Dear Sir,

A Mr M Bowen informed me that he attended the last court hearing as my Mackenzie Friend, in March, to find HM Court Service had ONCE AGAIN interfered with justice this time by withholding documents from the judge that I had sent due to my inability to attend.

Had Mr Bowen not had the foresight of the games Welsh courts seem to play with me and had already photocopied my pleadings, that the case should be stayed, to be moved to a higher court, the judge would not even have known about it!

One such document that was not read by the judge, in the time available, his anger for HMCS interference being obvious to all in the court room, is yet to be confirmed.

I have therefore lodged a Judicial Review Application with the Administration Court for the purpose of Their Lordships, outside South Wales, becoming more aware of the clandestine behaviour so often metered out by HMCS in South Wales.

Enclosed my 10th March position statement following the court hearing needing your response

Leaked internal memos, enclosed, between the manager of Cardiff Civil Justice Centre and the HM Treasury Solicitor is but one example of your apparent unlawful conduct to pervert the course of justice.

Please identify the document, to which I refer, in order that there is proof of all this for the Court of Appeal and explain why the judge was not supplied with my comprehensive pleadings by HMCS, sent to your office days before the hearing by e-mail?

Dear Mr Carwyn Jones AM and Mrs Edwina Hart AM,

Re: My Welsh Operation will now be in France. Is this the best future for Wales?

Important New Evidence that tests the State and Future of Wales NHS.

Mr David Sissling leaves as the local Chief Executive at ABMU LHB to be Chief of the Welsh NHS in May 2011. Edwina Hart as Welsh Health Minister and Mr Win Griffiths as Chairman ABMU LHB were being very helpful by seeking Mr David Sissling to address my concerns.

However, is it your place to intervene on the bigger issues and policy effect on the culture of the Welsh NHS, by whether the future NHS Chief Mr David Sissling's approach is appropriate, for the people of Wales to have confidence in the oversight by Welsh Ministers?

"Clear Evidence" of Brain Damage/Cancer - Available Facts about Dr Tegwyn Williams:

1) It appears, especially given his constant refusal to comment, that Dr Tegwyn Williams decided this brain damage existed without using any appropriately medically qualified doctor to allow or support his conclusion.

2) Yet it seems, when not using anyone medically qualified to progress such a view, that in 2009 Dr Tegwyn Williams wrote to the Crown Court to say that there is "clear evidence" that I have brain damage. Furthermore that the brain damage (that Dr Tegwyn Williams says exists) is supposed to also, according to Dr Tegwyn Williams, give an incurable condition leading to an unhelpful behaviour change, so to support that I may need to loose my liberty indefinitely, when I have never been convicted of any relevant or serious offence.

3) Furthermore, Crown Court transcripts of 2 December 2009 record a Crown Prosecution Counsel, Mr Twomlow, saying that Dr Tegwyn Williams wishes his concern about my having brain cancer to affect the decisions by the Crown Court.

"No" Brain Damage, "No" Cancer: by Two Sets of Evidence from both France & Wales.

4) In August 2009 properly qualified medical doctors at the Princess of Wales Hospital, Bridgend and later, in Southampton University, give an ‘all clear' brain scan result.

5) Yet, Dr Tegwyn Williams asserting brain damage or cancer means that my urgently needed hip operation cannot occur until surgeons are certain of what conditions may exist. Limited disclosure of records only added to confusion and delay as Dr Tegwyn Williams refuses to clarify about brain damage and cancer.

6) In February 2011 properly qualified medical doctors in France did a new brain scan and concluded also an ‘all clear' brain scan result.

Questions I ask be answered:

1. Do six Medical Opinions that contradict what Dr Tegwyn Williams says and his refusal to comment, adequately present a reasonable suspicion for the employer, Mr David Sissling, to act?

2. Why is there inaction to protect minimum standards, when ‘to be seen to act', the employer only needs to ask the General Medical Council to investigate to form their view?

