessly out of time'. The Court of Appeal stamp on my lodged papers clearly indicates in my favour, stamped but a few days from the Swansea Abuse of Process. These court papers were never before Mr Justice Kay or neither judges bothered to read them having already been told I was marked down as ‘vexatious in all fields' by Mr Justice Andrew Collins, in 2003, as so clearly indicated in HM Treasury Solicitor internal memos on http://www.kirkflyingvet.com/ .
5. This has meant my applications for HM Judicial Review, fifty or more, have been prejudiced from the start with perfunctory nanoseconds set aside for the purpose. I recall one of many before their Lordships, a Mr Justice Scott-Baker, coming to the Cardiff court clearly without the London lodged papers and rabbiting on about the wrong case.
6. This has meant my complaint of the conspiracy by RCVS lawyers, falsifying witness statements and deliberately misleading courts on the availability of witness evidence, enjoying immunity to prosecution by the 1967 RCVS Royal Charter, has become the best ‘Whitehall farce' to date.
7. This meant all court transcripts and tapes, now needed to prosecute, were copied to HM but the Cardiff court deny it, having destroyed originals before my case has even left the traps!

I ask, Your Highness, for your urgent intervention in the interests of justice and the Welsh community.

Now, would you believe, John Smith MP, our representitive in HM Government, has arranged for us to go up to see him next week in the Houses of Parliament and discuss a 'few issues' about the current state of our judiciary.

I remember flying back from an airshow, some years back, with Genevieve asleep in the 1940 Taylorcraft, when I experienced serious engine trouble over Highgrove House. Fortunately I had enough height to glide to His Grace the Duke of Beaufort's air strip at Badmington. The temporary disappearance of his new Range Rover and tea at The House is a far, far funnier story for me to tell and will be one for the daughter to recite one day.

Please find attached details for your information. I spoke to one of your partners in April 2008 regarding Mr Kirk landing his light aircraft near the ranch of President Bush, when he was apprehended by US security services and received a psychiatric evaluation before being deported to the UK.

Mr Kirk has come to the attention of FTAC on 06/01/2008 when he attended Highgrove House where he attempted to hand in a letter to Prince Charles. I understand the letter was an account of his grievances against South Wales Police, against whom he has made 121 complaints.

After leaving HIGHGROVE he went to TETBURY Tourist Information and enquired if there was a rear entrance to HIGHGROVE (not given any info)

The purpose of my enquiry is to share this information with you and ascertain whether Mr Kirk's mental health might be an issue in these matters.

Since my humble petition of 1^st January, explaining HM Court Service's refusal to disclose the whereabouts of court file, marked, Maurice John Kirk - Potential Vexatious Litigant, HM Home Secretary has now obtained a court injunction to protect all four defendants, the Royal College of Veterinary Surgeons, South Wales Police, HM Attorney General and herself from disclosing evidence or on any communications between them about me. They enter their seventh year, using HM Whitehall lawyers, in their attempt to have me certified as a ‘vexatious litigant' to block disclosure of malfeasance.

Each defendant has successfully claimed Section 42 Legal Professional Privilege, not to disclose evidence, in their joint investigations relating to removing my name from the veterinary register, prosecuting me in countless ridiculous Crown Courts and more recently, to having me unlawfully gaoled.

When I produced proof of HM Attorney General, employing the HM Treasury Solicitor and Mr Justice Andrew Collins, all identified on HM documents, the judge had to explain that the Attorney General may not have ‘legal professional privilege', as ‘an independent body' from judiciary and executive but when asked as to just how I had obtained so many confidential documents I felt obliged to offer many more memos between HM departments revealing their own respective agenda, all reflecting nefarious conduct.

I will appeal to the Court of Appeal and a fat lot of good that will do while HM judges continue to swear oath of allegiance to Her Majesty the Queen, giving agents of RCVS Royal Charter preferential treatment. These very same judges, identified in my fifty odd Judicial Review Applications, for disclosure, have clarified my complaint to have sufficient merit for some alternative intervention, lawful or otherwise.

Now my own doctor, today, has received a request from an HM government department, not a stone's throw from HM Attorney General's offices, purportedly following ‘complaint' from police, to consider as to whether I am mentally fit to fly my various aircraft and should I not immediately be sectioned?

I have few options left, in the pursuit of justice, other than to plead the notorious ‘Royal Prerogative'.

Complaint against HM Home Secretary, HM Attorney General, South Wales Police & RCVS.

