Maurice Jailed Three Times in a Week Fourth Break in & Accused of Fraud

On 20th July 2013 I am just released after another night in police cells because of liar, MARK DAVENPORT, ringing police to block my getting into the flat for my legal papers required for the final day of my twenty year running damages claim against the South Wales Police.

After an hour in Cardiff Magistrates, before proper Cardiff magistrates for a change and not the usual District Judges, John Charles or Bodfan Jenkins, fundamental issues with the help of the Clerk of the Court were sorted out.

But DAVENPORT had switched off the electric and had changed the locks whilst employing staff who were drawing the dole to help him allow fly tipping on my land.

After I had heard the usual evasion of the truth and shouts of almost, "liar, liar, your pants are on fire", Her Majesty's Representative, as prosecutor believed be also from 9 Park Place Chambers, Cardiff, eventually was made to release, albeit far too late, my custody record including the video made under caution that will knock this new bit of trumped up nonsense right on the head.

Yes, Mr Kirk must be allowed to live at the flat, the court heard and what of the squatter in the shop below, was my reply?

At the end of proceedings I felt it only appropriate to recommend that the Madam Clerk of the Court to be o0ffered a position as an inquisitional judge, as under the laws of Code Napoleon in a court somewhere in Brittany.

Whilst the Cardiff Cabal continues to protect the rogue police doctor and the courts appearing protect the other ring leaders behind my twenty years of purgatory whilst resisting both extreme and unusual irregularities from those in positions of privilege the Cardiff courts will continue to have my most undivided attention.

Her Majesty's representative again misled the court concerning the outstanding matter of the rogue police psychiatrist.

The Caswell Clinic psychiatrist and his Cardiff Cabal are still maintaining, three years on from the MAPPA level 3 'machine gun' acquittal, that their victim is still 'medically unfit to plead or stand trial' when it so suits but not when circumstances are not helpful for them (see The Times On Line' comment below).

Meanwhile I remain diagnosed with 'irreversible significant brain damage' and possibly cancer that caused the current Defendant, in these current civil proceedings, on 2nd December 2009 Cardiff Crown Court, to recommend, via barrister Richard Thomlow of 9 Park Place Chambers , Cardiff, to recommend that I be incarcerated in High Security Psychiatric Hospital most likely for life.

NHS (Wales), at Caswell Clinic, are reliant on not just a brain scan interpreted by someone without the appropriate qualifications after using the wrong techniques but on its supporting documentation for the Cardiff court stating I have significant brain damage because:

1. I had been an old drinking partner of actor, Oliver Reed Esq

2. I had ditched my WW2 aircraft in the Caribbean and

3. had flown all the way to Australia without a map

This continuing bullying by the police and causing false imprisonments, just as with their refusing to release of my own 5 page victim statement following complaint, last year, by this same Caswell Clinic psychiatrist having had me locked up in prison for weeks following his latest fanciful delusions that I had been around to his home and harassed both he and a DR JANIS HILLIER I have never even met.

The release of these 13th July 13 custody records together with the video record of my 'Defence Statement', in rebuttal to an allegation of two common assaults on DAVENPORT and another, are needed as exhibits inTuesday's County Court hearing before His Honour Judge Seys Llewellyn QC on the final day of the first three of seven damages claims listed soon for a hearing.

On that 13th July 13 I was arrested by a PC Charles......"Any relation?", I asked the court.

And by 7.30pm on 19th July I am again arrested and with hand cuffs behind my back hauled into a police car with not even the right to have a road side breath test. Hang on here, I said, it was I that asked for police officers to attend this time!

I was also arrested just a few weeks ago whilst quietly parked on private property, on the pretext of 'drink drive' but with no moving traffic offence as their excuse.

In both these 'drink drive' incidents there was significant delay for over one hour before having to provide a specimen of breath!

The 2nd delay was one hour and thirty five minutes and was deliberate for senior officers, no doubt, to be contacted to set up another conspiracy to pervert the course of justice. Remember, please, the numerous police incidents in the three current claims for damages contain three road side incidents recording positive specimen of breath taken but all zero within one hour of my arrests.

I am now told MARK DAVENPORT had reported me to police for fraudulently drawing up a falsely represented lease causing the severe banging on my door to occur recently and my camera to recording from my window, a 'paddy wagon' sitting patiently outside following my subsequent arrest.