3. Will this inaction justify more people to be forced to refuse to use a belligerent Welsh NHS?

4. Why is the future leader of the Wales NHS allowing and so supporting Dr Tegwyn Williams to behave as he does?

5. I am an Englishman granted Asylum in France in order to avoid Dr Tegwyn Williams' jurisdiction to use his opinion again to cause more harm or affect my liberty.

6. If I have to go to the additional strain of proving in the Welsh civil and criminal courts, by way of a private prosecution, that Dr Tegwyn Williams has acted dishonestly and maliciously, will my needing to so act spearhead that the Wales NHS uphold the basic minimum standards or will I inadvertently, as good as prove that Mr Sissling and therefore Welsh Ministers have abandoned important responsibilities and duties for which they take office and are paid?

7. My wife and daughter continue to live in the Vale of Glamorgan. Can I have your assurance the serious erosion of minimum standards in the Welsh NHS will be immediately addressed and rectified?

As you are both experienced and able politicians, I am sure you will welcome that I look forward to placing your reply alongside various comments on my website.

Hip Operation, on 20th January in France to go ahead, following late phone call from Morgan Cole ,solicitors, for NHS, saying, if my Welsh GP asks Mr David Sissling, NHS Area Manager, for South Wales, he will obtain the information from Dr Tegwyn Williams of what he told the 2nd December 2009 Crown Court. Court transcript reveals I had a brain tumour and therefore too dangerous to be released and must be sent to a High Security Prison, like Broadmoor.

But fresh medical evidence, on the 17th December 2009, given to the MAPPA (Multi Agency Public Protection Arrangements) of police, prison ,probation and social services, hosted by Dr Tegwyn Williams, in the Caswell Clinic Bridgend, found his evidence had been proved false so the Prison casually told me, that same afternoon, nothing other than I was no longer MAPPA level 3, terrorist level and likely now to be eligible for bail!

I understand yet another UK doctor is seriously concerned and has written to the GMC, direct, about this lack of clarification on such a serious subject as a brain tumour.

It is urgent, this morning, that you arrange this clarification with my Barry GP and for me to have copy to deliver, this afternoon, to the hospital in France

Dear Madam,

Thankyou for your telephone call , last night, AT LAST giving me assurance that if my GP in Wales immediately contacts, again, the appropriate NHS personnel with the missing medical information , known to Dr Tegwn Williams, needed for clarification, it will be released before lunch, in order for the operation to go ahead on the 20^th January 2011.

Your apparent black mail tactic has worked. By serving on me an extortionate bill of costs for £6000, just for my claiming for out of pocket expenses, in the Petty Debts court, for travelling, numerous times to the Caswell Clinic, following your client's promises relevant medical records were awaiting collection at the porters lodge, only to be refused.

Records to be released, this morning, I understand from you, about my serious medical condition of significant brain damage and possible brain tumour, will be from November 09 to 9^th February 2010 and will be complete. You said you would also put it in writing.

On 9^th February 2010 it was considered safe, now, to release me back into society as the South Wales Police no longer considered me a serious risk to the general public.

Withdraw Claim

There is little point in my pursuing my petty debt claim, on the 20^th January 2011, in Cardiff, for the bus and taxi fares so I am willing to sign your proposal but expired yesterday.

You state your £6000 bill will not be pursued subject to my signing I no longer need those unusual, extreme and indefinite medical records, falsified by your client, Dr Tegwyn Williams whilst under pressure from the South Wales Police to interfere in the ongoing civil damages claim for numerous malicious prosecutions and false imprisonments.

I need to have, urgently, your new proposals in the light of this agreement to disclose records.

We refer to your letter emailed to us earlier today.

We would refer you to the email sent by our Miss Tina Whitman at 10.35 am this morning,
which advised you of the correct procedure to be followed in order to allow your treating
consultant to obtain any records which he or she considers necessary in order to undertake any
treatment you require.

As advised, the appropriate procedure is for your treating consultant to write to Morgan
Cole with details of the records required and we will arrange for Abertawe Bro Morgannwg
University Local Health Board (‘the LHB') to action the request in accordance with their usual
procedures and provide the records directly to your consultant. As we have previously stated,
no request for records has previously been received by the LHB from either your treating
consultant or your GP.