Dear Sir,

Further to my complaint against the Royal College of Veterinary Surgeons' refusal to disclose any ‘contemporaneous notes' of their investigation to have me struck off I cite further parties refusing to disclose very much related evidence, contrary to your 1966 Data Protection Act.

I enclose HM Attorney General's private law team, HM Treasury Solicitor's 5^th December 2009 letter, my 1^st and 13th January 2009 letters to the Prince of Wales and Abuse of Process Application details re South Wales Police's failure to disclose, referred to in JR Section 8,The Facts, by way of a summary leading to the obvious question.....How on Earth can all these claim Section 42 Legal Professional Privilege?

1. RCVS never disclosed to you their ‘notes' or identify their client(s) or lawyers did they?
2. South Wales Police deny police recorded incidents ever happened to avoid your DP Act!
3. Attorney General and his ‘private law team', when you examine HM 23^rd July 2003 internal memo, enclosed, has no legal right to withhold details of their communications with my defendants, RCVS and South Wales Police, have they? Communication and exchange of evidence was without my knowledge and refusing to disclose is not just an Abuse of Process it is contrary to Data Protection Act1966, isn't it?
4. Similarly, the Home Secretary's refusal to disclose information about me, [my complaint police disclosed confidential records to RCVS,] to have me certified, in the manner it was collected, affecting my ongoing litigation would also be unlawful if disclosure continues to be denied, wouldn't it? But what has HM Partnership told you to do about it?

Where on Earth is the evidence of ‘confidential client/lawyer communications' if they are not unlawful undermining my damages claims currently before the law courts around the UK? Just who are the clients and lawyers and where are the compulsory Law Society contracts?

Abuse of Process Application

Dear Sir,

Re your 30^th Dec 08 Court Application Refusing 17 years of Disclosure of Police/Crown Prosecution Service ‘Abuse of Process' by tomorrow

HM urchins in Guernsey, it appears, put me in good stead for my dealing with the obvious filth I have now been subjected to whilst here in South Wales and with those influencing the Royal College of Veterinary Surgeons with their plotting with CPS and HM Partnership to deprive me of my livelihood.

I enclose 18th Dec 2002 letter [see recent downloads] to a Welsh Crown Court as a sample from of over 200 applications for disclosure of the usual police contemporaneous record in some 300 odd incidents, many leading to my unlawful incarceration. I asked at the scene, taped in custody, by letter the following day or in the 300 days or so of farcical Magistrate and Crown Courts not forgetting the most insulting of all, the 50 odd Judicial Review Applications before HM High Court judges fast asleep in the Royal Courts of Justice.

Leaked HM internal memos clearly indicate these judges were influenced by the HM Attorney General's personal intervention to block any further disclosure of the ‘conspiracy to pervert the course of justice' by the above mentioned. He failed miserably to have me certified as a vexatious litigant and so HM Partnership has stepped back into the fray to ‘*** up' any remaining legal process to which I am entitled as a British citizen currently living, but not for long, in the United Kingdom.

The incident before the 2002 Crown Court was used by the RCVS lawyers to have me struck off as a veterinary surgeon for life still refusing me, just as your client and CPS do, the identity of witnesses and copy of ‘contemporaneous notes' of their official enquiries. There is nothing new under the sun.

I disclosed to you 70 odd leaver arch files, ‘under my control', of my record of 10 years of harassment. I now have a similar amount since released from lawyers ‘not then under my control'. Do you need them?

You disclose the full record of the South Wales Police communicating with the Royal College of Veterinary Surgeons, in order to prevent me practicing veterinary surgery and I will withdraw all current civil actions against your client, Barbara Wilding of the Chief of South Wales Police.

JR Part 8 Facts For well over ten years now, in South Wales, I have suffered racial discrimination while asking successive courts to entertain my mounting evidence of Abuse of Process and general malfeasance by many employed by the tax payer supposedly to administer justice.

The sequence of documents below, pages 9 to 56, is but a sample disclosing relevant facts as to the scale of intrigue to which they stooped in order to prevent disclosure of favourable evidence in my cases. Disclosure was withheld by the Royal College of Veterinary Surgeons and by their complainant, the South Wales Police, in order to have my name removed from the veterinary register.

Leaked HM Treasury Solicitor internal memos [p.11], CAA Legal Dept. [p.56] and my damages action led to HM 30^thSept 08 Application Notice to reveal there had been a six year ongoing investigation by HM Attorney General, attempting to have me certified as a vexatious litigant and for what purpose?