Despite my repeated visits to Ely, Fairwater and Barry police stations, in an attempt to establish just what is going on and to file a statement of complaint, I am ignored.

I, Michael Murphy of The Old Police Station, Barry, confirm that the content of this, my statement, is true to the best of my belief.

Back in the mid 90s Mr Kirk had flown over my scrap yard, situated next to Barry harbour to identify his car lying there and then reported me to the police for theft.

A neighbour had previously arranged to have Mr Kirk’s car towed off private land to the rear of his veterinary hospital in Tynewydd Road, Barry and onto the adjacent public road.

Mr Button had then telephoned me to say that I was to remove the vehicle from the public highway but was to keep it for a minimum of fourteen days.

If by then it had not been recovered by the rightful owner then I was allowed to dispose of it as I pleased.

In Search of Appropriate Medical Attention

1. In 2009, whilst in custody at Caswell Clinic, Bridgend, South Wales, I was diagnosed with ‘significant brain damage’ and having a possible brain tumour. The forensic psychiatrist but without appropriate qualifications, recorded his findings in psychiatric reports and ever since the South Wales Police was used his reports to oppose my release from custody.

2. Originally I had been sectioned under the 1983 Mental Health Act and immediately incarcerated from Cardiff prison to Caswell prison purely from a fax, that morning, to the Cardiff Crown Court, the signatory of it having carried out a clinical examination.

3. I later found out that there had even been a mistake in allowing my presence to court, in a wheel chair, as it had been the police’s intention that I was not to be allowed either legal representation or warned as to what the legal proceedings were all about.

4. Again, in December 2009, his psychiatric reports were again used by this same doctor but he was in court this time while I remained locked up below without legal representation.

5. HM Crown Prosecution Service, on behalf of the South Wales Police, unsuccessfully applied, fortunately, that I be further incarcerated but now into Ashworth High Security Psychiatric Prison.

6. Ever since I have been repeatedly refused any chance of a medical examination, in South Wales, by no less than five GP practices, so far, whilst in the hope of clarifying and correcting Caswell Clinic records, being the responsibility of NHS (Wales).

7. In order to maintain validation of my pilot’s medical, in 2010, I had suffered further expense, because of Caswell Clinic’s records had been circulated by the south Wales police.

8. I was, therefore, made to face two hours of a gruelling ‘question and answer’ session with two senior psychiatrists at the Civil Aviation Authority Head Quarters, Gatwick.

9. In the end I was not entirely sure as to just who had conducted the most searching questions before the joint conclusion was reached by the doctors, at least, quickly requested to be backed by letter before any change of mind, that any query into whether or not my licence was to be revalidated, ‘was not a medical matter’.

10. In 2011, after my visit to Sussex, I was again arrested but this time by the Metropolitan Police with all charges later dropped. I had been again been sectioned under the 1983 Mental Health Act using purely the 2009 Caswell Clinic mental health records.

11. These same original records went on to be used again by the South Wales Police to successfully have me remanded in custody in the Autumn of 2011 and even deny me my right to represent myself in countless criminal court hearings that flowed while this Welsh same police doctor still maintained the validity of his apparent ‘findings’.

12. His own records of me were even relied upon, in court, when the police successfully opposed my bail whilst facing allegations from this very same doctor that I was causing him ‘criminal harassment’ when simply requesting his reconsideration of his clinical findings of me now that they were well over two years old.

13. It was by this same doctor’s recommendation, having failed to have me incarcerated in Ashworth high security psychiatric prison for life, as he said, a ‘risk’ to himself, District Judge John Charles appointed a ‘court lawyer’ to conduct my defence, ‘on medical grounds’ despite having no instructions given by me to anyone as the disputed facts in the matter!

14. Again these 2009 Caswell Clinic psychiatric reports were relied upon in Cardiff magistrates by the local police, in August 2012, following a signed police taken down statement by this same doctor and his wife, to successfully oppose bail.

15. I was not released from prison, with all charges dropped, until many weeks later following the CPS noticing, when preparing for another jury trial of ‘Breach of a Restraining Order’ the Caswell Clinic doctors’ 21^st July statements had recorded police had to be called to their home for Maurice Kirk to be ‘moved on’ when reliable police surveillance had confirmed that I did not even know where the two doctors lived nor did I have any desire to see the pair of them ever again!

16. Upon this release, this time from Bristol Prison, having had another case, this time a ‘common assault’ conviction quashed, originally obtained in Cardiff, during my absence.