We note from your letter that you understand that the records will be released today and
provided to your doctors in France by tomorrow. We must stress that that is incorrect and does
not reflect what we advised you, either by telephone or email. As stated, no records can be
released until your treating consultant makes a written request and even if that request were
to be received today, it would not be possible to get the records to the relevant doctors by
tomorrow.

Further, as you accept, you have already received all of your records as held by the LHB.
As we understand it, the period which you, and your consultant, are interested in relates to
December 2009 to February 2010. These records were disclosed, in their entirety, to you on 9
June 2010. Therefore, you already hold all of the relevant records and these could be provided

to your consultant by you if required. For the avoidance of doubt, we can advise that if your
consultant were to request records from the LHB, then he or she would not receive anything

We also understand from your letter that you are prepared to discontinue your claim against Dr
Williams on the terms set out in our letter of 7 January 2011. If this is the case, then we would
be grateful if you could sign and return the attached consent order today. May we suggest that

Falsified Medical Records

Further to your e-mail of, an hour ago and NHS counsel's confirmation letter of today's date, I enclose the response, you asked, in order for the urgent matter to be resolved today, with the release of December 09 medical records.

,Enclosed is my surgeon and anaesthetist letter, 'to whom it may concern', of the Vale Hospital, Vale of Glamorgan, as you both know, had their request before His Honour Judge Cooke QC who refused to intervene which is why the operation has been delayed since June 2010.

Note the enclosed letter of both my anaesthetist and Barry GP have names redacted as this document is for publication on web site, http://www.kirkflyingvet.com/. BUT it has the Cardiff Crown Court stamp on it and is Exibit I at the shortly to be heard Criminal Court of Appeal hearing in England, well outside Wales, that takes preference to your local attempts to hide the truth.

The truth behind my medical state, my then being incarcerated under HM Prison 'care', when Dr Tegwyn Williams, under oppression of the Welsh Crown Prosecution (South Wales Police), whilst attempting to avoid a ridiculous 'machine gun' trial that was bound to fail, alone asked His Honour Judge Bidder QC, tape recorder carefully switched off and copy of court log refused, by HM Court Service, to have me locked away for life, yes, in Broadmoor without trial.

My South Wales GP has confirmed again, today, their is nothing in my NHS records, for December 09 ,to date, referring to the 2nd December 09Crown Court medical evidence or Dr Tegwyn Williams complete reversal of his evidence at in his hurriedly arranged Caswell Clinic meeting of 17th December 09 with the prosecution, South Wales Police in attendance.

An appliication ,today, therefore has been lodged with the Trial judge in the 19 year running civil action for damages, CF101741 + 8 others, for disclosure of those very medical records, I am told, will be found in the MAPPA minutes.

May I suggest you consider your own positions in this and stop pissing me about when you know truth that those medical records are still in existence as MAPPA Minutes that every Tom *** and Harry have read, so far, other than my surgeon and anaesthetist, awaiting to operate, the patient's general practitioner, under whom I have his care and the suffering patient, moi...

In the interests of justice I suggest mutual agreement to adjoin this 'bus fares' petty debt claim until the outcome of the criminal hearing [ no 201004016C1], in London

Dear Sirs,

Re Dr Tegwyn Williams, Dr Ruth Bagshawe and Professor Roger Wood

A friend has written this for me and it may helps to see some simple information. Below is a letter 31 December 2010 sent to Dr Tegwyn Williams employers, the NHS except , on the occasion, in court I was neither under his care as someone else had employed him, in NHS time.

1) It appears to me that Prof Rodger Wood is re-writing his report to help cover up what I believe to be the serious wrong doing by Dr Tegwyn Williams as in my letter 31 December 2010 (copy below).

2) Dr Tegwyn Williams said in Cardiff Crown Court, on 2 December 2009 (caught on transcript) that I had possible brain cancer with significant brain damage when it now appears, Dr Williams did not believe that to be true.

