Maurice Jailed Three Times in a Week Fourth Break in & Accused of Fraud

On 20th July 2013 I am just released after another night in police cells because of liar, MARK DAVENPORT, ringing police to block my getting into the flat for my legal papers required for the final day of my twenty year running damages claim against the South Wales Police.

After an hour in Cardiff Magistrates, before proper Cardiff magistrates for a change and not the usual District Judges, John Charles or Bodfan Jenkins, fundamental issues with the help of the Clerk of the Court were sorted out.

But DAVENPORT had switched off the electric and had changed the locks whilst employing staff who were drawing the dole to help him allow fly tipping on my land.

After I had heard the usual evasion of the truth and shouts of almost, "liar, liar, your pants are on fire", Her Majesty's Representative, as prosecutor believed be also from 9 Park Place Chambers, Cardiff, eventually was made to release, albeit far too late, my custody record including the video made under caution that will knock this new bit of trumped up nonsense right on the head.

Yes, Mr Kirk must be allowed to live at the flat, the court heard and what of the squatter in the shop below, was my reply?

At the end of proceedings I felt it only appropriate to recommend that the Madam Clerk of the Court to be o0ffered a position as an inquisitional judge, as under the laws of Code Napoleon in a court somewhere in Brittany.

Whilst the Cardiff Cabal continues to protect the rogue police doctor and the courts appearing protect the other ring leaders behind my twenty years of purgatory whilst resisting both extreme and unusual irregularities from those in positions of privilege the Cardiff courts will continue to have my most undivided attention.

Her Majesty's representative again misled the court concerning the outstanding matter of the rogue police psychiatrist.

The Caswell Clinic psychiatrist and his Cardiff Cabal are still maintaining, three years on from the MAPPA level 3 'machine gun' acquittal, that their victim is still 'medically unfit to plead or stand trial' when it so suits but not when circumstances are not helpful for them (see The Times On Line' comment below).

Meanwhile I remain diagnosed with 'irreversible significant brain damage' and possibly cancer that caused the current Defendant, in these current civil proceedings, on 2nd December 2009 Cardiff Crown Court, to recommend, via barrister Richard Thomlow of 9 Park Place Chambers , Cardiff, to recommend that I be incarcerated in High Security Psychiatric Hospital most likely for life.

NHS (Wales), at Caswell Clinic, are reliant on not just a brain scan interpreted by someone without the appropriate qualifications after using the wrong techniques but on its supporting documentation for the Cardiff court stating I have significant brain damage because:

1. I had been an old drinking partner of actor, Oliver Reed Esq

2. I had ditched my WW2 aircraft in the Caribbean and

3. had flown all the way to Australia without a map

This continuing bullying by the police and causing false imprisonments, just as with their refusing to release of my own 5 page victim statement following complaint, last year, by this same Caswell Clinic psychiatrist having had me locked up in prison for weeks following his latest fanciful delusions that I had been around to his home and harassed both he and a DR JANIS HILLIER I have never even met.

The release of these 13th July 13 custody records together with the video record of my 'Defence Statement', in rebuttal to an allegation of two common assaults on DAVENPORT and another, are needed as exhibits inTuesday's County Court hearing before His Honour Judge Seys Llewellyn QC on the final day of the first three of seven damages claims listed soon for a hearing.

On that 13th July 13 I was arrested by a PC Charles......"Any relation?", I asked the court.

And by 7.30pm on 19th July I am again arrested and with hand cuffs behind my back hauled into a police car with not even the right to have a road side breath test. Hang on here, I said, it was I that asked for police officers to attend this time!

I was also arrested just a few weeks ago whilst quietly parked on private property, on the pretext of 'drink drive' but with no moving traffic offence as their excuse.

In both these 'drink drive' incidents there was significant delay for over one hour before having to provide a specimen of breath!

The 2nd delay was one hour and thirty five minutes and was deliberate for senior officers, no doubt, to be contacted to set up another conspiracy to pervert the course of justice. Remember, please, the numerous police incidents in the three current claims for damages contain three road side incidents recording positive specimen of breath taken but all zero within one hour of my arrests.

I am now told MARK DAVENPORT had reported me to police for fraudulently drawing up a falsely represented lease causing the severe banging on my door to occur recently and my camera to recording from my window, a 'paddy wagon' sitting patiently outside following my subsequent arrest.

