The South Wales Police, after nearly 17 years of my asking for arrest records, many of them, now are asking for 'more time' to consider whether to disclose, bearing in mind 'the web they weave' with HM Partnership , HM RCVS and HM Home Secretary. see below HRH blog.

This 03/04memos, a sample of many, may be an indication to the tax payer as to just how low those in the UK judiciary regularly stoop when enjoying total immunity to prosecution due to the 'Royal Prerogative'. HM Treasury Solicitor was no fear, of course, over his appearance tomorrow to defend the HM Home Secretary in Cardiff Court hearing for my false imprisonment.

While The Yorkshire Ripper associated trials unfold , one currently in session, it makes one wonder just how many HM agents ,given their immunity, have behaved like our current lot over the years?

Further to my last letter of the 26th November the Home Office now appears, under my Data Protection Act application, to have made ‘partial disclose'.

I enclose the Treasury Solicitors' letter of 9^th July and 30^th Sept 2008 and those earlier to the manager of Cardiff County Court [on website http://www.kirkflyingvet.com/ and sample of leaked internal memos sent to you earlier]. The first, in 2003, is asking the manager to round up and send to the team of HM lawyers in Whitehall all records of any of my civil and criminal cases, past and present and to contact all defendants in where I am the Claimant. The Defendants include South Wales Police, Royal College of Veterinary Surgeons, both Cardiff Crown and County courts and bad debtors from my veterinary practice. Deceitful lawyers being sued also enjoying immunity to prosecution under the ‘Royal Prerogative'.

The content of 9^th July and 30^th September 2008 letters indicate still further clandestine behaviour within HM departments. I received no 23^rd July 2008 court letter, for example, in reply to the Home Office from HMCS attempting to have the case thrown out without an oral hearing or any Disclosure.

The HM Treasury Solicitor continues to refuse to ‘disclose' any of the findings in their 5 year running ‘Maurice Kirk---Potential Vexatious Litigant' enquiry. How did they lose my police files and just who, when the music stopped, are holding my court files now?

Your South Wales constituency members, paying for all this, may now understand just who persuaded Her Majesty to ratify the 1998 Human Rights Act, knowing our current Justice Minister, Mr Jack Straw, omitted Article One of the 10^th December 1948 Convention making the whole purpose of the new statute an absolute farce.

Only the proper intervention by respective MPs will correct this Abuses of Process in our UK courts.

