Having been refused the right to apply for legal aid, eye witnesses, disclosure of custody records, the three prison officers who saw me arrest Mr Rogan in Cardiff prison, for withholding my passport on police orders, copy from any one of the seven CCTV cameras also recording the very hilarious event, my ‘conduct’ in the court below was just routine. . . I Cardiff criminal courts you are invariably denied your legal papers in the court room and if a prisoner you are not even allowed to take them off the prison wing. . . That day, in Cardiff’s Crown Court, before HHJ Crowther QC, I could neither see nor hear much of what was going as my hearing aid had been pinched from my cell, my glasses secreted in in my legal papers, at the foot of the court stairs, hoping to get at the file and compounded by the discomfort from temporary haemorrhoids caused by so much legal data having to be regularly stuffed up my rectum. . . I was was quickly stopped, more than once, by Their Lordships from enquiring as to what evidence of so called prisoner ‘conduct’ did the CPS refer and by whom did this HM barrister obtain such allegations if not from the South Wales Police? A touch of the re run, I thought, of Downing Street’s HM Privy Council/ RCVS Deja vu? This will be the next HM ‘cosey relationship’ within our South Wales Police/HM Judges/HM Crown Prosecution Service/HM Court and Tribunal Service needing to be quashed AND maybe, without even the need to cross the Severn Bridge! 16 02 04 RCJ note jugment 16 02 08 note taking CO042492014-Final Order His Honour Judge Seys Llewellyn QC, in my protracted actions against the South Wales Police for over 20 years of malicious prosecutions, has granted time for the production of further evidence of: An over arching course of conduct of police misfeasance in a public office My right in exposing Barbara Wilding’s ‘shoot to kill’ intention, following her clandestine 8th June 2009 Barry police station’s meeting, to have me registered MAPPA level 3 category 3, has been thwarted by His Honour Judge Seys Llewellyn QC this week. The MAPPA meeting had consisted only of senior police management and her chief forensic psychiatrist, Dr Tegwyn Williams, with his psychiatric nurse, Ms Elizabeth Paul both of Caswell Clinic’s medium secure psychiatric unit housed in Glanrhydd Hospital, Bridgend, South Wales. The then Chief Constable had blackmailed Dr Tegwyn Williams to concoct NHS (Wales) medical reports to have her adversary in court, claiming damages, to be locked away, hopefully indefinitely, in Ashworth high security psychiatric hospital without any need for the ‘machine gun’ trial. No evidence of Dr Tegwyn William s diagnosis of ‘significant brain damage’ or Crown Prosecutor Richard Thomlow’s pleading for MAPPA 3/3 victim be incarcerated in Ashworth High Security Psychiatric Hospital, with possible brain tumour, indefinitely. . . Mr Thomlow is now a Welsh judge, incidentally, which must signify the obvious while Dr Tegwyn Williams was sacked from the NHS for what he has done and now down in Christchurch, New Zealand, I last heard. . . .I have personal experiences of NZ police, in my jaunt around that great place, in Liberty Girl, that lost more per capita than any other HM King George Country in WW2, …..Yes, I was stopped by NZ police for various mischievous allegations, BUT always with a smile! The jury asked for them and was refused and I asked for them, of course, as there is no record of any restraining order ever being served on me in the cells.

CPS, polioce, judges and CCRC have them but we cannot.....does it stink?

Criminal Cases Review Commission (CCRC) appears to have washed its hands of the case.

MUSA six children snatch by Harringay Council is what it is actually all about. I was prevented from exposing the disgusting law firm, Spencer something in Kilburn High Street, stealing the legal aid whilst pretending to act before Musa parents gaoled 7 years.

I was arrested for 'failing to attend' the vital hearing for their release.....just minutes after the 'restraining order ' was attempted to be stuffed into my pocket as I was being dragged out of my cell by very irrate Geomey custody officers wanting to go home. (Cardiff prison was ordered NOT to produce me to London court).

Just What Really Goes On in Our Courts

21.34 hrs and I am still holding......

21. 25 hrs I ring South Wales Police101 number again as I am far from happy with Roger's 'advice' (advice I must say appropriate for the sort of calls I can imagine he is swamped with every night). I am asked to hold...but not before suggesting it takes only one phone to arrange for the doctor's house to be burnt down to address the minds of those ultimately responsible for what they have done to both my family and my life.....

21.07 hrs I ring Roger Davies on police 101 number re advice: Do I go to court on 16th or go to a long overdue Bristol psychiatrist appointment to get brain scan and establish once and for all ...do I have a brain tumour or not?...... if not I can have my cancelled CAA medical restored to allow me to fly in the cub to South Africa.

Dear Madam,

Regina v Maurice John Kirk (Kirk v South Wales Police) Further to my e-mail seeking advise as to which 16^th October 13 appointment I take, my preferring the psychiatrist’s appointment as I have waited for over four years, I find there are still several Crown Court appeals and other outstanding issues relevant to the trial listed on 12^th November 13.