Despite my repeated visits to Ely, Fairwater and Barry police stations, in an attempt to establish just what is going on and to file a statement of complaint, I am ignored.

I, Michael Murphy of The Old Police Station, Barry, confirm that the content of this, my statement, is true to the best of my belief.

Back in the mid 90s Mr Kirk had flown over my scrap yard, situated next to Barry harbour to identify his car lying there and then reported me to the police for theft.

A neighbour had previously arranged to have Mr Kirk’s car towed off private land to the rear of his veterinary hospital in Tynewydd Road, Barry and onto the adjacent public road.

Mr Button had then telephoned me to say that I was to remove the vehicle from the public highway but was to keep it for a minimum of fourteen days.

If by then it had not been recovered by the rightful owner then I was allowed to dispose of it as I pleased.

HARASSMENT?

In a minute I visit my sixth GP practice in another desperate attempt to have someone in the NHS (Wales) to finally correct my Caswell Clinic 2009 psychiatric Records fabricated then purely to have me registered MAPPA level 3 if the 'machine gun' allegation failed.

South Wales Police had and still have a 'hold' over him and his wife and yet no one else in the NHS system, appropriately qualified will be a seen correcting my medical records that are currently stopping me now from setting off to South Africa and the Falkland Islands in my WW2 D-Day Piper Cub, registration G-KURK.

This CPS barrister had every opportunity to rectify the anomaly, not once , not twice but at least seven times in a series of 'harassment' and then 'reach of restraining orders' vindictive prosecutions, anything to block the starting my 20 year running three month damages claim and allow proof exposed of a thoroughly deceitful doctor SUPPORTED BY THE SYSTEM

I have now had a number of articles, including my post, stolen from my Cardiff flat. I keep the flat locked at all times when I am not there and there is a very short list of those with duplicate keys.

Criminal Damage

Would this relate to your officers failing to recover stolen articles from my car, the week before last or allow me to identify the culprit who broke into my car, outside the flat, by my viewing the CCTV?

Fraud

Does this relate to anything over a short conversation I had, only this week with a neighbour, over my having been reported for fraud, apparently and also deception but possibly explaining why police had to attend my flat premises for over an hour and requiring a paddy wagon?

Could this also relate to the ongoing civil damages claims, in Cardiff County Court, against yourself or the pending one million pound damages claims, malicious prosecutions, some being relisted later this week? No more 'HM' court time has been 'allocated' or the trial judge just wishes not to hear any more evidence, apparently,for the completion of this Claimant's twenty year running damages claims leaving only the 'closing speeches' on 23rd July 13 to finish the case, subject to any appeal.

It is arguable that these and other cases, in the long stayed queue, have been delayed by those who really decide as to just what goes on in our UK law courts. The Claimant's consequential loss, following his countless imprisonments and being sectioned under the 1983 Mental Health Act so many times, of carefully stored evidence has been phenomenal.

On the promise of a jury, as far back as1993, the Claimant instructed Bristol lawyers to bring a series of damages claims against the South Wales Police in an attempt to simply to stop the harassment and finally 'get them off his back' when all he wished to do was to go about his chosen vocation, uninterrupted, as a veterinary surgeon in the Vale of Glamorgan.

From June 1993, in Cardiff and between December 1992 to October 1993, in Barry, following a series of arson, motoring and tenancy dispute incidents, requiring the Claimant to seek assistance from his local constabulary, chance communications with the wrong Guernsey police officers led to, some would say, an act of vengeance and damned what it cost.

Some within the Barry and Cardiff police then set about a 'course of conduct' argued by the Claimant as both unusual and extreme acts of bullying heavily reliant on their 'HM' Partnership's cosy relationship from within their own courts hoping their chosen victim would not make the distance.

Twenty years on and the Claimant now finds himself faced with recent court rulings appearing to both shorten proceedings and indicate the need, perhaps, for the maintaining or otherwise of the age old 'hot potato', the level of a 'judge's discretion' in this, such an unusual case.

Could the rulings relate to this 5th August 2003 HM Treasury Solicitor letter, I wonder, smuggled, most likely, out of the Cardiff Civil Justice Centre in the dead of night starting the 'Section 42 'Vexatious Litigant registration procedure to ban my right in ever getting access to a UK court under the rule of UK law?