Abuse of Process Application

Dear Sir,

1. Further to your 23rd October 2008 letter and His Honour Judge Chambers's Internal Memo, dated a year ago, the situation has not but changed, it has in fact changed for the worse.
2. Tomorrow, Friday, the HM Treasury Solicitor will quote from his defences against a judgment 8CF02269, by default, brought against the South Wales Police, 5^th Action, for my false imprisonment on the excuse his myriads were so engrossed in trying to get me certified as a Vexatious Litigant the 6^th Action was ‘overlooked' for 6 months.
3. HM Treasury Solicitor Internal Memos, you also have, indicate the legal process to get me certified has been going on now for 7 years without my contribution or even prior knowledge!
4. My fifty odd Judicial Review Applications were primarily against your client for trivial motoring matters costing me more to attend than the fines incurred. I suspected the convictions were going to be used against me by the Free Masons in the Royal College of Veterinary Surgeons and your client's motive, when Inspector Collins of Barry Police wrote to the college in January 2001 in order to have my name removed from the register, proved to be correct. 5. Lord Justice Thomas in July 2007 told my barrister, in front of me, not to attend my Application for a Trial By Jury for the 3 Actions of false Imprisonment, CF6141159‐MC65, CF101741, CF204141 excuses ever since being that the transcript is ‘corrupted' and cannot be transcribed. Someone is lying.
6. 2 weeks later His Lordship stated in front of me and Mr Patrick Cullinane Esq. that he did not know just who should hear the Abuse of Process Application, discarded the papers as if an empty cigarette packet and proceeded to expedite my denial of a civilian jury against your client, the only purpose for bringing the 10 years of relentless police harassment cases in the first place.
7. Your 24^th October 2008 letter again refuses to admit police burgled my veterinary surgery to re instate their police inspector's daughter into my flat, admit there was a magistrates hearing on the 9 month investigation, both sides of the English Channel, into my purported ownership of a Guernsey Registered Veterinary Ambulance, eventually ‘stolen' before your client as bailee or there was any arson on my home.
8. Your 24^th October letter goes on to say my requests direct to Barry Police, dated 4th October 2008 and to the Chief Officer, Ms Barbara Wilding, dated 2^nd October 2008, to identify the progress on 39 random samples of police incident numbers, all related to the Actions currently before Sir Nicholas Chamber QC, is wrong. You again prevaricate complaining I should write to you...what utter nonsense. Each incident number was created by your client in a standard covering letter indicating in plain English I was to write to the South Wales Police on the progress of recovery of my stolen goods, apprehension of ‘tipped off' villains in the Barry area for arson, theft, burglary and assault, all ‘modus operandi' mysteriously stopping the very day Inspector Collins had achieved my being ‘struck off' the veterinary register on 29th May 2002.
9. My miserable 10 years in Guernsey at least taught me to pick up a law book, albeit Normandy Law, not Code Nepolian, as no advocate was allowed to act for me or allow me legal representation from the UK. I have again looked at the books and it is plain to me the track record of your client during the 10 years of harassment is an exact copy of the conduct of the Guernsey Insular Authority that led me to the Privy Council more times than any other known litigant in the past century. Guernsey harassment was Free Mason motivated.
10. Normandy Law and I suspect UK Law on Tort is based on similar principles.

4^th Action 7CF07345, as Amended, will contain, in each incident, once there has been full disclosure by your client:

1) The police have a public duty to properly investigate crime
2) There has been a breach of that duty
3) Maurice Kirk and his family have suffered damage.
4) There is evidence of malice. ‘Proximity' argument is exactly why the police continue to refuse to admit they have record of the 100 or so indexed incidents that led to my ignored March 2008 Court Application requesting a Sworn Affidavit by the police that they have the contrary, ‘no such records'.

The amended 1^st, 2^nd, 3^rd, 4^th & 5^th Action will have further samples of Misfeasance by the relevant public authorities, already identified in the 16 years of litigation and criminal conduct by certain parties with whom you acquaint.

I again apply to the Cardiff County Court for an adjournment in these proceedings, 7CF07345, as I do for CF6141159‐MC, CF101741, CF204141 & 8CF02269 and again apply to the court on an Application of Abuse of Process and for the Court to Order proper Section 31 Disclosure by the South Wales Police or whatever other appropriate law based on their criminal conduct.

I, Maurice John Kirk, confirm the content of this my witness statement, supported by 16 years of documentation, most already before the court or under the control of CPS, RCVS and the South Wales Police, is true.

Further to your indication of offering help I will now disclose further examples while we have no apparent accountability within judiciary or legal profession.

Please find enclosed the remarkable admission, this late, by the Home Office with their apparent pretence that they are not culpable.

I have previously successfully claimed cash compensation for false imprisonment from the Home Office.

HM Treasury Solicitor has been made to admit, at last, he had been trying to get me certified as a ‘vexatious litigant' all the time my court files against the South Wales Police and Royal College of Veterinary Surgeons went ‘missing' for years from Cardiff Court. They were in the back rooms of Whitehall and Royal Courts of Justice all the time!

Also enclosed is a photo of my being denied entry to the HM Treasury Solicitor's office in the Royal Courts of Justice to retrieve my ‘lost' files. Just what will these villains do next just to protect the South Wales Police in first getting me struck off the veterinary register and now breaking every rule in the book to prevent my application going before a court for reinstatement?