1. My 12^thApril 2013 appeal application (Case 62120007323) filed with the magistrates remains ignored despite reminders and despite my sixtieth odd Judicial Review Application paid for and posted.

This is a residual matter from the 25^th January 2010 jury trial, re my trading in machine guns. The fact that I was acquitted meant the South Wales Police, with malice afore thought, continue to refuse to return my property confiscated during their 22^nd June 2009 dawn raid, brandishing automatic weapons.

The truth of the matter was they simply wanted me jailed for anything to affect my current ongoing twenty year running civil trial and even attempted to snatch our ten year old daughter under Operation ‘Orchid’ to further undermine my, then, already fragile state of mind..

2. Money for fifteen further court cases

As my purloined collection of antiques and shot guns exceeded an estimated £10,000 in value may I apply for the residing Crown Court judge to order the immediate release of said property that I may dispense with the need of my applying for Legal Aid and delay the police may cause? District Judge Bodfan Jenkins continues to refuse to state a case for delayed JR.

3. My appeal for 'common assault' conviction from arresting a mischievous Cardiff barrister, attempting to pervert the course of justice yet again, needs to be listed for an early hearing except another hearing before that is needed, outside Wales, like last time, because this individual has, at this late stage, now employed another barrister, at tax payer’s expense, stating he does not like the thought of my cross examining him again.

4. He is, of course, the Crown Prosecution lawyer who cross examined me in the past but is now fearful that my reason for his arrest may be disclosed to the general public. On 1^st December 2011 this complainant, David Gareth Evans of 9 Park Place Chambers, Cardiff, was and still is, despite my years of countless applications for disclosure, privy to the content of court and cell CCTV, police, court and custody records that will clear my name to successfully apply to become a veterinary surgeon.

5. Most important is the fact that both he and His Honour Judge Richard Thomlow have access to the Cardiff Crown Prosecution computer that produced the draft version my ten witnesses all watched District Judge John Charles scribble all over before ordering it be shown to me in the cells for my approval. 6. The 4^thMay12 jury, during my ‘Breach of a Restraining Order’ hearing, was, just like myself, refused sight of any of the above public records simply because Luigi Stranati, court manager, had not transferred the case to England as I had previously requested. When it suits the CPS, I notice, it is transferred to England like with the last two cases so similarly constructed. 7. That 4th May12 jury requested information that was all destroyed and will only be confirmed by, 'on who's orders', from David Gareth Evans if he is on oath but only if he is cross examined by myself.

6 and 7 seem to have been removed to protect that nice doctor who was so wise in his diagnosis and report about M's brain...

8. He knows I NEVER EVER WAS SERVED THE RESTRAINING ORDER, to possibly breach about three days later, by anyone that day as it was arranged by the then Recorder of Cardiff, His Honour Judge Llewellyn Jones QC, on 14^th November 2011 for a longer prison term (see clerk of court notes and High Court Order) with the usual intention for the prison to serve it upon my release.

9. But ‘the fearful sight of ten outsiders in the public gallery’ and Strinati sneaking in was just too much for the district judge who significantly shortened my prison sentence sufficiently enough for my immediate release.

10. Release for only twenty minutes, I hasten to add, before the next trumpeted up South Wales Police conspiracy unfolded and my arrest for ‘Failure to attend court’.

11. Just two days earlier, with me in prison, the Nigerian Musa family’s corrupt Kilburn High Street solicitors hearing succeeded as without my evidence they had buried the truth of their unlawful arranging of Tottenham police arresting both them and myself.

12 Similarly iniquitous conduct, months earlier, by the Haringey Council’s huge lawyer team, had me gaoled from the High Court to further aid their lucrative snatching of the six Nigerian children.

13. Mr Evans also knows, full well, that had John Charles allowed me to have cross examined the rogue police psychiatrist, under exemptions under the 1998 Harassment Act in the first place, in November11 and again by His Honour Judge Hughes refusing me in 1st March12 appeal of the conviction, none of these cases mentioned in this letter, today, needed to have been outstanding AND that includes my stayed civil police harassment trial BS614159

14. The police refusing to allow Newport office to issue me with a new passport, this week, my having previously had my current one unlawfully confiscated by the Defendant in my civil claims is just power for the couse for an Englishman in Cardiff.

15. Legal Aid is still not processed as Luigi Stranati still refuses my right, even on the telephone, to try and clarifying the Legal Aid queries my Bristol solicitors received when they gave up with the Welsh court. wishing no disrespect to the presiding judge my health, with or without a psychiatric examination, will affect whether I can even speak in any further court rooms as my only legal commitment is, I submit, to attend and not necessarily need to speak

16. Disclosure applications for information controlled by David Gareth Evans, CPS and the police, still need to be re addressed for both the outstanding appeal and this imminent trial.