3) That is seemingly dishonest and/or malicious comment and may potentially be sourced back as coming from Prof Rodger Wood.

4) I believe Prof Rodger Wood re-wrote his report to hide that wrong doing. One point of evidence that Prof Wood re-wrote his September 09 report is that he refers to a retired Chief Constable who was not retired at the time of the report , retiring on 31^st December 2009.

5) I both saw and read the original document whilst incarcerated in the hell of Caswell Clinic ,Bridgend.

6) Both Dr Williams and Prof Wood now try and run away from their false writings and will not clarify where they clearly tried to seriously prejudice my major legal case, trading in machine guns, that I won to their detriment.

7) However both Dr Williams and Prof Wood now try and run away from their false writings and will not clarify, for their fellow professionals and employer, so that I cannot have my operation until my recent Wales anaesthetist and new French doctors know what is wrong regards cancer or brain damage.

8)Please can you urgently help so that I can have my operation? I am in very much pain and have been on higher doses of morphine for far too long so that the conduct of Prof Rodger Wood and Dr Tegwyn Williams puts my well being at risk.

Missing Medical Records

Dear Mr Sissling,

At present replies from the ABMU NHS regards Dr Tegwyn Williams avoid the critical issues. Here is one example to make it very clear

Dr Tegwyn Williams has been caught on court transcript on 2 December 2009 saying that I have brain cancer. He refuses to comment either way to clinical colleagues or myself regards his comments about my brain cancer which were said for a Court and other public authority to use. This prevents me having my hip operation. I am in terrible pain from your delay in dealing with Dr Tegwyn Williams.

As you will be aware, the news of Dr Tegwyn Williams conduct is increasingly known amongst public and patients, so that if you are unable to clear up this issue, the patient community is going to have such sound reason to avoid needed or essential care on the basis Dr Tegwyn Williams and his employers cannot be trusted. I believe that to be a fundamental failure in the duty of a public body and by public officials to carry out their obligations.

Do you think Dr Tegwyn Williams should tell Officials at Court that I have brain cancer, and then refuse to explain to me or my doctors?

I still cannot have my hip operation and am in despite pain. Please would you attend to this single issue without delay.

MAURICE KIRK

I am a Canadian writer who has been following the story of Mr. Maurice Kirk very closely, and I wondered if you would kindly confirm that:

(a)   Mr. Kirk, his Member of Parliament, and the Minister of Health wrote to you, asking for his medical files so that he could have much needed surgery, and

(b)   you have not yet provided them please?

I am working on a follow up story regarding one of the recent news reports about Maurice Kirk but, at the same time, I am writing another story on Britain today, which includes health care and policing, as well as other social issues.

Flying Vet Approaches UK Parliament in Fight against South Wales Police

Could you please tell me

(a) how long you can legally withhold Mr. Kirk's healthcare file in the UK, and what would be possible reasons for doing so?

(c)   what are the statutes of limitations in Britain and Europe, were he to sue you personally for Breach of Care Causing Harm, Failure to Act, and other gross negligence issues?

(d)   have you been mandated to withhold his file by police, or some other body and, if so, what are their reasons for that please? If not, is this an oversight, or have you been away on vacation with nobody to act in your place when you are absent? Is there a policy for staff to handle correspondence in your absence, or do they wait for your return?

(e)   Are you aware that it is also human rights issue to deny someone medical care, directly or indirectly, and that human rights activists around the world are monitoring Mr. Kirk's story?

(f)     Would you say that you will be in a position to respond to the letters sent to you by Mr. Kirk, his Member of Parliament, and the Minister of Health Edwina Hart by November 3, 2010? If not, could you explain please?

(g)   Are you aware that withholding medical treatment, either directly or indirectly, is not only Elder Abuse, but much worse?

(h)   Is this standard practice in the UK, or is it simply an oversight?

(i)     Is there a policy in the UK to prevent the elderly from expensive surgery or hospital stays, due to a drain on the healthcare system? Would this be a reason to deny Maurice Kirk's request?