A little word of advice

Any one thinking of bringing civil actions against any Welsh authority by deliberately starting it in England, as I was advised by Bristol lawyers, to get a fair trial or 20 years later, then lodge an appeal in London, as I deliberately travelled to do, to avoid the stench of the Cardiff Cabal, please note the seal on the Order handed down by the very same judge that blocked all the politically sensitive incidents , last year, in my 20 years of hell.

More Extortionate Court Costs

The high court judge taxed the police £6,23&.50p by deducting it by £237.50p!

A good example of the usual 'HM gravy train' tactics, in UK courts, anything to deter those who cannot find legal representation they can trust.....rather a 'catch 22 situation, isn't it?

The QC, trailing barrister and crew were not needed to speak, of course but could only claim if they all attended.

The telephone conferences, to guaranteeing of blocking key police officers and a meeting in chambers, ex parte no doubt, could have all been done for the barrister to be back on the train even before the case was listed to start.

The point is that neither the police Caswell Clinic psychiatrist nor psychologist Professor Wood are medically qualified to interpret a CT brain scan as that is the role of the neuro-radiologist who has training and qualifications so to do.

All the neuro radiologists that examined the scans contradict the psychiatrist’s findings but still he went ahead and applied that I be sectioned IPP to Ashworth, ‘imprisonment for public protection’ with the full support of MAPPA

On 2^nd December 2009 in Cardiff Crown Court the prosecution, police psychiatrist and court of were all in receipt of my privately funded specialist report faxed the day before. Only achievedm incidentally, by the quick thinking Walter Sweeney, ex MP for the Vale of Glamorgan and his lovely wife, Nuala, a leading consultant radioligist in South East Yorkshire.

No one would allow it to be referred to as seen on the transcript overlooked to be destroyed at the time.

However, there is the built in provision in the Act that you cannot be prosecuted 'for a course of conduct' when attempting 'to prevent or detect (further ) crime'.....the very purpose of distributed WANTED posters. A further procaution was taken to get no less than severn police officers to examine the posters for adverse comment whilst they were being distributed. Of course I was refused any of them as witnesses

The CPS, on 1st December, produced various drafts of a 'Restraining Order' producing the following but still not disclosing the one now needed, of course, for the Criminal Court of Appeal, very shortly, the part hand written draft brought waved under my nose, in my cell, by that GEOamey guard, the lying little Lee Barker who's statement completely contradicted that of the only other tamed witness in a corridoe of six eager on lookers!

THE 1997 HARASSMENT ACT is a typically knee jerk written piece of legislation, of the Blair era, now being abused just to lock up those exposing the crimes going on daily in our welsh law courts.

Anticipating the continuing conduct of the Welsh courts, to protect their very own NHS's conduct in a similar manner to the way they had so far protected their police force, irrespective of the facts, I quietly lobbed into their cess pit of deceipt, rather like a Mills bomb into the mill pool for trout, a petty debt £840 claim for bus fares and time wasted, travelling backwards and forwards countless times to Caswell Clinic, when originally promised my medical records used on 2nd December 09 to have me sent to Ashworth. That claim, as predicted, to prevent the doctor having the risk of committing perjury, was settled out of court to the cost to the tax payer well in excess of £20,000.

There then followed the substantive claims before the final one due on 30th January 2013 at the hearingr to consolidate with the eight or so police claims:

At my 20^th December 2012 magistrate’s application, to be able to see my South Wales doctor, this 13^th December Morgan Cole document was, without me knowing, already with both District Judge Bodfan Jenkins and CPS Mr Dicken, the latter summoned to represent Her Majesty.

All four parties, the NHS, the protected rogue doctor, scheming judge and bewildered CPS ALL blocked the progress of the case by pre arranging yet another adjournment, a game they have played now for over a year…...anything to cover up the truth.

Like wise, Bodfan Jenkins, an old hand at perverting the course of justice, held back the clerk of the court’s notes of the May 12 ‘shooting walking stick’ hearing following my repeated attempts to have my totally legal property returned by the police following their 2009 ‘machine gun’ house raid fiasco.

