Maurice Jailed Three Times in a Week Fourth Break in & Accused of Fraud

On 20th July 2013 I am just released after another night in police cells because of liar, MARK DAVENPORT, ringing police to block my getting into the flat for my legal papers required for the final day of my twenty year running damages claim against the South Wales Police.

After an hour in Cardiff Magistrates, before proper Cardiff magistrates for a change and not the usual District Judges, John Charles or Bodfan Jenkins, fundamental issues with the help of the Clerk of the Court were sorted out.

But DAVENPORT had switched off the electric and had changed the locks whilst employing staff who were drawing the dole to help him allow fly tipping on my land.

After I had heard the usual evasion of the truth and shouts of almost, "liar, liar, your pants are on fire", Her Majesty's Representative, as prosecutor believed be also from 9 Park Place Chambers, Cardiff, eventually was made to release, albeit far too late, my custody record including the video made under caution that will knock this new bit of trumped up nonsense right on the head.

Yes, Mr Kirk must be allowed to live at the flat, the court heard and what of the squatter in the shop below, was my reply?

At the end of proceedings I felt it only appropriate to recommend that the Madam Clerk of the Court to be o0ffered a position as an inquisitional judge, as under the laws of Code Napoleon in a court somewhere in Brittany.

Whilst the Cardiff Cabal continues to protect the rogue police doctor and the courts appearing protect the other ring leaders behind my twenty years of purgatory whilst resisting both extreme and unusual irregularities from those in positions of privilege the Cardiff courts will continue to have my most undivided attention.

Her Majesty's representative again misled the court concerning the outstanding matter of the rogue police psychiatrist.

The Caswell Clinic psychiatrist and his Cardiff Cabal are still maintaining, three years on from the MAPPA level 3 'machine gun' acquittal, that their victim is still 'medically unfit to plead or stand trial' when it so suits but not when circumstances are not helpful for them (see The Times On Line' comment below).

Meanwhile I remain diagnosed with 'irreversible significant brain damage' and possibly cancer that caused the current Defendant, in these current civil proceedings, on 2nd December 2009 Cardiff Crown Court, to recommend, via barrister Richard Thomlow of 9 Park Place Chambers , Cardiff, to recommend that I be incarcerated in High Security Psychiatric Hospital most likely for life.

NHS (Wales), at Caswell Clinic, are reliant on not just a brain scan interpreted by someone without the appropriate qualifications after using the wrong techniques but on its supporting documentation for the Cardiff court stating I have significant brain damage because:

1. I had been an old drinking partner of actor, Oliver Reed Esq

2. I had ditched my WW2 aircraft in the Caribbean and

3. had flown all the way to Australia without a map

This continuing bullying by the police and causing false imprisonments, just as with their refusing to release of my own 5 page victim statement following complaint, last year, by this same Caswell Clinic psychiatrist having had me locked up in prison for weeks following his latest fanciful delusions that I had been around to his home and harassed both he and a DR JANIS HILLIER I have never even met.

The release of these 13th July 13 custody records together with the video record of my 'Defence Statement', in rebuttal to an allegation of two common assaults on DAVENPORT and another, are needed as exhibits inTuesday's County Court hearing before His Honour Judge Seys Llewellyn QC on the final day of the first three of seven damages claims listed soon for a hearing.

On that 13th July 13 I was arrested by a PC Charles......"Any relation?", I asked the court.

And by 7.30pm on 19th July I am again arrested and with hand cuffs behind my back hauled into a police car with not even the right to have a road side breath test. Hang on here, I said, it was I that asked for police officers to attend this time!

I was also arrested just a few weeks ago whilst quietly parked on private property, on the pretext of 'drink drive' but with no moving traffic offence as their excuse.

In both these 'drink drive' incidents there was significant delay for over one hour before having to provide a specimen of breath!

The 2nd delay was one hour and thirty five minutes and was deliberate for senior officers, no doubt, to be contacted to set up another conspiracy to pervert the course of justice. Remember, please, the numerous police incidents in the three current claims for damages contain three road side incidents recording positive specimen of breath taken but all zero within one hour of my arrests.

22^nd July 2013

I, Michael Murphy of The Old Police Station, Barry, confirm that the content of this, my statement, is true to the best of my belief.

Back in the mid 90s Mr Kirk had flown over my scrap yard, situated next to Barry harbour to identify his car lying there and then reported me to the police for theft.

A neighbour had previously arranged to have Mr Kirk’s car towed off private land to the rear of his veterinary hospital in Tynewydd Road, Barry and onto the adjacent public road.

Mr Button had then telephoned me to say that I was to remove the vehicle from the public highway but was to keep it for a minimum of fourteen days.

If by then it had not been recovered by the rightful owner then I was allowed to dispose of it as I pleased.

Extract from Claimants Closing Submissions

On 29^th May 2002 the Royal College of Veterinary Surgeons, upon receipt of 7^th January 2001 written complaint from the South Wales Police, removed the Claimants name from the veterinary register, for life, because the Claimant had been found guilty of having disrespect for authority

This three month trial produced NEW EVIDENCE re below extract from RCVS 2002 London enquiry when the convictions was used to have me struck off

This trial confirmed I delivered valid motoring insurance proof to Ely police station most likely under the control, at the time, of either Chief Inspector Brian Genner (the daughter of whom had a miscarriage blamed on me) or Inspector Robert Nelson Roe who used a sledgehammer and crow bar, helped by a van load of officers, to smash their way into my Cardiff veterinary surgery to put Alison Genner back into my overhead flat with the drug dealer boy friend, Anthony Glen Gafael.