17. I propose asking for a number of witness summonses to be served and as their subsequent counter measures will be both lengthy and expensive, may I suggest that both primary and Section 8 disclosure be ordered within seven days in the light of their refusal in disclosing my interview DVD and depositions from the last aborted trial.

18. I was entitled to all this from the very start and with a pragmatic expeditious process just as it was in all my three previously successful occasions in Bristol Crown Court concerning completely unrelated criminal allegations.

19. To reduce the number of appeals envisaged, following successful service of summonses on hostile defence witnesses and to counter this deliberate delay of my civil claims are you able, as a criminal court order independent arbitration because, while I still breath, there will be many more malicious prosecutions ahead?

20. Police withheld disclosure of CCTV,telephone and computer records created by the two complainants, Mark Davenport and Nathan Kingsley, before, during and after, alleged assault and subsequent 'intimidation of a witness' alleged incidents need addressing as the police already have mine and will not disclose as unlawful MAPPA level 3 24/7 surveillance continues here in South Wales.

21. I have been denied access in the past to this court room to give evidence, as last time, on precisely these very same issues when raised but, as usual, blocked by 'dark forces', 'the powers that be' that pullute society today.

22. The time before that, on 2nd December 2009, the CPS barrister, Richard Thomlow, also of 9 Park Place Chambers, supported the police psychiatrist in the conspiracy to strike out my current suspended civil case, BS614159, by applying for my being incarcerated in Ashworth high security psychiatric hospital for life. 23. Barbara Wilding, past Chief Constable, had failed earlier in having me shot on 18th June 2009 but only because there were far too many CCTV cameras and armed police in attendance, inside police HQ, to cover it all up an unlawful killing.

24. The South Wales Police have ‘proof of innocence’ and evidence of complainants lying for material gain but, as usual in my criminal cases are, not always so minded in telling any one. His Honour Judge Seys Llewellyn QC has indicated I may apply through his civil court in order that I may get access to my legal papers and clothes in my flat but the police strenuously oppose it.

25. I humbly submit that only the Cardiff Crown Court can vary the bail restrictions following twelve police officers threatening to arrest my daughter's Bristol based bailiff carrying out his lawful duties in eviction of the said squatters.

26. I declined His Honour's offer as I was aware of legal proceedings had already commenced from England. Luigi Stranati would have again 'burnt the mid night oil' in blocking any new judicial process of mine especially as the Cardiff Cabal appears to have over reached itself this time.

27. The police continue to oppose my having a passport as it is a potential threat, not just to retrieve my papers in Brittany but to their incestuous little world of money making, generally at the expense of the UK tax payer. My visit to France, to find a lawyer, may also lead to the ordering from London that Luigi Stranati allow me access to public court counters in order to process my Legal Aid application papers to expedite outstanding litigation including the machine gun/MAPPA/NHS (Wales) conspiracy implicating so many in both the judiciary and executive of The Principality.

28. Dolmans, Cardiff solicitors, have acted for all the Chief Constables in my twenty year running civil damages claim, for relentless police bullying and malicious prosecutions and in particular over the 'machine gun' case advising over IAG and MAPPA meetings and PII/MAPPA disclosure opposition, in the civil court, once I was acquitted of trading in WW1 machine guns bolted to display aircraft. Not only was the process of my being sectioned under the 1983 Mental Health Act ultra vires, with immunity given to the rogue police psychiatrist, the continuing bullying throughout the four month civil trial I consider as a criminal act with intent to pervert the course of justice.

29. Today I am told by two witnesses from 5^th May 2012 Crown Court public gallery that, following the jury passing a written note to the trial judge, in my absence, with regards to CCTV, court or custody records being in existance with the recording of the alleged service of a ‘restraining order’ on me in the cells, CPS barrister David Gareth Evans was heard to deliberately misinform the jury to obtain a conviction. 30. I make application to listen to the court tapes, for both the outstanding Evans appeal and 12^th November proposed trial, see original documentary evidence of service, under the laws of best evidence, purported to recorded in both 1^st December 2011 GEOamey custody records as well as magistrate court clerk Michael Williams’contemporaneous , as all previous requests have always been refused.

Seventeen arrests since and without a single successful conviction causes me to wonder whether anarchy really does reign supreme here in South Wales.

This date clashes with court ordered Bristol psychiatric examination of me and speaking on Bristol radio, my being just another South Wales Police MAPPA victim subjected to their relentless bullying.

1. To which appointment, please, do I attend?

2. Just who has the power, in Wales, to order area HMC&TS court manager, Luigi Stranati, to allow me to process a Legal aid application at Cardiff Magistrates court public counter when I have been banned by him from all South Wales court counters since 2008?