The case was adjourned, far too embarrassing for a public arena. My medical care will have wait until their conclusion at 22^nd January hearing!!!…….. come, witness and inhale their stench

The ‘walking stick shot gun case lingers on a ‘case stated’ application forcing the same judge to release the court’s notes indicating it had statements from both police and my then wife , none of which I knew about during the 2010 ‘machine gun’ jury trial, indicating a conspiracy to pervert the course of justice

So what? The South Wales Police are past masters at distorting the truth.

Letter to GMC:

I emphasize that in writing my psychiatric reports Dr ******** was unduly influenced by the South Wales Police to report that I was suffering mental health problems resulting from ‘significant’ brain damage and that in coming to such a conclusion Dr ******** deliberately ignored reports from properly qualified radiologists stating that my brain scan was normal for a man of my age.

Instead the doctor sought out the advice of a clinical psychologist researcher who was not qualified to interpret such scans (and who was not made aware of the radiologists reports) and then moved beyond even this advice to tell numerous courts on the basis of no evidence whatsoever that I had suspected brain cancer.

The three month trial, for first three of eight or nine Actions against the South Wales Police, starts on 18th February all based on police being allowed to refuse to disclose their records and identity of all witnesses at each of the forty odd incidents of police bullying.

I started this retaliation 20 years ago in Bristolbut then transferred to Wales where the first thing the little bast**ds did was to refuse me a jury.

There is an outstanding civil damages claim surrounding police operation, ‘Operation Chalice’ and a ‘machine gun’ I once owned attached to my aircraft. The armed police raid, backed by helicopter, on the marital home on 22^nd June 2009, marked the date of our marital separation. Witnesses present are reluctant to disclose any information always needed. That includes witness identification, copy of all statements taken and substance of all conversations and how and when the house search was carried out etc My daughter was again at risk, under police code name ‘Operation Orchid’, to ‘snatch her by Social Services. It is MAPPA and a rogue forensic psychiatrist that caused, if you wish to believe a word of it, added reasons given and accepted in court, as to why I was not to be released for nearly eight months and in return sectioned under the 1983 Mental Health Act.

Cardiff Magistrates Court Proceedings Buried

The case relates to a purported ‘shooting walking stick shot gun’ obtained by the police, nearly a year later, from the marital home, during my January 2010 ‘machine gun’ trial at Cardiff but with no witness statements taken. None of this information came to my notice until three years later and only by my court applications to make the police disclose relevant evidence.

Further to my ongoing complaint please note the latest complaints, enclosed, of at least several more examples of criminal conduct being occasioned:

South Wales Police cross to England to influence a witness that has caused my name being removed from the veterinary register and receive a criminal conviction.

Enclosed website blog with one 27th Oct 12 statement agreed and signed by Christopher Paul ALEXANDER originally MR EBBS and witnessed by several people.

. 2nd Nov 2010 conviction of common assault fabricated to use to oppose bail over a two year period only for it to be then withdrawn police never ever having intended to fight my appeal as the two year use of successfully opposing my bail had served its purpose..

Enclosed as a summary from my current website blog simply to indicate the extreme length Cardiff judges are now actively supporting their own police force’s criminal conduct

False imprisonment re 2^nd allegation of Breach of a Restraining Order from approx 21st Sept 2012 imprisonment for nearly 3 months on evidence later withdrawn as the police knew full well my action to fax a pre action protocol draft witness summons to Caswell Clinic was lawful.

My request for the MAPPA fabricated withheld medical evidence, used by police, CPS and rogue doctor, to apply for my transfer to Ashworth Psychiatric prison on 2nd Dec 2009, requires immediate disclosure in order I may apply to be put back on the veterinary register and for me to be eligible to update my professional flying licences.

Please do not allow this new evidence slow down you outstanding investigations of 'shoot to kill policy, 'machine gun' malicious prosecution and the falsification and maladministration of my being registered a MAPPA level 3 victim. Just when will you instruct an outside police force?

House of Lords May Meeting on the British Judiciary Brought Forward

Attention everyone, the meeting has been brought forward due to over subscription needing a larger committee room. Contact organisers or me for details.

1966 Veterinary Surgeons Act is admitted to be contrary to the European Convention of Human Rights. 1967 Royal Charter, imparting college immunity to prosecution, many also deem to be 'ultra vires' and should therefore go back before Their Lordships of HM Privy Council. Meanwhile, the college even refuses to 'convene a court', contrary to 2004 Statutory Instrument, to allow Maurice Kirk BVSc to 'practice veterinary surgery'. Finding any lawyer to do any of this, of course, is quite another story!