17. The Cardiff authorities had used the usual ‘court appointed defence solicitor’ on the excuse of the same spurious Caswell medical grounds with no prosecution evidence even being challenged!

18. My ‘common assault’ appeal had been deliberately delayed for over two years in order for the police to successfully use its outstanding conviction to oppose my numerous bail applications while I awaited the 1^st Dec 11 District Judge John Charles 1998 Prevention of Harassment Act allegations against the said doctor, its predictable March 2012 appeal and May 2012 first ‘Breach of a Restraining Order’ jury trial.

19. The purported ‘restraining order’ was never served on me until I had been arrested for the breaching of it.

20. The Welsh authorities used and still use my convictions picked up on 28^th Nov and 1^st Dec 2011 hearings, both conducted in my absence, one having been in the same London court where I had, a few months earlier, luckily overturned my Tottenham police station sectioning to St Ann mental hospital. Both these convictions were obtained by Cardiff prison refusing my attendance in court with John Charles, also refusing me bail, having been made aware of the full circumstances.

21. Luck came my way again by the Welsh CPS having been unable to put off my appeal any longer and so stupidly transferred my ‘common assault’ appeal to England for fear of the publicity it would generate locally.

22. The Bristol CPS gave the depositions in the case just one look and immediately dropped all opposition to my appeal once realising the doctor’s original police induced medical evidence had been the cause of the recent Royal Courts of Justice hearing, before Lord Moses.

23. Following a June 10 ‘contempt of court conviction’ before His Honour Llewellyn Williams, following His Honour Judge Cooke QC having refused to act on the Caswell Clinic falsehoods, my conviction for ‘common assault’ arose from an ex South Wales Police officer having just pushed me down a flight of court steps and braking my leg. This happened during my futile attempts to have served on any Cardiff court my ‘grounds for appeal’ against my ‘contempt of court’ one month’s imprisonment required for the Criminal Court of Appeal.

24. I needed an independent medical examination, now, for various reasons. Montpelier Heath Centre, Bristol was where I used to be registered as a patient before and during some of the time after I first came to live in South Wales, in the early 90s. This surgery also refused me registration as a patient but without being aware of my Caswell Clinic history.

25. There reason was that as I had not lived in the area long enough to have obtained proof, for example, by producing to the receptionist, an old gas or electricity bill before my application then it would not be taken further.

26. The fact that I had remained registered with that Bristol practice for many years, back in the early 90s, even though I lived and worked in the Vale of Glamorgan , seemed to worry no one in those days.

27. Once I had been successfully released from prison, in Feb 2011, following my acquittal for ‘trading in machine guns’, the Cowbridge Health Centre, in the Vale of Glamorgan, barely let me through the front door before threatening to call the police when all I wanted was clarification. I and my family had been registered with the Cowbridge practice for many years and myself for at least a decade.

28. This same practice refused, after my request for help from Caswell and would neither intervene privately nor take the issue higher, following my results of the August 2009 brain scans, at the Princess of Wales hospital at gross variance to that of the Clinical Director of Caswell Clinic.

29. So I registered with the Ravenscroft Surgery, Tynewydd Road, Barry. This soon terminated following just two consultations in my pursuit for clarification of whether or not I had cancer. I was, indeed, shown the door but not having first taken a witness to the doctor’s consulting room to witness his refusal to order a follow up brain scan.

30. So up the road I go, this time to Court Road Surgery, Barry and register as a patient yet again. Sure enough, as soon as a medical is requested to ‘fly an aircraft’, for an NPPL and not my current PPL licence I am refused an examination.

31. I next try Ty Catrin Psychiatric Hospital, Ely, Cardiff, simply to ask to see Dr Gaynor Jones for an overdue consultation once I had established it may well be possible.

32. Dr Gaynor Jones had earlier promised me an appointment having been the lady at Caswell Clinic in 2009 and in HM Prison Cardiff, in 2010, to have signed for the brain scans to be done, in the first place, I assume to quash this apparent nonsense as to why I had been sectioned and singled out to be a permanent mental patient in the first place.

33. This resulted in the visit by the police to my flat on several occasions until on a Sunday morning I was warned of immediate prison if I did not stay away from Ty Catrin I now understand being part of the Caswell clinic’s private domain for some of their doctors.