3. Just who has the power when I am purported to be diagnosed with both 'significant brain damage' and a possible brain tumour, when confirmed by HM Crown Prosecution Service in 2nd December 2009 Crown Court hearing, over some matter about my trading in machine guns and to be sectioned to Ashworth High Security Psychiatric Hospital? Neither doctor nor barrister, Your Ladyship and Your Honour, had the relevant qualifications and were both lying with intent to pervert the course of justice.

5. Just who has the power to make the South Wales Police hand back my passport, currently unlawfully withheld, following their blocking HM Newport Passport Office from issuing me with another to obtain legal papers from France?

6.Just who has the power to make the South Wales Police hand over evidence requested by 4th May 2012 jury (Breach of Restraining Order) indicated in their succinct note to His Honour Judge John Curran QC, unbeknown to me, if not your local Masonic lodge?

7. A similar jury note is likely to be repeated on12th November 2013 so who has the power then, in Wales, to order the South Wales Police to disclose my police/court/prison custody records, clerk of the court records and CCTV, both recorded at incidents and whilst I was in custody, not forgetting the numerous interview, under caution, DVDs denied me on so many previous occasions?

Outstanding Criminal Allegations to be Withdrawn to avoid Statutory Disclosure of Police Conspiracy Evidence 10am Cardiff Crown Court

Applications today will be made for the transfer of all my outstanding court cases to be properly heard well out of South Wales, it being exactly what the Crown Prosecution (Wales) have done with me, in the past, when the 'truth' is even too embarrassing for that 'shower' of reject attorneys to stomach. (ex police officer Derrick Hasan, working for HMC&TS Welsh manager, Luigi Stranati, pushed me down a flight of Cardiff Crown court steps to break my leg).

Nothing New Under the Sun,

where the South Wales Police is Concerned!

Yesterday’s Recorder of Cardiff Crown Court hearing was squeezed in between Her Ladyship’s heavy and far more serious agenda than Chief Constable’s Peter Vaughan’s oh so predictable continuing harassment of one of their too fast ageing victim.

Since his predecessor, Barbara Wilding, signed her Dolmans solicitor’s fabricated affidavit, to hide what triggered or contributed to extreme bullying, the incident of her Chief Inspector Brian Genner’s daughter’s miscarriage all blamed on me, police HQ’s conduct lately has worsened.

The changing of the machine gun’s paintwork , just to try and fool the jury, may be one out standing incident for Peter Vaughan to now address or Cardiff Cabal’s refusal to even return all my lawfully held antique guns, to the value of £10,000, confiscated purely out of shear spite, may be another but while the stay on all ‘Kirk v South Wales Police’ is in place for, so far 99 witnesses having given evidence, this current ratchetting up of their multi facetted conspiracy will show us all, at least, ‘just what really goes on in our UK law courts’.

Yesterday, for example, if you get in to the public gallery it is designed that you hear little and while not being allowed supervised tape recording for your own use, unlike elsewhere your time there is almost futile.

If you are in the Dock then forget it as it is even worse even if handed an audio loop to use. Bullet proof glass meant, in one of my recent cases, that it became so ridiculous I pushed off to my cell to have a cup of tea and read the paper while they ‘got on with the verdict (already laid down by written instructions by the then recorder of Cardiff , HHJ Llewellyn Jones QC. In that case the District Judge, John Charles, ordered I was not allowed to cross examine anyone, not just the rogue psychiatrist and Caswell Clinic staff that sanctioned the fabricated paperwork to have me registered MAPPA level 3 to get shot.

I have to fight for my custody records but, sure enough, my passport was listed in my property but when I was ejected from the prison it was nowhere to be seen!

Why snatch your passport, my friends in the public gallery asked? Your legal papers from your prison cell is obvious and the blocking of access to lap top and CDs but why the passport, so unlawfully?

That is an easy answer

1. His Honour Judge Seys Llewellyn QC’s 4^th September 2013 Judgment, staying ALL my civil proceedings against the South Wales Police, following their latest ‘knee jerk’ flair up of ‘activity’, to have me gaoled for the seventeenth time, since 2010, without achieving a conviction, means the Crown Prosecution Service (Wales) has had to employ a barrister from outside the area. The Bristol based barrister’s task is to secure my next unlawful incarceration in South Wales signifies just how desperate the Cardiff Cabal is becoming.

2. Mark Davenport was a witness, earlier this year, to the South Wales Police having me arrested in Brittany, sectioned and locked up in a French psychiatric hospital. I only escaped further sectioning because a passing nurse, who looked after me two years earlier, recognised me and set the alarm bells ringing. I had been in Pontivy hospital for my hip replacement as my NHS Caswell Clinic diagnosed ‘significant brain damage’ excluded my being able to be operated anywhere in the UK. Further evidence of the ‘entante cordiale’ police ‘cross border’ conspiracy could only be gathered by my personal complaint to the French IPCC, in person.

