First Petition to Parliament on Behalf of Victims of White Collar Crime

The following Petition has been submitted to our new MP for the Vale of Glamorgan, Alun Cairns MP, following a very lively debate at our 25th January 2011 House of Commons meeting with both Members of the House of Lords and House of Commons in attendance, a committee room, I may say, STUFFED with Victims of the banks, HM and our law courts, solicitors and NHS (see photo gallery, other blogs and PDF downloads).

To the House of Commons

The petition of Maurice J Kirk BVSc, a citizen of the UK at 52, Tynewydd Road, Barry CF62 8AZ, declares that he has tried everything in his powers as a former veterinary surgeon to stand up to the harassment of South Wales Police who have delayed his civil action against them.

The citizen has suffered from harassment by South Wales Police that culminated in 7 months imprisonment, including 3 months in a psychiatric clinic, after getting him struck off the Register of Veterinary Surgeons.

One of the incidents in a series of interconnected legal actions was the machine gun case. The allegation was the possession and sale of a ‘gun' even though it was decommissioned and an ‘add on' to an historic aircraft. In the run up to the trial, however, South Wales Police mobilised Multi-Agency Protection Arrangements (MAPPA) hoping to shoot or section the citizen for life. MAPPA categorisation was used for imprisonment which included 3 months in a psychiatric clinic. A leaked MAPPA document, published on his website www.kirkflyingvet.com, shows that the Police had a firearms response.

The harassment included the falsification of medical records claiming that he has serious brain damage, possibly brain cancer, to get him sectioned. This prevented his surgical team from carrying out a hip replacement scheduled for June 2010.

While the citizen won the machine gun case in court, he did not get any costs or compensation for malicious prosecution, false imprisonments and generally the deprivation of his human and professional rights as a veterinary surgeon.

The petitioner therefore requests that the Government steps in as Compensator of Last Resort

Dear Mr Cairns,

The 25th January meeting at the House of Commons was a resounding success with many Members from both Houses, with 'like minds', all in one room! The ever widening divide between the basic rules of justice and the conduct of the South Wales Police, our law courts, Crown Prosecution Service and now, HM Court Service, is really most serious because it is clear there is no accountability for their joint actions.,.

South Wales National Health Service and our Health Minister refuse to hand over my medical records in their current control and with CPS, police, Caswell Clinic, HM Prison, Cardiff, Dr Tegwyn Williams and Professor Roger Wood are all refusing to clarify, with my surgeons, my medical history when I was in prison custody meaning still further delay in my much needed hip operation.

When can I next see you, please, either in London or Barry? I have currently obtained asylum in France following the repeated attempts by the South Walers Police to either have me shot or jailed for life so any meeting must be before my witnesses and suitably recorded.

Beware of Medico-Legal Collusions – in and out of Court

Maurice has had to endure soooooooooo much trouble and to think up sooooooooooo many ways of defending himself while trying to live a private and professional life, that it’s hard for him to see the wood for the trees. However, as there are more opportunities for putting court documents together, he also goes over transcripts of past hearings and lo and behold, he makes new discoveries.

Here he puts together the essence of six documents:

1. Four pages of a leaked MAPPA memo that identifies why police deliberately set Maurice up as a target to be shot.

a. This is crucial evidence of the covert surveillance that Maurice suspected but Police had always denied. Maurice thinks he knows why it started on June 8^th, but he still has no idea why it ended on December 18^th.

b. The law says that offenders are entitled to minutes of meetings in which they are being discussed. Maurice has never seen any, and Police have never disclosed any either.

2. The full transcript (22 pages) of the hearing on 2^nd Dec 09 in Cardiff Crown Court, when Maurice was still in prison, fearing he might be sent to Broadmoor for life. The transcript commences at 11.39am. Almost a whole hour was not recorded. Maurice now realises that the reason was that William, the court clerk, had been told not to switch on the tape, while Dr Tegwyn Williams’ latest medical report was discussed, which, of course, he had never seen.

3. Another transcript - of the hearing on 17^th December 09 Newport Crown Court - (25 pages) poses a few interesting questions:

a. Is it the decommissioned machine gun (that Maurice once owned as part of an antique plane) that is dangerous or is it Maurice Kirk who is dangerous?

i. Will he commit ‘further offences’? To own and have sold a firearm where the ones alleged).

ii. Will he interfere with witnesses? (His offer on his website to reward information leading to witnesses made the Police worried.)

iii. Will he fail to surrender, if he is granted bail? (He wasn’t volunteering to report to a police station in Wales as he has suffered their harassment for decades.)

b. What are the considerations, threats and delays regarding his action for civil damages against South Wales Police to be listed for January 25^th 2010? This civil action actually only started on September 7 and is currently being adjourned until November 30.

c. It appears that Maurice could have been granted bail, if he had ‘behaved a bit better’. But it also seems as if he knew that what really mattered to the Judge, the Prosecution and, above all, South Wales Police, was to delay the hearing of his case for civil damages. That’s why, it seems, Judge Bidder apologised to Mr Twomlow, the Prosecutor: “I am very sorry, Mr Twomlow that I couldn’t help”.

d. One day after this hearing, his MAPPA surveillance was stopped.