Documents below will disclose these three defendants have been aware of this investigation for years and have been consulted by other government officials, without my knowledge, as to the scale of disruption it is doing to all three court proceedings, disclosing evidence to the Ministry of Justice and Home Office(3rd defendant) the fact that the South Wales Police originally, having lost their 120 criminal charges, 35 times demanding to see valid driving documents, invited the RCVS to Cardiff Central Police Station to take away copies of confidential police records, contrary to Home Office Regulations 45/1987, some of which were incorrect. This falsified evidence by the RCVS lawyers remains unpunished.

Even the Information Commissioner, following my DPA and FOI Act Applications for the RCVS to disclose their contemporaneous notes of their interviewing my clients, deemed this evidence as ‘lawyer /client privileged'! There is little evidence that interviews were even conducted by a lawyer, to the contrary.

The RCVS and Commissioner's department refuse to disclose what ‘client information' was purportedly put before him to indicate my veterinary clients and the investigating police were neither competent nor compellable for the witness stand. My clients and a local magistrate and a teacher were but a few interviewed by outside agents and identified staff from the college. ‘Lists' served on the RCVS of when, where, why and by whom evidence was gathered, following the Legal Assessor, Mr Flather QC, laying down terms of reference in open court for RCVS to DISCLOSE, continue to be ignored because the RCVS is protected from contempt of court legislation under the 1967 and 1844 RCVS Royal Charters.

No contemporaneous record of the investigation relating to prosecution evidence used in court has ever been disclosed, contrary to Article 6 of ECHR 1948 or Human Rights Act 1998. HM Treasury Solicitor has supported it in his submissions in Cardiff County Court, only this month, saying the vexatious litigant enquiry is ‘confidential' while he, the police and the RCVS have all been consulting each other while many of my current and past court files have been gathered up from around the country's courts and lost. These ongoing cases, HMCS have just admitted, have had their court tapes destroyed before any substantive hearing has even started and while my appeals are ongoing on in the Court of Appeal.

Malfeasance by blackmail is not uncommon. In 2001 I was denied any witnesses of fact by the RCVS to counter the evidence by police called as prosecution witnesses. HM Treasury Solicitor's office, confiding with my witnesses [see enclosed 23rd July 2003 HM Treasury Solicitor internal memo, page 11], threatened me with a bill of £6000+ should I persist in serving witness summonses on the very HM lawyer needed to attend the RCVS hearing with the evidence I needed to prove most of the above.

Just why, after seventeen years of litigation, this started in 1992 and six years with a team of Whitehall HM lawyers, is this same enquiry still going on in secret and just who is paying for it all?

This JR Application is to reveal to a competent court evidence that the defendants, RCVS, South Wales Police and now Home Secretary are in ‘harmony', refusing my right to be a member of the profession simply so I cannot get access to the college records to clear my family's name.

This so far undisclosed reason by the RCVS for failed disclosure is disproportionate to my refused right to practice veterinary surgery and is an Abuse of Process and requires criminal investigation.

The manner in which all three enquiries against me were conducted was an Abuse of Process.

Failed disclosure by the South Wales Police, denying incidents such as police breaking into my surgery with a crow bar and sledge hammers, locking me up in Cardiff prison saying "he cannot be identified" and denying court cases ever happened, can only be sorted in a criminal court, not some Welsh civil court behind closed doors denied a civilian jury.

Whilst lawyers continue to bury evidence of this once simple case of police harassment, with their tactics to delay ‘due process' at every turn, this never ending game of gutter warfare, purely to fuel the ‘gravy train', will soon make Charles Dickens's ‘Jarndyce and Jarndyce', as an example of avaricious attorneys, looking more like a mediocre mélange of a teddy bear's picnic crossed with Lewis Carol's Mad Hatter's tea party. But who out there really cares that the culprits, clear criminals, always get paid?

Legal professional privilege

10. Personal data are exempt from the subject information provisions if the data consist of information in respect of which a claim to legal professional privilege or, in Scotland, to confidentiality as between client and professional legal adviser, could be maintained in legal proceedings.

This interpretation of law, upon which all three defendants purport to rely, is yet another abuse. ‘The Royal Prerogative' allows each, in turn, to refuse disclosure of relevant evidence gathered by their respective investigation teams to prosecute Maurice John Kirk because each judge in turn has been made to swear allegiance to the Queen instead of the citizens who are paying for the ‘gravy train'.

Leaked HM Treasury Solicitor 23^rd July 2003 memo, enclosed, reveals the CAA have also been made by the HM Attorney General to communicate, as Defendant, with the HM team of Whitehall lawyers, in their joint attempts to have me certified.

May I suggest you ask for disclosure of those CAA documents when considering whether I am to be certified to fly or not?