(j)      Is there a shortage of doctors and healthcare providers, as there is in Canada, and would this be a reason to deny Mr. Kirk treatment?

(k)   Now that you are aware of the urgent need for Mr. Kirk's file, will you be able to deliver it please, or afford the MP, Minister of Health and Mr. Kirk the courtesy of a reply to their letters?

(l)      Would you be able to send it via express courier, or is there an NHS policy not to use couriers in your country?

(m)     Do you need to be supplied with extra copies of the letters that were sent to you? Have they been lost?

I very much look forward to hearing from you, as Canadians are puzzled as to why Mr. Kirk's files have not been sent. In Canada, his request would come under the Freedom of Information Act, and you would have only 30 days to respond to the request, so we are watching the outcome with great interest.

NHS Withheld Falsified Medical Records of Maurice John Kirk

It is over a year now since a Dr Tegwyn Williams and a Professor Roger Wood agreed to submit apparently erroneous medical evidence to the 2nd December 09 Cardiff Crown Court hearing with HHJ Bidder QC. They recommended I be sectioned to HM Broadmoor, IPP, Imprisonment for Public Protection.

I understand the Crown Prosecutor heard Dr Williams tell the court I may have a brain tumour along with the joint diagnosed opinion, of the two named doctors, that I had 'significant brain damage'. See here for request of information by HH Judge Seys Llewellyn QC and transcript of hearing.

1. HM Court Service refuse to disclose the evidence given to the judge either by my access to tape, transcript or court log, all public documents from a court of so called record.

2. No NHS doctor or South Wales NHS department, with that information, will respond to my request for that urgent record to be disclosed.

3. The GMC also appear to ignore my complaints on the matter which is, of course, of no surprise.

4. Lawyers, Morgan Cole, employed by you, have also failed to inform me of any reasoning as to why either my GP or myself are not entitled to that information, especially in the light of both my orthopaedic surgeon and anaesthetist, for my now long overdue operation, having also asked for it.

5. Various dubiously safe but unnecessary brain scans, taken in September 09, to recommend my further incarceration in NHS Caswell Clinic Prison were referred to in the 2nd December 09 evidence as significant. These scans were recommended, by both doctors, to be repeated within six months. No mention of this has since been made to me and despite my requests, both in custody and since my acquittal in February 09 of all charges, I am being refused any follow up scan or appropriate clinical examination.

6. HM Crown Prosecution Service, Cardiff, have also received the record used in that 2nd December 09 hearing. CPS, Wales, also refuse to disclose any of the proceedings, held in my absence, it having been dependent on this collusion with your NHS in order to avoid the January 2010 scheduled trial of scandalous indictments levelled against me, each carrying a five year prison sentence.

7. Your department's conduct in this matter, for well over a one year period, clearly points to criminal conduct by just too many in positions of privilege, the very reason for this widespread cover up.

8. So I wish to know for just how much longer you and others in the South Wales NHS intend to continue covering up this incident? Will you eventually break ranks or pretend I and my many supporters have just crawled back under a large stone?

9. In other words:
a.what prevents you from disclosing and releasing the specific documents in question?
b. why have Morgan Cole not written to me as you had announced?
c. why didn't you follow up by email when you wrote you wanted to deliver documents by mail?
d. if you think those documents satisfy my doctors' requirements, include the 2nd December 09 material, you can still send them to me at my address in France where I am in political asylum due to South Wales Police persecution and threat on my life: Puits aux Papillons, St. Doha, 22230 Merdrignac, Brittany.

Mr David Sissling, CEO of the Abertawe Bro Morgannwg University Health Board has not answered Maurice's letters of September 15 and 18, nor the one by Health Minister Edwina Hart AM or by Alun Cairns MP.

Hence I have asked Alun Cairns MP, on behalf of Maurice, to send this form to the Parliamentary and Health Service Ombudsman.

In support of 'having exhausted all complaint procedures' are two letters by Maurice and two by Health Minister Edwina Hart AM: of 7 September and of 20 October.