4. 3^rd November 09 - a 26-page medico-legal assessment by Dr Silva was in favour of Maurice: “not suffering from a mental disorder of a nature or degree that would make detention in hospital appropriate.”

5. 1^st December 09 – a 5-page medical report by Dr Kemp – in favour of Maurice: ”does not show any convincing evidence of abnormality”...

6. Purported first page extract of 18th September 09 Professor Roger Wood medical report only released by NHS in June 2010. The original report, read, at the time by Maurice, inside Caswell Clinic, is being refused disclosure by Dr Ruth Bagshaw, to whom it was addressed.

Police Helicopter Chase near Highgrove

I would not miss the 24th Feb Barry Magistrates hearing for 'all the South Wales Police Pension Fund' the court heard when quashing the police restrictions refusing my leaving the country. It was therefore no surprise to be detained at Portsmouth docks on Tuesday night by my refusing to disclose 'registered police fixed residence for bail'.

I eventually get away only for my 'cut away speed model' aging Fiat Panda to 'blow up' on the M4 motorway in the pouring rain. Hitching, walking luggage and aching joints gets me to Lea's Pub in Malmsbury and another Lea driving me, Stirling Moss style, past Prince Charles's residence to catch the last train, by mere seconds remaining, for Cardiff long after midnight.

Around 1 am I receive a call on my new mobile. "Wiltshire police here, where are you?" "You know perfectly well exactly where I am, I have just (stupidly) put the battery back into my phone." "You were last seen dragging two large bags across a field near the motorway so, considering your welfare, we launched the police helicopter."

I reach Barry settee by 3.30am and arrive at court 10 minutes early! The District Judge fixes 14th April date to argue witness summonses for Drs Tegwyn Williams, Professor Roger Wood and Ruth Bagshaw of Caswell Gulag to disclose the redacted 'damaged brain' reports for all day trial on 28th April.

I remind the judge that Crown Prosecution barrister Tom Thumb Twomlow told HHJ Bidder QC, in front of Dr Tegwyn Williams that I had cancer and therefore must be legally represented. I, meantime, was smouldering in the cells beneath, but the power crazy lot had failed to notice the court tape recorder had been inadvertently been switched on.

It was their last 'throw of the dice' to scupper the trial and obtain the IPP (Imprisonment for Public Protection) and one way ticket to Broadmoor, for indeterminate prison sentance, Williams et al having found no other forensic level. 12 psychiatrists for the mandatory Section 41, 83 Mental Health Act 2nd signature. Apparently the cabal had abandoned the earlier argument of brain damage due to my having been 'drinking pal of Oliver Read, ditched in he Caribbean and had flown to Australia withouut a map'.

BUT HOW MANY PERFECTLY SANE BOYS AND GIRLS DID I LEAVE IN CASWELL GULAG WHEN I ESCAPED?

Remanded in Cardiff Prison Until December

Maurice has been remanded to Cardiff prison until 4/12/09 when he will be heard by another judge over his fitness to plead.

Maurice Kirk laisse paraître à Cardiff Crown Court de nouveau le lundi 26 Octobre 2009, énumérés à 10h, mais vérifiez auprès de l'Office Listing Cour le vendredi (Tél: 02920 678 760). Il a lu au téléphone depuis la page 11 Rapport final par Dr Tegwyn Williams. (Maurice n'est pas autorisé à envoyer des copies à ses avocats ni à sa famille, par tout moyen, lettre, fax ou courrier). Il affirme également le rapport contient au moins 20 graves erreurs de faits. La conclusion du rapport est que Maurice a une lésion cérébrale incurable et que personne ne peuvent encore rien faire pour lui.

Para. 39 comprend les mots: Si le tribunal souhaite un second avis, elle envisage d'instruire un psychiatre de l'hôpital de haute sécurité afin d'évaluer que Maurice Kirk à la fois commence un traitement, et aussi dans quel environnement que le traitement doit avoir lieu". Para. 40 dit: Maurice Kirk peut retourner au tribunal pour tout acte de disposition que le tribunal juge opportun."

Final Report by 'Dr' Tegwyn Williams states Brain Injury and Washes Hands

Maurice Kirk is due to appear in Cardiff Crown Court again on Monday 26th October 2009, listed for 10am, but check with the Court Listing Office on Friday (Tel: 02920 678 760). He has read out over the telephone from the 11 page 'Final Report' by 'Dr.' Tegwyn Williams. (Maurice is not allowed to send copies to his lawyers or his family, by any means, letter, fax or email). He also states the report contains at least 20 serious errors of fact. The conclusion of the report is that Maurice has an untreatable brain injury and that no more can be done for him.

Para. 39 includes the words, "Should the court wish a second opinion, they may wish to consider instructing a psychiatrist from a High Security Hospital to assess Maurice Kirk both as to treatment, & also in which environment that treatment should take place". Para. 40 says, "Maurice Kirk can return to court for any disposal that the court sees fit."