34. So I register at the Ely Bridge Surgery, Cardiff, just down the road from where I currently live for the duration of current legal proceedings but I am refused a medical examination once it became established as to just who I was and just what my medical records contained.

35. I consider going ‘private’ while being unable to return to my doctor in France, in the current time frame and so I make local Cardiff enquiries.

36. Yesterday, at a Clare Road practice, Cardiff, as soon as I get out of court, I am told, “No, Dr Jones does not do private consultations” and in fact the practice does not cater for private consultations. “If you wish to make an appointment for an ordinary NHS consultation you will have to make it at least two weeks ahead”.

37. So much for that idea so try Spire or BUPA Cardiff hospitals. So what a waste of time that also was! “Ring back on Monday”, I was told.

38. This morning, before I had renewed my place back in the witness box for further cross examination I had indicated to the trial judge that I simply needed an adjournment for a medical examination but as soon, as possible. We were both aware of my concerns over unexplained memory loss and loss in hearing, abundantly evident during the last two months of evidence and of my ‘unusual’, if not ‘extreme’ ‘clinical history’ concocted whilst in police custody.

39. The learned judge had been a party to earlier court proceedings, this year and in the same building, following the failed NHS(Wales) application to have ‘struck out’ my then blocked one million pound damages claim levelled at whoever was ultimately responsible for my current medical situation.

40. No one was told, incidentally, that I had also been twice to ‘casualty and emergency’, during recent months, once in Bridgend and once in Cardiff. On each occasion I was refused an appropriate examination following my name being identified with previous addresses, including on the list both HM Prison Cardiff and Caswell Clinic psychiatric prison with the latter’s erroneous mental health records right before them.

41. Just what can I do next with no time left during such a 24/7 work commitment for trial?

I woke up at 4am, to day and realised the very real risk of a repeat performance, with Norman Scarth and myself videoed in the Royal Courts of Justice court, before Lord Justice Moses, over my appeal to my imprisonment after reminding the then Recorder of Cardiff, upon my acquittal over a WW1 Lewis machine gun, that his shallow promise that 'I will get the Caswell Clinic evidence', to support the police doctor's psychiatric report, that I am so dangerous, due to 'significant brain damage'!

I, therefore, cannot cross examine police officers and should be locked up, IPP for good, in Ashworth High Security Psychiatric prison, anything to protect Cardiff courts' nefarious conduct.

Three years on and I find still neither GMC nor IPCC will intervene while both indicating there will not even be 'an investigation' in to Barbara Wilding's having the 'machine gun' painted a different colour, Dr Tegwyn Williams' and Professor Rodger Wood'[s fabricated NHS (Wales) oh so damaging medical records, clearly proven criminal conduct.

‘Breach of Restraining Order’ Appeal at 14^th March 2013 Cardiff Crown Court

I continue to be in some difficulties in the matter of ‘disclosure’ of evidence, in order to clear my name, concerning the unlawful manner in which I was registered MAPPA level 3, later jailed on spurious ‘machine gun’ offences and then, when it became clear that lot was collapsing, to be then incarcerated in Caswell Clinic prison on a bogus psychiatric report by a Dr Tegwyn Williams who did not even afford me the courtesy of first examining his patient! 09 09 30 INTERIM PSYCHIATRIC REPORT Oct1 2009 REDACTED.pdf

1997 Prevention of Harassment Act clearly indicate a patient’s right to either ‘detect’ or ‘prevent crime’ and my attempts in stopping, once and for all, the twenty years of extreme and unusual bullying by very senior police officers, as my current three month civil trial is so clearly exposing, with their cowardly use of ‘bobbies on the beat’ to do their dirty work.

The Crown Prosecutor clearly stated in Cardiff Crown Court the need for him to give evidence, on oath, to confirm it was he, not the district judge, that arranged the draft ‘restraining order’ to be taken to me in the magistrates’ cells, for my consideration and approval. The fact that only one visit to me ever took place is painfully evident if one simply looks at the oral evidence and conflicting clerk of the court’s and GEOamey Custody Services manager’s section 9 MG 11 witness statements, custody records and CCTV.

I have again attempted to instruct a barrister for Tuesday’s hearing but the Welsh authorities continue to refuse me the right to listen to the court tape, of the period when I was forcefully dragged from the court dock, immediately after the trial judge, yet again, had refused me my right to have my legal papers, already confiscated and lying at the foot of the stairs and that included my defence exhibits for both me and my awaiting defence witnesses.