3. Without my passport in my pocket I could be arrested again, snatched off the street, as ‘ non identifiable’ and sent back to Cardiff prison just as Cardiff police had been done before from the very same two police stations dealing with this current scenario.

4. Her Ladyship asked that I put into writing reasons why I needed all criminal cases to be heard well outside South Wales before considering the possibility of ordering put in writing

5. Her Ladyship asked that I put it in writing why my last year’s incarceration before dropped indictment , following two Caswell Clinic doctors lying to the police that I had been around to their home harassing them, was relevant to this present list of charges.

6. Easy, I thought to myself, it is my legal submission that last year’s conspiracy with the two doctors to jail me, without trial, IS within this court’s jurisdiction BUT more to the point, it is relevant to His Honour Judge Seys Llewellyn QC’s civil stayed case. I might serve the full content of the hundred or so lever arch files of evidence during the 27^th Sept? proposed management hearing in order to finally get that jury promised me 20 years ago when I first started fighting this cess pit of evil in South Wales.

7. I was, incidentally, again refused a copy of my custody video as defendant interview, under caution, as it is so crucial, each time, to expose police conspiracy.

8. The exclusion of the video is the first positive indication of the CPS proposing to drop the charges as no judge in Wales will get you the proof of the conspiracy on depositions once the case is buried. It stinks, doesn’t it?

9. Often, just like in many of my previous cases, none of the relevant CCTV footage, under the care of the police/CPS/courts or ‘apparent ‘victim’ making the complaint appears to be disclosed, despite my demanding as soon as the hand cuffs clip on. Just as HHJ John Curran QC said to the 2012 ‘Breach of Restraining Order’ jury, in reply to their note, for court and custody records and cell CCTV, ‘unavailable’! Deja Vu

Claimant’s Application

1. Further to the court’s indication of offering assistance for the Claimant in obtaining access to his own flat, in order to retrieve his relevant legal papers, video records, post and personal medical records for the next trial, Kirk v NHS (Wales) Defendant’s psychiatrist, he must now retract his originally decline the court’s offer.

2. The Claimant’s then instinctive impression, that it was for a Welsh criminal court, not a civil court, to intervene, was entirely misguided.

3. The Claimant applies to the Cardiff County Court to order the Defendant to cease, forthwith, the continuing acts of harassment against the Claimant, all contrary to Section 2 of The Prevention of Harassment Act 1997.

4. The Claimant now only enters South Wales to expedite outstanding litigation against the Defendant and agents thereof and with the hope to see his past wife and daughter.

5. It has became apparent upon enquiry, to day, that neither the Defendant nor HM Crown Prosecution Service (Wales) will cease in their joint course of conduct of harassing the Claimant to prejudice the Claimant’s closing submissions while openly protecting the unlawful occupation of the shop below his flat.

6. Mark Davenport’s conduct includes switching off the Claimant’s electricity, changing the lock of the Claimant’s front door and garage gate, has reported the Claimant, by witness statement, to the Defendant for committing fraud and common assault while he continues to employ labour, on the ‘dole’, to allow lorry loads of builder’s waste and other hazardous materials to be dangerously fly tipped onto this Claimant’s land.

7. The Defendant’s resistance, now, to allow its 2000 custody video record to be an exhibit, following the Llantwit Major’s brutal arrest in the town square, is fanciful. The Claimant left his exhibit with the court and just because it was not ‘played’ to Sgt Khilberg is, the Claimant humbly submits, quite irrelevant as it still remained a Claimant prosecution exhibit of this sergeant again caught lying and this time to another custody sergeant, re “F******skunk”.

8. The fact that Claimant’s legal papers are now missing from his flat and arising from several break-ins to his motor vehicles compounds the reason why there should be an immediate intervention from an outside police force if the Claimant’s own MP cannot influence this inherent culture of deceit committed by too many, around here, in positions of privilege.

During the 23rd July hearing and while the Defendant's QC was rabbiting on and on with quite fanciful and irrelevant arguments in 'air law', trying frantically to quash the very idea his client just out to 'GET KIRK', His Honour Judge Seys Llewellyn QC quietly directed him to their client's 21st July 1999 letter to the Civil Aviation Authority when asking just where is the air to video (recording the lettering on my t shirt....I'd Rather be Flying G-KIRK' ?

The court was told that the police had sent the video to the CAA with the view of my being prosecuted, with it, for daring to not just sit in the back seat of a cub but in one that then had 'broken the bonds of earth' and left the ground!

To produce the video proof of just how dangerously close the police helicopter was prepared to go, just to 'GET KIRK', I had to ply the air traffic controller, 'JC' to his mates, Jonathan Clayton with many shots from a bottle of whisky until he was so 'rat arsed' he sang like a canary. His Honour's following remark was something like, "and I suppose the pilot of the police helicopter, Captain Jim Moseley, also disappeared into the mist and clouds?"