D-Day

Both these incidents produced statements on the same day by Inspector Roe from Gafael and guess who produced O' Brian's

What these two incidents have in common is that Dolman's drafted 25th Feb 2009 Barbara Wilding Affidavit with her denying any knowledge of the break in and miscarriage Ely incident or the Llantwit Street incident with O'Brian saying he issued a HORT1 + demand to see Registration docs for the Guernsey ambulance.

The reader following previous blogs may now guess why the defending QC denied seeing the O'Brian incident pleaded in the Action by the Claimant and the court refused me the right to call any of the conspiracy identified by Special Constable Deryn Wilson blurting out she had telephoned Guernsey police pretending she had lawfuly issued a HORT1 (for O'Brian) as by the time the trial came for 'not producing valid insurance' for O'Brian circumstances changed, with 'trouble at mill'!

Conclusions

1. Despite considerable data having been passed between both the Defendant and Guernseys authorities, for a period exceeding thirty years, there was been no successful prosecution by either judiciary despite the unusual need for the Claimant to operate his respective veterinary practices on foreign motor vehicles or registered under fanciful names.

2. Despite the Claimant having been ordered by the Defendant to produce evidence of valid motoring insurance, no less than thirty five times between the dates of 1992 and 2002, there has been no successful prosecution despite countless Defendants direct communications with the Claimants insurance companies.

3. Despite the Defendants successful complaint to the Royal College of Veterinary Surgeons the Claimant has since received no notices of intended prosecution for failing, no less than eight times, in producing his driving documents when stopped by a uniformed police officer.

Incidentally, the latter's grandfather as Bailiff, had identified the young Jewish girls to the N*z*s, in 1942 and had them sent to a concentration camp to be exterminated

ACK Day then took a photocopy of the charge sheet after a card with typed new was stuck over the , rather like I had done in Taunton, of a Chief Superintendent Hawkins borrowed personal note book and had produced it in court to cause the quashing of serios fire arms charges

No wonder I was never allowed a jury

The lawyer defence team for the Defendants Skeleton Closing Submissions, to defend the 1992 -2002 bullying by the South Wales Police, have printed out such a thoroughly misleading account, in well over thirty or so, so far heard, of a hundred or more appalling incidents of criminal conduct, by three Chief Constables, no less, obviously requiring an outside intervention.

All it required was to look in log books of aircraft/pilots onboard/ ring ATC Gloucester for records/ get ATC Cardiff to ask or simply send the Llantwit Major’s police car two miles to landing strip and enquire after the aircraft had landed.

Police identifying the pilot as being in the front ‘pilot’s seat was a joke, in itself, assuming a WW2 J3 L4 is usually piloted so. Which seat did I fly from when I then flew her to Australia, solo and stuffed with fuel cans?

No, they kept no safe distance and in fact, it was all very dangerous, as close as the length of the court room, plus a foot or two.

Both pilots confirmed it was illegal, inside the 500ft Air Navigation Order rule. unless the police had a justifiable reason to put so many lives at stake?

Interesting how the ATC Cardiff asked G-KIRK to orbit until the police helicopter arrived. We could have diverted and landed, quite easily, at the Cardiff police heliport, in time we were made to wait, if the matter was so very urgent.

No. The radar facilities at Cardiff cannot measure distances between such aircraft to ensure safety

No, not true. To prove the point of just how dangerous it was the two helicopter crew both had to admit they each lost sight of the cub for sufficient time to get her an imaginary five second burst from a WW1 Lewis machine gun, ‘up their tail’.

The CAA should have investigated the police dangerous prank but I was not going to report another pilot simply being black mailed by a bunch of bullys sitting at HQ calling the shots.

In a minute I visit my sixth GP practice in another desperate attempt to have someone in the NHS (Wales) to finally correct my Caswell Clinic 2009 psychiatric Records fabricated then purely to have me registered MAPPA level 3 if the 'machine gun' allegation failed.

South Wales Police had and still have a 'hold' over him and his wife and yet no one else in the NHS system, appropriately qualified will be a seen correcting my medical records that are currently stopping me now from setting off to South Africa and the Falkland Islands in my WW2 D-Day Piper Cub, registration G-KURK.

No more 'HM' court time has been 'allocated' or the trial judge just wishes not to hear any more evidence, apparently,for the completion of this Claimant's twenty year running damages claims leaving only the 'closing speeches' on 23rd July 13 to finish the case, subject to any appeal.

It is arguable that these and other cases, in the long stayed queue, have been delayed by those who really decide as to just what goes on in our UK law courts. The Claimant's consequential loss, following his countless imprisonments and being sectioned under the 1983 Mental Health Act so many times, of carefully stored evidence has been phenomenal.

On the promise of a jury, as far back as1993, the Claimant instructed Bristol lawyers to bring a series of damages claims against the South Wales Police in an attempt to simply to stop the harassment and finally 'get them off his back' when all he wished to do was to go about his chosen vocation, uninterrupted, as a veterinary surgeon in the Vale of Glamorgan.