The Crown Prosecution Service continues to refuse me copies of my depositions, especially those prosecution papers containing Dr Williams further falsified ‘victim’ evidence, of last summer, stating I had ‘harassed’ him and his wife, Dr Janis Hillier, at his home, causing me still more months in jail, whilst un convicted, until all daft charges were reluctantly dropped.

I simply must have the ‘case summary’ prepared for Their Lordships by, e-mail and returned today, as it may be incorrect and order or not for me to hear the portion of Cardiff Crown court tape this week, with the release of depositions, by e-mail, from the CPS, if I or anyone else is going to be ready in time to prove the whole affair was an utter shambles.

For all that I have written these last months, the
situation can be summed up in 63 words.

‘The Law’ in Britain (The Police & the Courts), deliberately
deny me the protection of the law, & deliberately block
me from seeking a remedy in the courts for crimes &
other wrongs committed against me.

That being so, & it IS fact, then that same ‘Law’
CANNOT be used to punish me.

Indeed, both Police & Courts have themselves
committed serious crimes against me, & do so with
impunity.

The content of a series of 1st December 2011 Cardiff Magistrates tape recordings, [examples in previous blogs], mirror the omissions in the later 4^th May 12 transcripts, for ‘Breach of Restraining Order', deliberately doctored by HMCTS and Cardiff's Cabal to repeat the CPS David Gareth Evans lying to the court.

Lawyers and police, when in court, are both immune to prosecution by the ‘Memorandum of Understanding' between police chiefs, Law Society and Bar Council.

The Criminal Court of Appeal have been given statements from the 4^th May 12 jury trial public gallery, for ‘Breach of Restraining Order', that the CPS barrister told the court there was a ‘draft' restraining order , witnessed from the public gallery, being hand written on the 1^st Dec 11 by District Judge Charles and sent to show me to agree or not. NOT give to me as a final order.

Months later, in the jury trial, the witness BECAUSE it was that that was shown to me in the cells at lunch time and not public gallery then heard the prosecution barrister admit he may need to be a defence witness

The FINAL Order was never served on me..

The guard, Lee Barker, whose evidence it was that he came into my cell and left me with the FINAL court copy is nonsense. My cell was opened for release was 5.15pm any hours after Barker was on duty!

ALL CCTV in cells, court logs and custody logs have been withheld because 5 burly guards threw me out of the cell when I was demanding paperwork of the court case outcome, conducted in my absence

NORMAN SCARTH and I are campaigning to be allowed to take tapes of court proceedings.......supervised.

Why are we always refused? In order to cover up the wide spread corruption in our courts and complete disregard for human rights

......My appeal , shortly to be heard in the RCJ, is classic.

The transcript of Cardiff Crown Court proceedings omits the fact my witness names were asked by me in the cells.

Yet another case I did not attend in protest as, again, I was refused witnesses , my legal papers in court or cross examine the same complainant the Caswell Clinic's police psychiatrist who had fabricated seriously worrying medical records.

WHY? In order to have me sectioned to Ashworth High Security Psychiatric prison.

IF my tapes of the original 1^st Dec 11 District Judge John Charles Cardiff magistrates are allowed to be heard at my RCJ appeal, shortly, I will win and a number of prosecution witnesses and the prosecutor stand a very serious risk of themselves going to jail

To Mr Sashy Nathan, solicitor & Mr Amos Waldman, barrister.