On 20th July 2013 I am just released after another night in police cells because of liar, MARK DAVENPORT, ringing police to block my getting into the flat for my legal papers required for the final day of my twenty year running damages claim against the South Wales Police.

After an hour in Cardiff Magistrates, before proper Cardiff magistrates for a change and not the usual District Judges, John Charles or Bodfan Jenkins, fundamental issues with the help of the Clerk of the Court were sorted out.

But DAVENPORT had switched off the electric and had changed the locks whilst employing staff who were drawing the dole to help him allow fly tipping on my land.

After I had heard the usual evasion of the truth and shouts of almost, "liar, liar, your pants are on fire", Her Majesty's Representative, as prosecutor believed be also from 9 Park Place Chambers, Cardiff, eventually was made to release, albeit far too late, my custody record including the video made under caution that will knock this new bit of trumped up nonsense right on the head.

Yes, Mr Kirk must be allowed to live at the flat, the court heard and what of the squatter in the shop below, was my reply?

At the end of proceedings I felt it only appropriate to recommend that the Madam Clerk of the Court to be o0ffered a position as an inquisitional judge, as under the laws of Code Napoleon in a court somewhere in Brittany.

Whilst the Cardiff Cabal continues to protect the rogue police doctor and the courts appearing protect the other ring leaders behind my twenty years of purgatory whilst resisting both extreme and unusual irregularities from those in positions of privilege the Cardiff courts will continue to have my most undivided attention.

Her Majesty's representative again misled the court concerning the outstanding matter of the rogue police psychiatrist.

The Caswell Clinic psychiatrist and his Cardiff Cabal are still maintaining, three years on from the MAPPA level 3 'machine gun' acquittal, that their victim is still 'medically unfit to plead or stand trial' when it so suits but not when circumstances are not helpful for them (see The Times On Line' comment below).

Meanwhile I remain diagnosed with 'irreversible significant brain damage' and possibly cancer that caused the current Defendant, in these current civil proceedings, on 2nd December 2009 Cardiff Crown Court, to recommend, via barrister Richard Thomlow of 9 Park Place Chambers , Cardiff, to recommend that I be incarcerated in High Security Psychiatric Hospital most likely for life.

NHS (Wales), at Caswell Clinic, are reliant on not just a brain scan interpreted by someone without the appropriate qualifications after using the wrong techniques but on its supporting documentation for the Cardiff court stating I have significant brain damage because:

1. I had been an old drinking partner of actor, Oliver Reed Esq

2. I had ditched my WW2 aircraft in the Caribbean and

3. had flown all the way to Australia without a map

This continuing bullying by the police and causing false imprisonments, just as with their refusing to release of my own 5 page victim statement following complaint, last year, by this same Caswell Clinic psychiatrist having had me locked up in prison for weeks following his latest fanciful delusions that I had been around to his home and harassed both he and a DR JANIS HILLIER I have never even met.

The release of these 13th July 13 custody records together with the video record of my 'Defence Statement', in rebuttal to an allegation of two common assaults on DAVENPORT and another, are needed as exhibits inTuesday's County Court hearing before His Honour Judge Seys Llewellyn QC on the final day of the first three of seven damages claims listed soon for a hearing.

On that 13th July 13 I was arrested by a PC Charles......"Any relation?", I asked the court.

And by 7.30pm on 19th July I am again arrested and with hand cuffs behind my back hauled into a police car with not even the right to have a road side breath test. Hang on here, I said, it was I that asked for police officers to attend this time!

I was also arrested just a few weeks ago whilst quietly parked on private property, on the pretext of 'drink drive' but with no moving traffic offence as their excuse.

In both these 'drink drive' incidents there was significant delay for over one hour before having to provide a specimen of breath!

The 2nd delay was one hour and thirty five minutes and was deliberate for senior officers, no doubt, to be contacted to set up another conspiracy to pervert the course of justice. Remember, please, the numerous police incidents in the three current claims for damages contain three road side incidents recording positive specimen of breath taken but all zero within one hour of my arrests.

I, Michael Murphy of The Old Police Station, Barry, confirm that the content of this, my statement, is true to the best of my belief.

Back in the mid 90s Mr Kirk had flown over my scrap yard, situated next to Barry harbour to identify his car lying there and then reported me to the police for theft.

A neighbour had previously arranged to have Mr Kirk’s car towed off private land to the rear of his veterinary hospital in Tynewydd Road, Barry and onto the adjacent public road.

Mr Button had then telephoned me to say that I was to remove the vehicle from the public highway but was to keep it for a minimum of fourteen days.

If by then it had not been recovered by the rightful owner then I was allowed to dispose of it as I pleased.

Draft Restraining Order Found!!

The 1^st December 11 draft restraining order, re harassment conviction of an unusual police psychiatrist, hand written by District Judge John Charles, was mysteriously suddenly found yesterday in Cardiff magistrates in a hearing denied the usual press coverage.