From June 1993, in Cardiff and between December 1992 to October 1993, in Barry, following a series of arson, motoring and tenancy dispute incidents, requiring the Claimant to seek assistance from his local constabulary, chance communications with the wrong Guernsey police officers led to, some would say, an act of vengeance and damned what it cost.

Some within the Barry and Cardiff police then set about a 'course of conduct' argued by the Claimant as both unusual and extreme acts of bullying heavily reliant on their 'HM' Partnership's cosy relationship from within their own courts hoping their chosen victim would not make the distance.

Twenty years on and the Claimant now finds himself faced with recent court rulings appearing to both shorten proceedings and indicate the need, perhaps, for the maintaining or otherwise of the age old 'hot potato', the level of a 'judge's discretion' in this, such an unusual case.

Could the rulings relate to this 5th August 2003 HM Treasury Solicitor letter, I wonder, smuggled, most likely, out of the Cardiff Civil Justice Centre in the dead of night starting the 'Section 42 'Vexatious Litigant registration procedure to ban my right in ever getting access to a UK court under the rule of UK law?

A little word of advice

Any one thinking of bringing civil actions against any Welsh authority by deliberately starting it in England, as I was advised by Bristol lawyers, to get a fair trial or 20 years later, then lodge an appeal in London, as I deliberately travelled to do, to avoid the stench of the Cardiff Cabal, please note the seal on the Order handed down by the very same judge that blocked all the politically sensitive incidents , last year, in my 20 years of hell.

I refer to your further attendance at our offices on Thursday 28 March 2013, when you again sought to ignore the fact that we have withdrawn your licence to attend at our offices. I would also wish to record that you were not prepared to identify the basis of your attendance with the staff who sought to speak with you.

I refer to your telephone contact with Dolmans at 1.30 pm on 2 April 2013. I would again remind you of my prior request that you deal with matters by email due to your propensity to distort comments made in telephone discussion. You have been able to communicate by email and indeed, have sought to encourage the same. I record that it is only during the course of the adjournment of your civil trial that you have sought again to attend our premises and to communicate by telephone, even though you have been prepared to communicate previously by email. I would again ask you to revert to dealing with matters through this medium as it enables both parties to prepare for matters arising in the trial.

You have left a message at 1.30 pm asking for details of the witnesses who are to be called tomorrow (3 April 2013) for trial. You can be advised that it is the intention of Leading Counsel to invite former police officer Robert Osbourne to provide evidence at court on 3 April 2013.

Take the ‘Musa Family Case’, as another typical example, currently on appeal, ‘we think’, where Haringey Council lawyers ‘cashed in’ on the act, again all immune to any HM regulatory retribution or HM prosecution in either our civil or criminal courts.

[The Nigerian couple are currently serving seven years imprisonment with all seven of their children now snatched and outrageously ‘re homed’ instead of just being put on the next flight to Nigeria].

In Cardiff County Court this Month

Lantwit Major's police sergeant Kilberg, one of many in the 1990s police force, who had my name removed from the veterinary register is caught out lying to the currently presiding judgere along with a few others already heard and shortly to also give evidence.

Enclosed is a 90s Barry police station custody video of Kilberg lying to the custody sergeant that I was in breach of a public order offence despite the custody sergeant specifically asking for that clarification.

His Honour Judge Seys Llewellin QC or the police QC, during the three months civil action currently in session in the Cardiff Civil Justice Centre, asked for clarification on exactly the same point with the South Wales Police sergeant qualifying the issue by stating the custody sergeant made the mistake when writing down the facts.

The truth of the matter was his partner, PC Gareth Holmes was right there, seen on video and refusing to support the deliberate lie either by recording it in his pocket note book or in his subsequent MG 11 witness statement.

Punitive Damages

Punitive DamagesInEnglandand Wales, exemplary damages are limited to the circumstances set out by Lord Devlin in the leading case of Rookes v Barnard:

Oppressive, arbitrary or unconstitutional actions by the servants of government.
Where the defendant's conduct was 'calculated' to make a profit for himself.
Where a statute expressly authorises the same.

Rookes v Barnard has been much criticised and has not been followed in Canada or Australiaor by the Privy Council.^[7]

Another case that could arguably be seen as an example of punitive damageswas that of Attorney-General v Blakein which the defendant profited from publishing a book detailing his work for MI5. The details were very old and therefore did not cause loss to the state. The publishing was, however, in breach of the contract of employment (and incidentally criminallyin breach of the Official Secrets Act 1911). The defendant was required to give an account of his profits gained from writing the book.

Thecourts have been very reluctant to follow this approach,^[9]emphasising the materiality of the criminalelement required for these damagesto be considered.

Thank you for your letter 20 March 2013. My 22 January 2013 letter is to vary “all” conditions. I understand that the CPS previously proposed the following sorts of conditions in 2011 and so it follows we vary the past CPS draft proposals to seek a proportionate response:-

I can agree not to contact Dr Tegwyn Williams. [I have instructed private detectives to locate Drs Williams and Hillier’s home in order that there may not be a repeat of my last summer’s vindictive imprisonment following his false ‘victim’ statements].