The European Court has warned Maurice it will refuse any further application relating to this Royal Charter or continuing conduct of the RCVS. This coincided with Her Majesty's Attorney General applying to have all his court files confiscated from the Western Circuit with the view of having him certified as a 'Vexatious Litigant'.

The RCVS obtained an Extended Civil Restraint Order to smother the truth. He is banned from the Cardiff County Court building, having served seven months in jail only to be aquitted, not even having tendered a defence.

Banned for Life as a Veterinary Surgeon

Another 2 year Extended Civil Restraint Order handed down preventing any further Applications to the RCVS, with the threat of a Contempt of Court Indictment if I do.

My Appeal to Court of Appeal will re-iterate the law stating the RCVS must convene a public court to hear my application to practice veterinary surgery.

‘Hairy Students'

Dear Mr Oliver,

Mr Justice Goodie QC and your client's ‘hairy students', as they so described themselves when approached by Patrick Cullinane Esq., all strategically positioned around Court 6 of the Royal Courts of Justice this week, know or should know the matters to which you now refer in your letters of 17^th Dec 2007 and yesterday, pretending to seek specific disclosure as they are currently in your possession [Action 3. 8.26].

You know police sergeant Rowe was seen wielding a sledge hammer while other police with crow bars broke into my veterinary surgery in Ely, Cardiff, during June 1995. Eight surgery break-ins I suffered and your Sgt Runnalls in Cardiff Crown Court denied every one of them telling the jury each incident, at the Llantwit surgery, had been ‘criminal damage' not a ‘burglary', [God forbid, it could put off the tourists].

And why was Sgt Rowe smashing his way into my building without first contacting me with the key, Mr Oliver? They told you in order to put back into my overhead flat a drug dealer, then shacked up with an Alison Jenner, a daughter of a police Inspector he being a long time client of mine. Read the police statements again that Goodie J predictably declined and ask yourself just why Wilding had to bury the incidents and Goodie had to quash any chance of an adjournment blocking any further legal process for discovery of documents by handing me down a two year ban using an Extended Civil Restraint Order. The police about the court in plain clothes may consider wearing white coats next time as I may feel more at home.

All this evidence and more has already been given to you relating to this incident highlighted in my 4^th October 08 letter, yet another to Barbara Wilding, Chief of South Wales Police, listing well over 40 police incidents caused by the police surveillance team specifically assigned by her predecessor to follow me.

These 40 odd incidents were relevant to Mr Justice Goodie QC as well, relating to the gaggle of lawyers representing the Royal College, but I could not disclose them to him without your client first being forced to admit that they existed and I was swindled. As for HM Attorney General, currently five years into attempting to have me certified, he did not even bother to send representation. She was needed to answer to the content of the leaked HM internal memos between HM Treasury Solicitor and Cardiff court staff and other seemingly undesirable trysts featuring in this seventeen year running litigation. An ECRO is a poor second to being certified as a Vexatious Litigant, but will at least block my lawful right to have Section 31 disclosure of conspiracy between the RCVS and the South Wales Police.

The 10 years of unrelenting police harassment I have suffered until, of course, they had me struck off the veterinary register, is compounded by your client's continuing refusal to disclose, contrary to the Fraud Act, causing my 7^th Application now, to rejoin my family's profession, to have been refused awarding £7,000 costs for the purported expense for a brief hearing and the photocopying of the same court documents from my previous application before Mr Justice Lloyd Jones in June 2008. That case is still smoldering somewhere in the Court of Appeal, smoldering because statute law states the college must convene a public hearing for my application to work and refuse for fear of previously withheld evidence, as with you, coming to the notice of the veterinary profession and tax payer.

I have again been refused a public hearing, contrary to 1966 Veterinary Surgeons Act, 2004 rules on procedure and 1415 Magna Carta, the decision having been taken by some girl, I'm told, sitting alone in some gloomy back room of the college's head quarters in Horseferry Road, London.