Produced by Barrister David Gareth Evans first complaining I had assaulted him during by my private person’s arrest for his continuing abuse of his position as Her Majesty whilst prosecuting in a UK British Court this revelation is a break through to go back to Lord Leveson at the Criminal Court of Appeal.

My 23^rd April 2013 arrest of this lawyer, carried out following indication the South Wales Police would not investigate on my behalf, as to how this HM Crown Prosecutor, David Gareth Evans of 9 Park Place Chambers, Cardiff, had clearly perverted the course of justice AND the offence is still on going. when he originally watched NHS (Wales) doctor, the complainant in the original harassment summary hearing, have me registered his mental patient simply so he could not be cross examined by me!

I politely warned the visiting district judge, a Mr Layton, believed to be from outside Wales, that until this doctor and those hell bent in conspiring with him, to have me either shot or incarcerated for life, by blocking the GMC from intervening, then he would being seeing a lot of me in his courts as each new charge is fabricated.

It all stinks, doesn’t it? But what is new under the sun where UK law courts are concerned?

This now disclosed draft restraining order has been deliberately withheld from me, not just for my countless failed bail applications but my 1st March 12 Cardiff Crown Court of Appeal against imprisonment, the 4^th May 12 jury trial, for being in breach of it with a further vindictive stretch of imprisonment when I was never served with a restraining order in the first place1

Even my 2013 Criminal Court of Appeal applications, before Lord Leveson et al and my current Judicial Review application, again blocked by the HM Cardiff Cabal, for this very court hearing to be adjourned, is a scandal in itself.

Both HM Court Service and HM Crown Prosecution Service had previously deniedall knowledge’ of such a hand written document which now only leaves the one, unless this was this one that my human rights workers saw being brought back from the cells, on 1^st December 2011, following my refusal to read it yet alone approve of it?

Yesterday's conspiracy, with an empty public gallery, unfolded further by the ‘finding’ of another draft version actually stapled to it!!!!!

This version, with no hand writing on it, other than my own made in the 4^th May 12 Cardiff Crown Court dock, was the ‘draft’ the very minute Evans had produced it from ‘out of a hat’. It followed the judge’s order, the day before, to ‘go find it’. [This followed Evans’ admission that he may need to be Mr Kirk’s defence witness as the ‘hand written draft’ was still up in his Merthyr Tydfil CPS office.

Despite admitting the day before, before both the trial judge Curran QC, my friends in the public gallery and Mackenzie Friend in the dock, he had a typed a version, he had handed this same one, now in the 2013 Cardiff magistrates court, to District Judge John Charles, on 1^st Dec 11 to promptly scrawl all over it with his fountain pen, to ‘beef it up’, before ordering it be taken down to the cells for my so called ‘approval’.

The apparent criminal conduct of barrister Ms Anthony, from Middle Temple, London, was possibly worse, shipped in to give the impression of ‘no bias’ or real risk of bias, when I was refused the right to have the case heard outside South Wales.

Ms Anthony repeatedly mislead the court by telling the also ‘shipped in’ district judge, ‘there was nothing on file’, at Cardiff CPS HQ and that there was no letter or telephone CPS record from either my Bristol based solicitors or Cardiff based barrister for basic or section 8 disclosure.......

.....the bl**dy lying little b*tch or was she simply lied to by Cardiff CPS? Either way, she had a duty to the court first.

This very abuse is rife now in Cardiff courts and no doubt, elsewhere and is the major reason why the once revered UK adversarial system, a solicitor implanted between client and court advocate, is so strongly fought to be maintained?

For after over forty years of experience in London's Royal Courts of Justice, Taunton, Hampshire, Guernsey and Jersey, time and time again, I have witnessed barristers lying, through their back teeth, on oath or appearing to lie, as the little game is to keep the judge sweet and not compromised while their bank balances continue to swell.

[Despite my personal experience I still strongly support the basic principle of a solicitor needing to put up with the, oh so often, awkward client and all his irrelevancies leaving the barrister to remain uncluttered with the job in hand and not with the baggage some clients bring along to the table!].

[ I fear still further break down of our judicial system, shortly, as more and more litigants in person (LiPs) are forced to conduct their own cases so often bringing mayhem to an already mysterious system based on discretion and not, apparently, the rule of law.]

1. the instructing solicitor gathers the evidence and prepares the case for the Crown

2. the solicitor, in this case HM Crown Prosecution Service, Cardiff, hands the file to the barrister often on his or her arrival, usually by train, at court

3. this is where it all gets rather murky. A need to know basis is the art behind good advocacy .