I agree not to disseminate any untrue information with regards to Dr Williams.

That the Order end on………Date?

As Dr T Williams is not at Caswell Clinic and has not been there for a very long time it would seem wrong to deny me my rights and liberty of access to my NHS clinic.

It is also normal NHS procedure, after being an inpatient (sectioned or otherwise), that if he is confused, unhappy or seeks reassurance regarding what has occurred and/or is written, that the patient is to return to the same clinic to discuss issues with the same ‘group’ of clinicians.

Under the Data Protection Act the same clinicians are to update the records to make all that they have ever written to be fair, true and accurate. Clinicians not at Caswell in 2009 cannot address data. It must be the team at Caswell. There were over twenty writers in the three months of my team assessment or forced unnecessary and unlawful incarceration.

Dr Williams and his lawyers are accused of abuse of power and workplace bullying where the Caswell team wish to build a relationship with me. If I name a good genuine clinician, who will help me, will Dr Tegwyn Williams and his lawyers then bully that clinician not to help?

I cannot now name any helpful good clinicians for fear of them receiving a repeat bullying.

You mention that Morgan Cole, solicitors, say that there is no facility to conduct tests for brain damage at Caswell Clinic when Dr Tegwyn Williams seems to say there is, in that Caswell Clinic is the host to commission and deal with investigation of specific issues of brain damage effecting behaviour relevant to MAPPA level 3 forensic psychiatry.

Why, then, did Dr Williams ask the Crown Court to section me first to Caswell Clinic and then to Ashworth Prison if not to determine the presence or absence of brain damage?

Why does Dr Williams avoid clarifying whether I have significant irreversible brain damage?

His last summer’s false ‘victim’ statement, police countersigned, means the CPS recognises Dr T Williams is not without blame when dropping all charges. So is the CPS now proposing to vary my Restraining Order to that of a more proportionate one or do I appeal to Europe?

As usual it is all about 'disclosure of evidence' so if the police can withhold names of witnesses, custody records and police personal note books etc then they usually have you 'buttoned up' and 'up a creek without a paddle' in any subsequent criminal or civil proceeedings.

I have been unable to open the ZIP files which you have sent and have asked my IT team to investigate the same. Attendance at our offices

I refer to your and anticipated attendance at our offices at approximately 4:55 pm on Friday, 22 March 2013. I record that you entered the reception area of our offices despite having previously been advised that your license to attend our premises had been revoked and that you would be trespassing if you entered our premises.

This decision was not taken lightly, but was based upon our previous reasonable requests for your dealing with matters by e-mail and correspondence and the fact that it had been necessary to ask for police officers to attend our offices due to your refusal to vacate the premises on a prior occasion. In addition, you have made several unwarranted indications of your intention to effect a citizen's arrest upon me personally. I have no wish for my staff to become embroiled in any issues relating to your expressed intention. I am also aware that you have distributed leaflets relating to myself which are inappropriate and inflammatory.

I would be grateful if you would abide by the indication which has been provided to you. If you continue to seek to enter our premises, then it will again be necessary for us to involve the police.

Your purported reason for attendance at our offices

You indicated to the person who dealt with you that you are seeking to attend regarding VHS cassettes and a DVD and that you are seeking to draw attention to discrepancies between the same.

The person who dealt with you indicated that he would not be able to assist in this regard, but you indicated that he would be returning to our offices at 4:00 pm on Monday, 25 March 2013.

Your need to comply with a court direction

A direction was made by the court on 13 March 2013 that you were required to produce by 4 pm on Friday 22.3.2013 the videos which you have in your possession by email and that those which you did not have in digital form, were either to be supplied to the court in digital form, or if not practicable, to be lodged with the Court by that date, for the particular attention of Mrs Rosie Pahl.

It is clear from this direction that the intention was that you should lodge any relevant tapes or digital copies with the court, rather than this practice. In particular, we are alert to the fact that you have suggested to the court that this practice cannot be relied upon to produce appropriate copies.

The court has made it clear that the court is to take control of any documents which you produce. You are therefore reminded of your obligation to provide any relevant material to the court as directed by the court.

It is noted that on Sunday 24 March 2013 you directed an e-mail to Melanie Standley of this practice (who is absent from the office this week) providing a link to a “you tube” site. It is noted that you also referred to videos having been stolen from your vehicle.

Today, at Cardiff Magistrates, with appropriate witnesses to give evidence to confirm later, I was allowed, but only by the presiding judge's ‘discretion' as he put it, to allow me to rely on tape recordings of previous summary hearings in my application to have urgent medical attention.

These obviously accurate tape recordings of proceedings proved premeditated criminal conduct by prosecution witnesses, the Crown Prosecution Service and the then presiding magistrate, District John Charles, in breach of ECHR Article 6.

Apart from my 21^st January 13 letter to the CPS, responding to its 15^th Jan letter, suggesting I bring proof to the court, I had served on an earlier, addressed to the Criminal Court of Appeal, summarising the years of ignored applications for basic disclosure, back to the 2010 ‘machine gun' jury trial, by the South Wales Police, simply for public documents to which I was entitled.