Gentlemen,
I have today, Monday, received by post the Attorney General's bundle of 141 pages, 15 dividers & one CD.
He & his gang may have nothing better to do than produce all this garbage (& receive vast amounts of taxpayers' money for doing so) BUT, having seen some of it before, & noticed the many lies, I am CERTAINLY not going to waste my time reading it again!
To recap & sum up:
This is my Final 'FINAL STATEMENT'.
Accused of 'Contempt of Court', how on earth can I 'defend' myself, when I have made it abundantly clear that I have the utmost contempt for those who currently run our courts.
What I seek to show is that my contempt (& that of a growing number of people) is justified.
The Attorney General seems to think that my contempt will be lessened by his savagery in trying to put me (completely sane) in a Stalinist 'Mental Hospital' for what few years are left to me to live. Could anything be more sadistic? (I send again as an attachment the Andy McCardle document.)
I am rather disappointed to learn that Mr Waldman 'handed up' my Statement at the previous hearing, when I had specifically asked that it be read out, & I again ask that he reads out my Statement of Facts, with addendums etc.
This is important, bearing in mind that one of my arguments is that the Official Transcripts cannot be trusted. I am being more than fair in giving an opportunity for the courts to show that, on this occasion at least, they CAN be accurate.
I ask you please to hammer away at the totally irrelevant lies in the Skeleton Argument & Affidavits (put in purely to blacken my character), & the malice of the Attorney General Dominic Grieve, he being the man who had me thrown out of an Election Selection Committee Meeting in 2008, before he come to power.
As regards this hearing, I am in the fortunate position that I cannot lose. If the case goes against me, it will be more proof of the truth of my words. If (as I belief he will) the Lord Chief Justice rules against the Attorney General, then that will indeed lessen my contempt for his profession.
In which case I ask you to remind him of my request that he should use 'The Inherent Jurisdiction of the Court' to order an investigation into the 17 years of persecution, this action by the AG being only the latest. Also that he use that same 'Inherent Jurisdiction' to reduce the obstruction to my own attempts to use the law to seek a remedy for serious wrongs committed against me.
An example(a comparatively minor one) has just arrived by post today, Monday. On 17th September 2012 I made a 'Small Claim' against the Chief Constable of West Yorkshire. Twice, the documents were returned to me for some fictitious fault. Sent in again with the 'fault' rectified, I heard not a word until today, when the letter arrived. With it was a Notice of Issue, saying that the Claim had been sent to the Defendant on 15th January 2013.
SO, IT HAS TAKEN FOUR MONTHS TO HAVE A VERY SIMPLE 'SMALL CLAIM' ISSUED!.
Was this just incompetence, inefficiency or laziness? Or deliberate delay against the hated Litigant In Person? I am tempted to think the latter.
I ask you to hammer away at all that which is above at the hearing.

Is this a sample of things to come right across the Principality of Wales and then, UK?

The ‘Cardiff Cabal' of deceitful key players has finally been promised sole control, their own judiciary, of their very own ‘gravy train' funded by YOU.

Consider, please, the extreme lengths to which I, one of many, have again been subjected, just to obtain both court and custody contemporaneous record for an already bemused jury.

Then consider the reason for recent hunger strike, due to the appalling lack of medical services by HMP and NHS (Wales), as original medical records, originally falsified for MAPPA and a string of Cardiff judges to get me IPP, in 2009, have still not been corrected nor clarified. How many times has my lawyer written to the authorities now? Five times?

The need to stuff defence exhibits up orifices, just to get them into court and again be subjected to being beaten up in the Cardiff prison, by the very same bully boys, 395 Myers and 344 Graham, upon my return from court, is all part of their 20 year conspiracy.

Masonic devil worship? Of course it all is while those in ‘authority', able to stamp it out, are, of course, in the very same club.

All this is exactly as to what happened in the 2009 'machine gun', MAPPA and 20011‘harassment' court cases, all displaying extreme examples of criminal conduct by the very same faceless individuals from within the Welsh Authorities protected by HM. Extended terms of custody, each time, expecting their irritation will eventually go away, has been a particularly bad error on their part and something they are, shortly, to regret.

The prison, now, will not release my legal papers needed for my appeal and JR Application to the Royal Courts of Justice.

His Honour Judge Lambert, in Bristol Crown Court this, week, has ordered proper disclosure to show why the 2^nd Nov 2010 ‘common assault' conviction, at last on appeal, is listed outside Wales?

Why carrying a sentence of ‘no penalty' given 13 months after Cardiff conviction ?

Why in my absence I was convicted of failing to attend when John Charles gave the permission?

Can this English judge also influence a Welsh prison, I wonder?

I will write to Bristol Crown Court and apply for an Order to amend the never seen yet original 'Restraining Order' to allow me to communicate with witnesses from the public gallery for grounds for Royal Courts of Justice.

When I do get promise of court records HM prison Cardiff, Geo Amy Custody Services or some Cardiff judge simply reverse their previous decisions and block their release. This time all three blocked their release after the trial had started.

Judge Cullen QC repeatedly witheld what he knew, stifling evidence what the jury needed and even before the trial started, promised me both legal representation and production of the essential witness with his relevant NHS documents.The judge had no intention what so ever of ever upholding those previous court orders and ran Janet Kirk and other helpers a merry dance when they tried to get hard copy from the public counter.