4. In yesterday's trial for example, just as in my recent three month civil action against the police, when ever the prosecuting barrister (or defence barrister) is asked something he or she already knows the truth over some fact or other but body language, hand signals and facial expressions etc. come into play. such communication of information, not recorded on tape or clerk of court written record, between the thee players, the judge, the barrister and team of instructing solicitors sitting quietly behind can so often go unnoticed by the unsuspecting client in the dock!

5. Yesterday was a classic, for example, over reasons why the case should obviously been adjourned. Time and time again it was obvious her replies were because she had been either withheld information, as to my numerous attempts to have relevant documents to be disclosed or she already knew.

BUT did she know that or was she told 'don't ask'?

6. This Swansea visiting barrister may have left the court with unblemished character but both Mackenzie Friend and myself may well think otherwise.

Having suffered more than twenty years of this kind of inherent deceit in Cardiff law courts I promptly summoned my barrister who, by sheer coincidence, was just outside the door 0f Number 2 magistrates court and to come in and told both judge and bent barristers, the truth. [Evans stated he had never seen the prosecution's CCTV footage]

Not only had my barrister written to the Cardiff CPS, for obviously needed disclosure, on my behalf but his letter to me was up on my website, with his permission, he having also made numerous telephone calls to both CPS HQ and CPS lawyer, Tony Dicken, re my one million pound damages claim against the NHS (Wales) forensic psychiatrist.

With both Barbara Wilding, the then Chief Constable and the rogue doctor, in clandestine Caswell Clinic multiple meetings, having me registered MAPPA level 3 and jailed for trading in illicit machine guns, just what will the cabal dream up next, I wonder?

My barrister went on to say, to an unusually listening judge for Cardiff, that the civil action was seriously entwined with these criminal proceedings and needing the basic ‘disclosure’ for both of the South Wales Police conspiracy, hatched as far back as May 1993, as the on going three month trial has just proved, to block my seven damages claims, against them, due my being bullied with malicious prosecutions, false imprisonments and refusal to investigate crime on my behalf.

This caused adjournment and lengthy telephone calls by the London barrister to those in Cardiff’s CPS who, of course, should have been in court from the start with all the answers and so face the ‘music’.

Just another example as to why my tape recording of the court proceedings was not allowed, needed as we no longer have a ‘free press’ and because our British legal fraternity are still privileged to be allowed such a perverse adversarial system, too often before our very eyes, riddled with criminal conspiracies, such as what yesterday’s hearing exposed and remaining unpunished.

The visiting judge ordered the production of the unsealed 'brown envelope', as well, with secret orders to the 1st Dec 11 district judge from His honour judge Llewellyn Jones QC, inadvertently slipped out of the Cardiff cabal's hoard of embarrassing docs, amongst HM Court Service clerk of the court records, asked for and denied to my May 12 jury.

The Cardiff Crown Court, shortly, will willingly, no doubt, have it produced to crush my many recent convictions, in the name of so called 'justice' now the author has retired.

Clearly, yet another set of criminal proceedings must be instigated somehow while this current matter is on a deliberately delayed Cardiff Crown Court appeal, like last time, in order to force the Cardiff cabal to give disclosure of simple public documents.

It appears, as I pleaded to the visiting judge to intervene, to be the only way to have my erroneous Caswell Clinic Prison, Bridgend, medical records totally expunged and for the culprits to be sent to prison.

Early on in yesterday's proceedings I recommended to the court some sort of restraint order aught to be handed down, which I would eagerly agree to, in that I had no wish to approach or arrest this crook, again, as I was filing private prosecution papers, anyway, as my complaint to the Bar Council, sent out from the prison had achieved the expected.

If and when I receive any restraining order it will join my appeal already lodged at Cardiff Crown Court asking, again, for an outside police force, to investigate the widespread unchecked corruption throughout so many performing in South Wales law courts.

Just been tipped off the cabal are up to having me sectioned 42 as a 'vexatious litigant' again, with the aid of the bottomless pockets of the British tax payer.

In Cardiff County Court this Month

Lantwit Major's police sergeant 'Killer' Kilberg, one of many in the 1990s police force, who had my name removed from the veterinary register is caught out lying to the currently presiding judgere along with a few others already heard and shortly to also give evidence.

Enclosed is a 90s Barry police station custody video of Kilberg lying to the custody sergeant that I was in breach of a public order offence despite the custody sergeant specifically asking for that clarification.

His Honour Judge Seys Llewellin QC or the police QC, during the three months civil action currently in session in the Cardiff Civil Justice Centre, asked for clarification on exactly the same point with the South Wales Police sergeant qualifying the issue by stating the custody sergeant made the mistake when writing down the facts.

The truth of the matter was his partner, PC Gareth Holmes was right there, seen on video and refusing to support the deliberate lie either by recording it in his pocket note book or in his subsequent MG 11 witness statement.

Oppressive, arbitrary or unconstitutional actions by the servants of government.
Where the defendant's conduct was 'calculated' to make a profit for himself.