This, of course, is a major breakthrough in the argument for Litigants in Person taping one's own court cases, whether it is because one is a little deaf, as in the Norman Scarth Appeal, currently before the Criminal Court of Appeal on 23^rd January 13 at the Royal Courts of Justice or in my own current appeal conviction there, relating to the bizarre 4^th May 12 ‘Breach of a Restraining Order' conviction with expensive official transcripts devoid of critical conversations in the court room that day.

My ‘Restraining Order' was purported to have been handed down in that 1^st Dec 2011 magistrates hearing but within my library of Wales' way of administering ‘justice', so similar to my past experiences in Guernsey, all indicated a rampant abuse of process.

Today's case revealed the fact that, while the court downloaded my 21^st January 13 letter from my website, only because the CPS seemed to have difficulty finding their own copy, my original argument in the 1^st Dec 11 court, that I was not allowed my own legal representation, my papers defence or witnesses in court, it was the police psychiatrist, not me, doing the harassing when one cannot be accused of harassment when applying the same ‘rule of law' the CPS appeared to be relying upon.

Sub section 3 a) & c) of the 1997 Prevention of Harassment Act allows me to:

‘Pursue a course of conduct' to detect or prevent crime'.

Apart from false medical reports and written without appropriate qualifications, whilst in possession of contrary evidence, the MAPPA doctor continues to break the law.

Recently, by MG 11 police witness statement, which had me jailed for several months, he stated that I had been accosted by the police whilst I was committing further harassment at his home. I had also made several attempts to break into Caswell Clinic, Bridgend, to gain access to my medical records. He told the court I suffered ‘paranoid delusional disorder', believing the South Wales Police were bullying me, had ‘significant brain damage' and a possible brain tumour.

The original medical report had been written in a conspiracy with a rogue doctor protected by Port Talbot NHS management, several running similar private establishments funded by the tax payer.

I was mysteriously MAPPA level 3 'de regististered', at the same time, from my much enjoyed elevatated status in Cardiff prison, remains a covered up conspiracy also in keeping with the routine behaviour of Cardiff's prison, police, CPS and ubiquitous dubious judges who should, at least, no better.

A string of, no doubt, masonic Cardiff Crown Court judges, tried their damdest to have me jailed with mandatory prison sentances totalling 10 years all over this antique decommisioned WW1 Lewis machine gun.

I was, years earlier, invited to fly my replica DH2 at Farnborough by the express 'orders' from my old mate Captain Brian Trubshawe of Concorde fame.

Rumour at the time was that his air show committee's 'slight mis understanding' with the CAA (campaign against aviators) cased them to vote I and only me was to fly her in the display! I had both lost and won numerous court case skirmishes, over 40 years, with my persistent adversaries, based at Gatwick, the most recent being a win over 'low flying' in Taunton Crown Court.

Successive Cardiff based and very corrupt Welsh Crown Prosecutors were ridiculed in Brisol Crown Court, recently, by fellow but English barristers refusing to dirty their hands over my transferred appeal for a 'common assault'.

The facts were that a rather nasty ex South Wales Police police officer, Derrick Hasan, protected by his HM title as a Cardiff Crown Court official had pushed me off my walking stick, pushed me down the stairs and had broken my leg.

The Cardiff judges, with a similarly string of district judges, leaped to the suggestion that I had assaulted him!

NHS (Wales) has always been a most lucrative and easy source of income for lawyers but I am experiencing, as a tax payer, something quite unprecedented, at this very moment, here in South Wales.

The protection from criminal prosecutions currently being awarded, for services rendered, to certain Caswell Clinic personnel, in Bridgend, Swansea University and elsewhere, the centres of investigation for a recent run of unfortunate teenage suicides, is only just the tip of the ice berg.

This was my signed Wanted poster, of 5th July 201I, handed in at Cardiff's police station as part of my formal complaint under the 1997 Act for the culprits to be arrested.

But , instead, the police ran around like headless chickens until I was arrested for 'threats to kill the Lord Mayor of Cardiff'!

I was then jailed, brought before another notorious and wicked conspirator, district judge Bodfan Jenkins, who refused to take my 'not guilty; plea, for fear of further bad publicity and fined me £50 !

These evil Cardiff people will stop, it seems, at nothing.

This Wanted poster, in the harassment magistrates case, barrister Evans, of course, pathetically attempted to substitute in front of us all for the 'Dead or Alive' one following the prosecution witness not producing the evidence needed for the pre planned conviction.

Judge Charles 'throws in the towel', intimidated by so many of my helpers in court and decrees this poster as, NOT HARASSMENT

SO, how can it have been so descibed by this same barrister Evans in the 2nd May 2012 jury trial as the breach of restraining order?

And when you ask yourself that how, then, could DJ Charles be caught saying, "all seven incidents had been proven"? The doctor quote extract indicates criminal conduct, does it not?

Nine of the 2010 'machine gun' trial jury told all of us, in the pub afterwards, that the only dessenter of a 'not guilty' verdict was one male who, throughout the two week trial refrused, point blank, discussing the issue other than I was obviously guilty.

How many planted in the 'restraining order' jury when considering it was a majority verdict?

Despite the remaining jury members reminding this possible 'plant' , "how can the prosecution use the museum staff from Dorset,who sold Mr Kirk the WWI DH2 aircraft attached to an antique gun and the man from the Lincolnshire museum, who bought the display aircraft from Mr Kirk, as prosecution witnesses without them also being in The Dock?