Both the Royal college of Veterinary Surgeons and South Wales Police refuse to disclose anything on the matter of this 7 year HM Attorney General investigation.

My Abuse of Process Application, citing the damage it has done to my veterinary, flying and family life, is repeatedly swept under the carpet by successive judges because I hold the proof of misfeasance and criminal conduct by lawyers.

It may not surprise you to know my FOA and Data Protection Act Applications, to make CAA's Mr Stephen Williams disclose this HM Partnership interference, bore no fruit, yet.

So just whom am I expected to believe, bearing in mind it was the CAA that had me put in prison in 1980, destroying my aviation career, on trumped up evidence, sending bully boy retired police officers around to witnesses at the dead of night saying, "if you do not give evidence against Kirk we will take your licence instead"? I had been neither the pilot, registered owner nor drunk, contrary to the way the CAA lawyers put it to the ‘bemused' in Bournemouth Crown court.

I have sent you some fax material and an e-mail earlier this morning concerning my licence suspension in May 2008, pending enquiry, following my encounter with the US Department of Homeland Security, Texas, with subsequent deportation.

I have now found the document you need, enclosed. I made the doctor in Texas State Lunatic Asylum, Austin, write out and sign, witnessed before me, before I would agree to leave the hospital building to pursue my rights in court convened upon my insistence. The British Consulate clearly kicked up a fuss and I thank them for it.

US Authorities arrested me while I was on a country stroll in Texas, trying to get a photograph of a scissor bird. While in chains I saw neither the President's Men ,FBI, The Sherriff nor his many deputies make any written record at all of my incarceration other than the details from my passport and home address. They ALL refused to write down my detailed statement of explanation. The FAA told me,witnessed by others, I had committed no aviation offence in landing in the farmer's field many miles from Mr Bush's ranch.

My demand for a ‘Habeus Corpus document', where I had been and that I was still alive, was because no ‘audit trail', to date, appeared to have been created during my detention, as far as I could see, either at road side, 11 police vehicles, in Waco Prison, Waco hospital or in various police cars and now, in State Lunatic Asylum . Not dissimilar to my experiences with the RCVS, refusing to disclose any contemporaneous notes of their enquiry. I do not frighten easily but what I witnessed in Texas, up until US guards let go of me at Gatwick Airport, is a stark warning to the world. I demanded such a document, as I do for all custody records, be created by my captors for I have found so often, without such record, RCVS, police and now the CAA, rarely believe a word I say and will spend a small fortune to prevent me enjoying respective ‘privileges' my qualifications were supposed to guarantee. No police escorted me to my aircraft in the cow field, as the doctor's note portrays, they were seen gathered under the trees, half a mile away, with surveillance gadgets and a ‘surface to air' missile, no doubt.

I went with witnesses to the court hearing in the Texas hospital only to be told by a lawyer there, again witnessed by Alvin Howell, the case had, as the attorney put it, "air- brushed out"! Court officials refused to let me get access to any public record of its existence. Good ‘Old Uncle Sam' and so called human rights.

I chased over 50 JR Applications in that ridiculous building, the Royal Courts of Justice, London, knowing full well the lawyers in the RCVS would use those trivial motoring convictions to have me struck off. I believe HM intervention was originally to investigate the South Wales Police conduct following my complaints but everybody is keeping their traps shut.

It was encouraging to see the way the June 08 CAA memo described these minor South Wales convictions. A pity someone in the CAA could not back me on that point against the RCVS, refusing my right to practice veterinary surgery.

It is therefore of interest to me that the HM Attorney General instigated, both in 2003 and last year, an enquiry with the CAA to get information from their Legal Department to get me certified. I must start new applications concerning failed CAA disclosure.

To be certified as a vexatious litigant does have its advantages. I could not think of anything more enjoyable as to never ever having to enter such sewers of depravity, UK court rooms, each in there trying to outdo the other by their level of deceit.

The Information Commissioner has interpreted the purpose of the Act by stating the RCVS ‘need not disclose the evidence', gathered from my own clients, by lay staff of the college, not even to him. His communications with the RCVS, supporting this argument also, of course, remains ‘privileged'!

The HM Treasury Solicitor, in court last week, on behalf of the HM Home Secretary again refuses to disclose anything concerning the 7 year investigation on me where the HM Attorney General' ordered all three of you defendants to communicate with each other and disclose the undisclosed evidence, in respective ongoing court cases, without my knowledge and contrary to law.

Supply evidence, to which I am entitled and I will withdraw most Actions currently before courts.
