You feature the Magna Carta and its anniversary date in your news programme. You tell us that enshrined in the Magna Carta is the right to a fair trial and that right is still relevant today. Tell that to Maurice Kirk who is languishing in a Welsh Prison. He is being denied almost every basic human right going, these human rights are supposed to be set in stone. He is even being denied a critical operation. If you treated a dog like this you would be prosecuted. You paint such a rosy picture. Please BBC come to the rescue of 69 year old Maurice John Kirk an honest, honourable and very principled man to say the least, surely it’s your duty.

The Aviation Medical Services told Maurice in February and confirmed it in June: you are unfit to fly.

Maurice said it means "We won't reconsider our position regarding your licence, until the NHS states that the diagnosis is 'without foundation'."

Well, one thing keeps amazing me: despite a never ending chain of events that are completely beyond any law, rule, guideline and certainly humanity, compassion, moral and ethics, Maurice does keep his spirit up!

Tomorrow he'll be in court in Bristol.

He said there are at least six reasons why they will try to keep him inside.

Pity that justice is neither democratised nor technologised. Otherwise we'd see videos like when Select Committees meet in Parliament. But that would be too much in the public interest, wouldn't it!?...

Maurice Kirk's phone call was again how he is being hampered in seeking Justice whilst a Litigant In Person in prison.

Over a month ago he typed out his Appeal to the Criminal Court on a HMP computer. His hand writing has deteriorated hugely over the last months due to having no suitable glasses for his eyesight; despite an eye test last year no new glasses have appeared.

He has been denied the ability to download his Appeal onto a CD, a memory stick or even onto a printer so that he can post the Appeal document direct to the Criminal Court of Appeal. He has been denied photocopying and carbon paper ever since he's been imprisoned.

He is unable to change the seven telephone contacts he registered in October 13 even though he is in need of direct contact with certain bodies to confirm information relevant to his Appeal.

Although he has money in the Prison system, he has been denied further money onto his account and so is unable to telephone out, buy stationery and stamps etc.

They laughingly allowed him to work on an HMP computer in his cell and after hours of work he discovered that it had been disabled and thus totally useless for any form of download.

This is how the Justice System treats a man who is in his 70th year.

THIS IS NOT JUSTICE - let alone fairness, the Rule of Law or compliance with guidance rules...

Maurice had been given bail at the beginning of this year by Judge Bidder; it never happened.

May 2nd 2014 he was eligible for tagged release; it never happened.

Now he has found out why. Back about ten years ago Maurice was involved in an incident in Bristol which resulted in him being held in custody for a short time. He had a run in with the custody people and through their behaviour towards him he got them into trouble.

Now he has discovered that the ring leader of the custody people has moved on and the same man is now head of NOMS, (National Offender Management Service) in the Cardiff area by the name Mulholland. He is Sarah Rowe's boss and the boss of many other staff in the prison and it is he who has TOTAL control over what happens to Maurice within the Prison.

Hence visitors are denied entry on the pre-arranged dates, Maurice's access to his Judge demanded Computer has been permanently obstructed and of course any opportunity to leave the Prison under licence has been blocked.

Never mind Judge's orders; they are all overridden by this man. No wonder Judge Bidder, Judge Rowlands and others have said in open court that they have NO jurisdiction within a prison. One can have no sympathy for the 'overcrowded prison situation' when the Ministry of Justice runs the prisons with such as Mulholland given free reign to persecute those who annoyed him in a previous existence.

Despite promises, urgent papers for court deadlines couldn't leave HMP Cardiff today. They were not 'processed', but returned...

Similarly, his permission to produce CDs is highly curtailed and does certainly not conform to the Order made by HHJ Seys Llewellyn.

At the time of his strike-off, Maurice was not allowed to cross-examine a Police Officer who lied.

What else is new since then? Damages after damages, battles after battles by "professionals who don't lie" and are "only doing their job", i.e. protect their salaries and pensions, by protecting their brethren.

Meanwhile, Litigants in Person can go to hell, rot in prisons and experience stitch-ups in courts.

None of the complaint procedures work: "we don't deal with individual cases" while statistics don't make the slightest difference. The difference between the parallel economy of civil servants on one hand and independent professionals such as Maurice is that there is always enough money to cover up white collar crimes. Furthermore, there are the Royal Charters who guarantee immunity from prosecution. And so it goes. Everybody knows, as Leonard Cohen sings...

Litigants in Person are as much a nuisance for that public money machinery as are McKenzie Friends. They must be taught lessons, some policy makers seem to have decided while doing their job and to keep the Oppression of the British people going - with the public gravy train of a dishonest money system...

In French they say "on boucle la boucle" - when closing a circle. I'm back to where I started: with the publication of fraudulent bankruptcies as white collar crimes.

For Maurice I wonder when will "enough be enough" in terms of violation of laws, rules, practice guidance, ethics, morals, justice, fairness and other lofty terms in professional oaths???

Another Litigant in Person writes: "three colleagues have long experienced similar prevaricatiive stonewalling - herewith the reply from another one:- the whole system is just another money-making machine for lawyers and strategised to ensure that any complainant body is trapped in a revolving door until s/he disappears up their own arsehole. All these Ombudsmen are government quango's whose existence are to created to give the illusion of a cosmetic democracy - i.e. it purports to resolve complaints, but no resolution actually ever happens."

Maurice Kirk has had rectal pain, an excruciating situation, which has been impinging on his sleep and more recently, during the day, since late last year. HMP Cardiff rightly organised a colonoscopy at 'The Heath', Cardiff University's Hospital with a Dr/Mr Adam which was supposed to have taken place last March 2014. Maurice travelled to the hospital under escort but before he even saw a doctor the examination was cancelled and he was returned to HMP Cardiff.