Evilness personified, perhaps, with that trial judge, HHJ Paul Thomas QC, for he also not stopping the gun trial but repeatedly blocking my lines of questioning once he woke up to the fact I could expose this inherent deceit in Cardiff's judiciary if I had the investigating officer, Hughes, crumbling in the witness box.

Each judge trying to cover up the mere fact that it was Dolmans, solicitors, for the Chief Constable's, private but pending civil three month damages claim, sstarting in January, might just be the the cabal's modus operandi?

District Judge Charles, remember, used the excuse to prevent me from cross examining the police in any hearing because I was subjected to, in 20110, high doses of morphine sulphate and on crutches because of the rogue police forensic psychiatrist, currently enjoying immunity to prosecution, having an extended holiday on full pay and private insurance contrary, in fact, to which the harassment Act allows him to have! But that's the current state of our judiciary in South Wales.

By10th November 1012 this man switched the excuse that I could not cross examine anyone despite my having obtained, at last, a hip replacement in France, refused in Wales, due to the contnet of the bogus psychiatric reports and therefore my no longer needing the daily morphine.

This same individual then quickly switched to some other excuse dreamed up on the day, still not defined, as to why I could not cross examine policemen!

His Honour Judge Hughes, for its March 2012 Appea, thought for a moment and with no grounds what so ever, followed the same agenda of refusing me right to cross examining anyone. So why was I forced a Meirion Bowen as a witness and allowed to ask him questions but not the police/

Well this, of course, led to HHJ Curran QC, for the 2nd May jury trial, with a real head ache as the jury, if not nobbled, would be mystified and smell a rat.

So all these crooked litlle Cardiff S barristers got into a huddle, no doubt at some incestuous Lodge meeting and got Curran QC, in Feb 2012, to order I could cross examine all prosecution witnesses except the Dr complainant, the main player. [but he was not the complaqinant any more . the taffiaq had not thought it through. The whole welsh audience wanted to see the rogue doctor properly cross examined so the judges had to dreaqm up something to prevent it ever happening. His performance at magistrates, shortly to be broadcast world wide is an indictment in itself as the evilness pervading the Cardiff court rooms.

first Dr ****************** was to enjoy cross examination similar to the court appointed solicitor, Swansea solicitor,Williams' nonsence where he, to date, had challenged no prosecution evidence in magistrates or at its appeal what so ever !!!!

But I soon scuppered that idea by speaking on the Cardiff prison monitored for police to hear along with reading all my ingoing and outgoing mail.

The freemasons call it 'the disemination of mis information'.

Sure enough the devil worshippers showed their hand by blocking certain phone numbers on the already very short Cardiff prison list of allowed recipients in my attempts to prepare for trials whilst on remand.

So what did my Cardiff judges do?

A couple of months later these judges realised the jury may see through the scam so another judge was wheeled out and had me out of my cell for a video link hearing.

He orderedld you believe, that the Dr, the purported complainant, will not be a prosecution witness making the whole saga even more ridiculous. This would not prevent me calling him as my own witness but they could risk that with the obvious consequences!

Wait, reader, until you examine the full 'machine gun' transcipt (Cost in excess of £4,000) and this latest Cardiff Cabal Curran conspiracy, then we will hear the pips squeaking from across the River Severn.

Rogue NHS (Wales) personnel, a doctor Thomas, Professor Rodger Wood and certain others, at NHS (Wales) Caswell Clinic and Swansea University started all this simply due to my winning too many court cases brought by the bullying South Wales Police.

My 2010 quite unintended release from Cardiff prison had now caused the Welsh authorities a serious head ache following their failure to having me interred in Ashworth High Security Psychiatric prison or having me, as a MAPPA victim, shot.

Having been incarcerated, until then, for nearly eight months on remand, three of which having been a terrifying experience in Caswell Clinic, their dealt Gulag card having now failed, meant just what will they try next?

Barbara Wilding, the then Chief Constable of South Wales Police, in the Spring of 2009, had not chaired countless clandestine IAG and MAPPA meetings in Caswell Clinic or police stations for nothing just to allow my acquittal for trading in WWI machine guns and live ammunition.

I note His Honour Judge Curran QC's 4th May 2012 remark to the jury, see link above, indicated I was not supposed to have been told by any of these Cardiff Crown Court judges, staff of Caswell Clinic or a chain of, scurrying away to hide, GPs that I may have a brain tumour!

Curran makes the 10th Cardiff Crown Court judge, at least, proven, since 7th August 2009, to be conspiring to pervert the course of justice .

Just how high up the devil worshipping chain within these Welsh doctors and Welsh judges do we need to go, for God's sake, to stop all this?

But the petty debt action proceeds so Morgan Cole, solicitors, indicate the approximate £10,000 bill, accrued to defend the rogues, I will have to pay if I proceed any further.

There being no form of taxation of such a bill then claiming the same sum from the tax payer when I withdrew was routine. At least there was blood on the carpet despite the hearing not to be in an impartial environment like in Bristol, for example. It was to be heard in the notorious Cardiff Civil Justice Centre, a den of vice, so I had to withdraw.