Despite my 2008 Abuse of Process Application, granted by Mr Nicholas Chambers QC, leading to Ms Wildings falsely sworn 25th February 2009 affidavit, denying court cases and police incidents ever occurred, you have the apparent audacity to delay, yet again, when you know, full well, I was arrested and charged, your client continuing to pretend these 40 odd police occurrence numbers are purely a figment of my imagination? I need a substantive reply to my 4^th Oct 2008 request in order to assist your enquiry. Blackmailing me with the same threats as before is to be expected bearing in mind the law is only as good as the integrity of those entrusted to administer it.

Are you therefore seeking a further 2 weeks to exchange witness statements?

Both Mr Justice Goodie QC and your client's myriad of lawyers present witnessed as to just why I raised these matters before the High Court my doing it to obtain yet another pretence letter from you stating your client still has no knowledge of the 40 police incidents listed in my 4^th October 2008 application for disclosure, being some from a hundred or more similarly drafted letters my secretary will confirm she typed over many years whilst in my employ.

Your ‘systemic risk' taking to the whole legal industry may come to fruition, as it has done with Penningtons for the RCVS, ridiculing the good name of the veterinary profession.

I need our trial judge, His Honour Judge Seys Llewellyn QC to read Monday's transcript but far more importantly, the UK tax payer to hear it and to consider your proposed conduct before embarking on your lucrative 6 month Trial without a Jury needing well over 200 hundred witnesses not all yet disclosed.

One of my various secretaries, over the years, only yesterday reminded me that she would arrive at my surgery each morning only to ask, "What new police incidents do we have today to record?" We would then set about gathering evidence for the latest criminal court pantomime or current JR nonsense between a castration and retained afterbirth, no doubt. Retention of police records by the police was my secretary's paramount policy, writing, telephoning all and sundry. Incident numbers, custody records and where necessary, attending court herself when I have been locked up over night.

One such case, your client still refuses to fully disclose, was Action 3 paragraph 2.1 where she witnessed, from the public gallery, my asking, hemmed in by prison officers, just why was I in prison?

Both Jackie Seals, prosecuting and the clerk of the court refused to disclose any information on the matter, saying later there were no documents as to why, but instructed the Magistrates, also none the wiser, I assume, to order my immediate release with no apology or bail conditions.

Jackie Seals again refused even to tell His Honour Judge Gaskell, in one of my earlier Abuse of Process Applications, as to why I had been arrested, jailed and kicked out the door by your client.

She went further, having been silent in Magistrates, saying, before the Crown Court, she refused to answer my questions as my witness, "for fear of incriminating myself". Counsel for your client, the South Wales Police was made to admit to Judge Gaskell I had been arrested for refusing to leave the Vale of Glamorgan Agricultural Show where I had been Honorary Veterinary Surgeon for most of the day. The arrest, he admitted, was for Breach of the Peace and nothing else.

The RCVS struck me off for it, for life, it appears, now Mr Justice Goodie QC has refused to grant a Judicial Review, while the college's thoroughly deceitful lawyers keep the cash, originally awarded £66.000 costs by HM Privy Council, £12,000 by Mr Justice McComb and your client's HM Crown Prosecution Service, also immune to any ‘accountability', awarded £11,000 by Mr Justice Griffiths Williams who was performing, incidentally, in the court next door to Patrick and myself, on Monday.

It stinks, Mr Oliver, doesn't it?

I was therefore at Barry magistrates yesterday putting the finishing touches on my private criminal prosecution of both you and Ms Wilding, my intention being to produce tape recordings, gathered over the years depicting, in particular, the demeanor of presiding judges when I have dared to suggest that lawyers and police in UK courtrooms have a signed and sealed arrangement to act with impunity should any past indiscretion come to the surface of their gutter during any subsequent court proceedings. It was drawn up by The Law Society and called The Memorandum of Understanding to support the already existing HM Partnership.

There I had a chance meeting of the original lawyer in Cardiff Magistrates, Action 3 Para 5.1, my having been ordered by the police to produce motoring insurance for the 35^th time. I refused winning the case including the 7^th time police had stopped me as a banned driver only to be proved they knew I was not.

My secretary yesterday, when told of our meeting, remembered my showing the court my driving licence, pressed up against the prison glass for all in court to see, my being imprisoned overnight for "having no driving licence"!

I have a set of hand cuffs and I will be around to your offices later this week.