As he was in court during the end of March, he missed his appointment with the Prison Medical Department, Dr Rose Marnell, and so another appointment was made for 6th May 2014 (some 7 weeks later). When this date finally came around, and in regular agony with only paracetamol issued at 8am and mid afternoon each day when he had to take it and not allowed to save it for the pain in the small hours of the night, THE APPOINTMENT WAS CANCELLED with no explanation.

Since then he has continued to ask for a proper examination as he has previously had rectal problems due to sitting on an extra fuel tank in his Piper Cub from Biggin Hill to Sydney Australia. A seat would have added to the total weight of the plane and restricted distance covered between refuelling.

Two weeks ago he was able to ask/beg the two main doctors at the unit for a proper appointment and examination but both doctors separately ignored him and would not talk with him. On Bank Holiday Saturday afternoon he was handed a letter from Wing Governor Reed which had been dated Friday 23rd May 2014 suggesting that if he desired a medical examination the Prison could offer the following:

a) At his own expense he could invite a GP into the Prison to examine him

but failing that

b) At his own expense he could visit the surgery via a taxi and escort.

What is the Prison playing at? One was led to believe that Her Majesty's servants were duty bound to show 'duty of care' of prisoners, but it appears that South Wales 'servants' can do anything, ignore decency, ignore rules, ignore justice. Who can defend inmates from these Welsh 'servants'?

The EXTREME TEMERITY of a Cardiff Jury to ask for disclosure of PUBLIC DOCUMENTS being court orders and contemporaneous records...

and going without medical attention including pain killers for the whole week despite an untreated prolapsed bowel known to the medical staff.......

Day Five

continued with the cross examination of the clerk to the court with regard to new paperwork present in the court, after spending hours establishing the points of law the Judge ended the witnesses second turn on the stand just before Maurice could elicit the second contradiction of the serving of the "restraining order" .

A fresh influx of supporters lent the afternoon a renewed air of hope that justice will prevail.

There then followed a reading of the transcript of the interview under caution, read by Mr Gunney and Mr Smyth, unfortunately this left little time for much more, as ever the case continues..............

So much as far as 'breaking news' is concerned:

thanks to weird and wonderful connections, it can be revealed that Dr T M W was de-registered on 02 February 2014 which means he doesn't pay for his license, as he doesn't seem to have employment; I leave it to your own level of being a 'conspiracy realist' or theorist to decide how this may have come about and what it means for him, South Wales Police and the General Medical Council and its members, besides the Health Select Committee of MPs who's looking into complaints and raising concerns in the NHS;
a most helpful barrister has found a precedent regarding the supposed 'threat' charge and thus the CPS have no case - in theory;
Maurice telephoned blogger Butlin on Saturday to report the lack of health treatment regarding his prolapse - as punishment for his hunger strike!

You can't make it up, once again: after all the procedures of 'logging into' HMP Cardiff, 'white shirt' officer 056 tells us that 'Maurice refuses to come to the visit'.

A nice 'gate officer' found out that it was the doctor in the hospital wing who had made the decision not to let him have a wheelchair. I wonder whether she's ever been on a fast for nearly five weeks and how much energy she would have left???

Maurice, If your hunger strike is a serious one, I urge you to cease. It will achieve nothing. Your childish faith that Britain is run by people with compassion & humanity is touching, but totally wrong. Governor Steve Cross has of course power to release you on compassionate grounds, but the hope of compassion from him or any other prison staff is a futile one.

Compassion or Humanity are not in their make-up. Nor in the make-up of South Wales Police, their Judicial Mafia pals who put you inside, Court Service staff, Government Ministers, or any of the other Quislings who now rule Britain. THEY WILL SMIRK BEHIND THEIR HANDS AS THEY WATCH YOU DIE OR LEARN OF YOUR DEATH.

While the rest of the people stay glued to East-Enders, Corrie, or ‘Sport’ – the present day ‘Opium of the Masses’(qv). Convicted of no crime, you are held ‘On Remand’ accused of ‘Breaching a Restraining Order Contrary to the Protection from Harassment Act 1997’. That is one of the worst of the many bad ‘laws’ brought in by the mass murderers & war criminals of the Blair Regime (the ‘Heir to Blair’ is no better).

SUPPOSEDLY brought in to save women from being murdered by stalkers (often ex-husbands or lovers), it was specifically & cynically designed as a weapon for police to harass law-abiding citizens, & is used by them with enthusiasm (woman are still being murdered by stalkers, just as before)..

Your captors would have obeyed the orders of King Herod or Judge Jeffries with the same enthusiasm they use to enforce the ‘Laws’(?) of those mass murderers. They remain free to jet-set around the world, while you rot in the ‘Hell-Hole’ which is Cardiff Prison.

It was Martin Narey, one-time Director General of the Prison Service (no less!) who wrote of “A Litany of Failure & Moral Neglect in HELL-HOLE prisons!"

It was General Sir David Ramsbotham who spoke on the TV Frost programme of ‘BARBARIC GUARDS’! The General had just been sacked from his post as Her Majesty’s Chief Inspector of Prisons - for doing his job too well - as had his predecessor, Judge Sir Stephen Tumim!

That was ten years or so ago, but obviously things are no better now. Unable to get more than token improvement, the humane Martin Narey gave up in despair, to become Director of Barnado’s - [to advise on accelerating adoptions!]