Barristers, David Gareth Evans, Richard Ace and Richard Twomlow, ALL of 9 Park Place Chambers, Cardiff and barrister Hemmimgs acted as Crown Prosecution HM Queen repesentatives, for the South Wales Police, during my machine gun trial, bail applications and alleged seven breaches of the 1997 Protection of Harassment Act hearings heard between 10th November to 1st December 2011.

Not one of the above barristers were prepared to inform the respective juries there was 'no case to answer', decided, incidentally, by the 'machine gun' jury on the very first day of evidence, some told us afterwards.

Where Harassment/Breach of Restraining Orders were concerned barrister Evans switched exhibits, by slight of hand in magistrates and consistently lied over many facts accurately noted by my Mackenzie Friends crowded in the public gallery. All to be published in full shortly for the English Bar Council to examine as an example of what daily goes on in Welsh law courts for local people to both fund and suffer.

This Dec 2011 Harassment debarcle terminated with an 18 week retrospective jail term conviction only because district Judge John Charles felt intimidated from so many witnessing and recording his and the barrister's disgraceful conduct. A purported service of a restraining order, also much disputed, was, of course, planned to be given to me in prison and not in the cells.

Apparantly I was accused in harassing one of the Welsh doctors listed, I am informed by many, by this week's NHS alarming report on how many victims had similarly been incarcerated under false psychiatric reports and pretences or, as in my case, with the doctor not even having the appropriate qualifications.

That was precisely the case as with my Caswell Clinic,Bridgend forensic psychiatrist, he being immune to prosecution because he, like this barrister Evans, worked for the South Wales Police.

Jeremy Hunt says up to 5,000 mental health patients may have been sectioned over the last 10 years by 'unapproved' doctors

Up to 5,000 mental health patients may have been sectioned over the last 10 years by doctors who had not undergone proper approval, Health Secretary Jeremy Hunt has said.

Mr Hunt said there were "irregularities" around the way doctors were approved before they could assess patients for detention under the 1983 Mental Health Act.

He told the Commons: "Our latest best estimate is that 2,000 doctors were not properly approved and that they have participated in the detention of between 4,000 and 5,000 current patients within institutions in both the NHS and independent sectors."

Mr Hunt said four of England's Strategic Health Authorities were affected, with some patients sent to Ashworth and Rampton secure hospitals, home to some of Britain's most notorious prisoners.

The Health Secretary said emergency legislation would be rushed through Parliament to deal with the scandal, which he learned of last week.

But he added: "There is no suggestion that hospitalisation or detention of any patient has been clinically inappropriate, nor that the doctors so approved are anything other than properly qualified to make such recommendations, nor that these doctors might have made incorrect diagnoses or decisions about the treatment patients need.

"All the proper clinical processes were gone through when these patients were detained. We believe no-one is in hospital who shouldn't be, and no patients have suffered because of this."

He said doctors recommending patients to be locked up would not have known they had not been properly approved to make such recommendations. "They acted in good faith," he added.

Shadow health secretary Andy Burnham said: "Detaining people under the Mental Health Act raises the most serious issues of fundamental rights and of patient and public safety. Any reported failure will therefore always be a matter of the highest concern."

Mr Burnham said MPs wanted to "get to the bottom of the unacceptable breaches of procedure we have just heard about".

BUT HERE IN WALES things are quite different.

My so called 'shrink' neither had the qualifications nor competence to inform the then nine Cardiff Crown Court judges that I had 'significant brain damage' and a possible brain tumour, as written in his psychiatric reports. He always left that to the police barristers, as with His Honour Judge Bidder QC, on 2nd December 2009, for example, while I was held in a cell beneath being refused any legal representation.

CPS barrister Richard Thomlow, from the same 9, Park Crescent Chambers, Cardiff, waxed eliquent determined to have me incarcerated in Ashworth High Security Psychiatric prison, IPP, imprisonment for public protection. My Father, Maurice John Kirk (MJK) was refused the right to apply for bail before four judges, consisting of Judge Morris, Judge Cooke, Judge Llewelwyn

‐Jones and one other, on 6th July, 16th July, 30th July and 7th August.

On 6

th July, his Honour Judge Morris said "I am not hearing any applications" and then promptly switched the video screen off when MJK tried to respond. I am assured this was recorded, and therefore, presume this can be proved by the transcript/voice recording of the hearing. In addition, witnesses of our own were present also.

On 7th July and 30th July, MJK was even denied the right to be in court.

MJK was again refused the right to apply for bail, and was refused legal representation in the hearing when he was certified under Section 35 of The Mental Health Act 1983.

th August, MJK had been informed by a Doctor by the name of Dr **************, "it was to be a bail application".

I, son of the accused, apply for MJK to be produced before a competent court without further delay, in order that he be allowed to make a bail application as soon as possible, as due to his incarceration, he is unable to make this WRIT application himself.

PARANOID DELUSIONAL DISORDER

On 01 October Judge N Cooke refused me bail. Since 25 June I have been denied the right to apply for bail as I appear to be under the control of MAPPA (Multi Agency Public Protection Arrangement) without being notified for what reason.

Am I considered dangerous, despite FTAC (Fixated Threat Assessment Centre) clearance in January?

The Judge, after indicating I may be released, first asked if I would co-operate with further examinations at the clinic. I deferred my reply to establish just what was causing my having been locked up all summer and who instigated it?