No wonder no UK court will process my Abuse of Process Application with all its Part31 Disclosure implications.

Oh this web they weave! And who ultimately pays, Mr Smith?

Dear Mr Smith,

South Wales Police - Treacle Treatment

Further to my letter of 8^th September 2003 expressing the above and your 15th Sept. reply, stating my ongoing case was receiving your personal attention, I now give you an update.

In 2003 I had asked the Police, Crown Prosecution Service and Magistrates to retain all records relating to my complaints, arrests and imprisonments, leading to approximately 121 charges out of 130 being thrown out. These 7 were latched upon, incidentally, by the Royal College of Veterinary Surgeons following a complaint from the police to have my name removed from the veterinary register.

The police disclosed confidential records to the RCVS contrary to Home Office Rules 45/87.

The Magistrates refused to disclose, the CPS handed over a token sample but only by my taking them to court. The Police delayed 5 months whilst my, then solicitor, wrote about five letters before the police force solicitor finally refused to supply any records at all.

From then on external solicitors for the police have avoided that disclosure to which I am entitled.

Civil courts in Wales also appear to ignore my right of disclosure as was the case in the criminal courts. Lord Justice Thomas, in the Royal Courts of Justice, has refused both legal representation and a Trial by Jury, the original and only purpose for suing for damages.

Over 30 Law firms, specialising in police harassment, incorporating over 80 lawyers have refused to act on my behalf at any stage in these 15 years of litigation following the sacking of the original incompetent Bristol law firm.

I enclose 5 Actions for Damages, my desperately needing legal representation to proceed.

The 5^th Action was blocked by Mr Justice Andrew Collins, Manager of the Administrative Court of the Royal Courts of Justice, until his two year Extended Civil Restraint Order expired. The ECRO was applied for by the Royal College of Veterinary Surgeons to block disclosure during my futile court attempts to be re-instated to my life's vocation.

The 5^th Action was changed from that of the South Wales Police as defendant to the one ultimately responsible for their conduct, namely, HM Home Secretary.

Cardiff County Court refuses to enforce the £15,360 Judgment in my favour having returned my cheque.

It is no surprise to a Patrick Cullinane Esq., a fellow chronic litigant, also ‘in person', who has personally attended my court cases both before the Royal College of Veterinary Surgeons and Royal Courts of Justice (see transcripts) to witness the judges not even bothering to even read the lodged case files.

HM Attorney General ordered my files in this case be rounded up from the Welsh Courts and for several years were with a team of lawyers in Whitehall attempting to have me certified as a vexatious litigant. Leaked internal memos indicate the extent to which the police have gone to hide their conduct.

Mr Vincent Cable MP recently chaired a meeting at Westminster for chronic litigants from his constituency. He then left his seat and immediately asked questions in the House.

I again ask you for a meeting on behalf of litigants in South Wales and others that have suffered under the criminal conduct of those within the UK judicial system apparently immune to prosecution due to either a Royal Charter or ‘Her Majesty's Prerogative'.

Dear sir,

Readers of my web site are asking me , in the light of the South Wales Police now settling ‘out of court' on my 5^th action for damages against your client for false imprisonment, why is there not pre litigation protocol in train in the welsh courts?

I had to explain to my readers that in welsh courts against an Englishman there is no ‘arbitration procedure' either, unlike England and Scotland.

Readers have pointed out that if the Home Secretary has settled at 10% of your purported costs ,to date, in the remaining actions shortly to be entering their 16^th year, just who is being greedy?

Not quite my view, I hasten to add. I know the full history of racism here in South Wales.

Anyway, is there a way in which you can assist in getting my £15,000 from the Home Secretary?

I will, of course enter, into a legal contract for ‘no win no fee' or tender a % of your success, which ever you prefer?

I enclose a copy of judgment against your client to ‘concentrate the mind' of any taxpayer implicated.