The Judge then produced a single page extracted from my website, out of context, following the South Wales Police refusing to identify any of the police officers at the 43 incidents listed with police authority ‘occurrence numbers’ stored on the Police National Computer for easy reference.

The Chief Constable’s 25 February 2009 erroneous sworn affidavit refers to this matter – see website downloads www.kirkflyingvet.com.

Both the Chief Constable and Adrian Oliver of Dolmans solicitors, Cardiff, are the subject before the Barry Magistrates Court on 23 October in a private criminal prosecution and other related alleged offences originating from 1993 covert police surveillance by South Wales Police on my veterinary surgeries and home and which is ongoing.

The Judge indicated I would offend again and sent me down to attend court on 26 October. The page he referred to identified my £10,000 reward for the home addresses of retired Police Officers and Crown Prosecution personnel.

In order to serve a witness summons private investigators have explained the only method left open to me as the police refuse to even answer my letters.

Welsh MAPPA meetings regularly include police, members of Caswell Clinic personnel and agents for the Judiciary, including the CPS

Judge Cooke knows the relationship between the Royal College of Veterinary Surgeons, South Wales Police and the HM Attorney General as co-defendants he having sat on one of my cases, only to witness the Jury catch the police ‘red handed’ signalling to the PC on cross examination. They even put it in writing to Judge Cooke, but the Judge let the culprits get away ‘Scot free’.

Judge Cooke already knows I have been subjected to intrusive techniques, including SPECT (single photon emission computed tomography) and the refusal by the HM clinic to disclose any of my medical records.

Judge Cooke knows there is no right of appeal to this 3rd 28 day consecutive court order when well over 35 hours of intense interrogation has already taken place with doctors alone.

Psychiatrists from both Cardiff and Swansea University, with funding from the USA in their research, have played a major part.

For him to refuse me the right to hear the 03 September court hearing tape (transcript omitting both my request for a bail application and allegation that the clinic had ‘put something in my tea’ is but ‘small beer’ to his ignoring my need for analgesia due to a splitting headache.

Not the court fraternity, custodial staff of the cells, nor even the numerous psychiatric nursing staff, that it needed to get me there, would supply anything to alleviate the acute pain.

Judge Cooke will know that on 26 October Dr (name redacted 01/11/12) will reiterate his previous suggestion that I may now be subjected to anti psychotic drugs, possibly by force and further sectioned to remain in custody indefinitely purely at the discretion of the Ministry of Justice.

Judge Cooke again refused to take a pleading saying I was not fit, despite the 29 September psychiatric report clearly stating to the contrary!

It was Judge Cooke with two other barristers on 16 July who all discussed a submission that it was not about who was holding the parcel when the music stopped.

Judge Cooke reused to seize exhibit AJR/1, the antique weapon following my written request to prevent the police from furthering tampering with it. Now, I wonder why?

Judge Cooke is just another in a string of court cases where successive judges have refused to establish just who instigated my arrest in the first place, who appointed the Caswell Clinic and who instigated a Section 35.

Cardiff's cabal ordered the lot from the State psychiatric hospitalm in Austin but on reading them Cooke ordered they be shredded.

COMPLAINT

I wish to make a formal complaints against these barristers Thomlow, Ace and Evans in their appalling and unlawful conduct during trials, bail applications and the summary hearing ending1st December 2011 at Cardiff Magistrates and during the Crown Court trial, ending 4nd May 2012, before a bemused jury and audience.

What did each trial judge know about basic human rights?

I, for example, in the past year been refused fundimental disclosure of court and custody records, CCTV, time to cross examine, access to my legal papers, exhibits, all waiting in my cell. Judge Curren even refused me my right to see my witnesses before during or even after the ridiculous trial etc etc

No restraining order was ever served on me in the magistrates cells at the end of the case and the CCTV, asked for by both me and the jury, was deliberately destroyed because of my being beaten up by five GEOamey Custodial Services employees, throwing me out on the floor and chucking my crutches out on top of my head causing others to lay on a wheel chair.

Evans' conduct at magistrates clearly showed the knowledge I was absent and in the cells. He knew just what he was telling the district judge JOHN CHARLES were bloody great lies.

The common assault conviction had already been arranged, for Peter's sake, to be quashed when it was to be heard well out of of wicked Wales, in Bristol Crown Court, nearly two years later.

Getting back to a Cardiff criminal court example, "a relatively minor offence" the evil judge Charles said.

Charles had been the one in the first place, over a year earlier, in August 2010, when he had ordered I was not allowed to cross examine any of the prosecution witnesses.... I was to have their own court appointed defence lawyer do it!

Quoted recently by Bristol CPS, when applying to not oppose my appeal against conviction of 'common assault'

"Your Honour, the complainant is now reluctent to give evidence" (in the light of being cross examined for the first time).

This x-ray of my ankle, after the ex copper, Derrick Hasan, had pushed me down the Crown Court steps and off my crutches. I have needed nine unnecessary months on them with almost daily morphine sulphate only because no one in the Welsh judiciary and NHS (Wales) had the balls to have my 2009 psychiatric reports corrected to allow me a total hip replacement operation in England.

All in a day's work here in Cardiff's stinking cabal.