Judge Cullen QC blocked my JR application, re the original Dec 11 magistrates fiasco under District Judge John Charles, until ‘after the trial is concluded'....he being the trial judge! Should he simply recused himself!

He knew that had the JR been successful, I was refused court documents,witnesses, access to lawyer, my own legal papers or right to cross examine in both courts. If current IPCC and NHS ‘investigations' from England had been allowed to be concluded,properly, there would not have been any trial in the first place. NHS officials or their legal representatives, crowded into each and every court room during these past seven months to monitor proceedings........so what are they frightenend of?

In Cardiff Crown Court, incidentally, I never ever did get to see any certified true copy of an original document relied on by the prosecution. What utter nonsense again, the 'machine gun' case all over again.

David Gareth Evans, barrister for the Crown Prosecution Service, meaning the representative of Her Majesty the Queen, was no better as he also was promised immunity to criminal prosecution as part of HM Partnership.

Now, he perverted the course of justice ‘big time' knowing he is cocooned in their cosy ‘Cardiff Law'. He was free to re draft as many versions of allegations, he liked, during the magistrates nonsense and in full view of the K Team, created the very exhibit that made him, of course, the vital witness to scrap the trial.

Instead, the one of many draughts, the one I only saw, was left in the CPS Merthyr Tydfil Office, under lock and key.

District Judge John Charles blocked my being able to cross examine anyone, at all, as far back as August 2010. He had taken a leaf from His Honour Judge Paul Thomas QC's book, during the scandalous 2010 ‘machine gun case', to prevent the uncovering of the south Wales Police's MAPPA conspiracy

Barrister Evans told the court he had contacted the Bar Council for help when realising I was obviously calling him as my main defence witness.

As the original fabricator of some fictitiously served up paperwork, down in the cells and by post, what was he doing now conducting the prosecution in the first place. The judge, mean time, sat very quiet knowing if I had objected a re trial would have me returned to prison for many more months whilst unconvicted.

On the 3rd day of this circus, Geo Amy either refused to inform the judge the CPS Evans was my defence witness, now to be called, as His Honour had already blocked all others or maybe, custody staff, Diane or Jackie did get my message to court from the cells, below?

This continuing NHS (Wales) withholding of my medical records, with evidence recorded of 'significant brain damage' and a possible tumour,whilst at the same time, refusing me clarification, correction or giving me treatment, is a stark warning to others that these recent criminal proceedings, in Cardiff, have now set a precedent across the UK.

Wll jail for arguing with a traffic warden be next?

Duty of Care, Abuse of Process, Failed Disclosure, Human Rights Act Infringements

The headline is a copy of the "details of claim" that Maurice submitted on 28^th November 2007, as what he calls "4^th action". The document spells out the reasons for "the Claimant's right to have a Trial by Jury for the three Actions 85614159 CF1A1741 & CF20414 (which cover numerous false imprisonments and malicious prosecutions).

At the time, the judge claimed that this action can only go forward once the other three are completed. Well, it seems that judges keep cutting the beast into slices, because they are afraid of a collateral attack, but the current action asks for the beast as a whole with these claims:

“For countless false imprisonments, malicious prosecutions and failure to properly investigate crimes committed against the Claimant and his family in his house, surgery, law courts and in particular in the court of The Royal College of Veterinary Surgeons."

Below I select relevant paragraphs from the text that Maurice produced. It's really sad for me to notice that its excellent quality shows how much his experiences in prison and Caswell Clinic have affected his mind...

Page 3: "Failed 'disclosure' by both the Defendant and the Royal College of Veterinary Surgeons, contrary to court orders, delay by HM Court Service to process current actions, interference by Crown Prosecution Service, HM Attorney General, Mr Justice Andrew Collins and others, either to hand down an Extended Civil Restraint Order or obtain a Vexatious Litigant Order, clearly to protect the Defendant, all done without the Claimant's prior knowledge has contravened hIs rights under the European Convention ot Human Rights and Fundamental Freedoms and the 1998 Human Rights Act.

The Defendants have a duty and power to stop and arrest any person ihat they may reasonably suspect as having committed a criminal offence. Further, the Defendanls as a police authority have a duty and obligation lo fully and diligently investigate any complaint from the general public in respect of any criminal offence."

Page 4: Further or in the alternative, lhe Defendants have a duty and obligation as bailees to use their best endeavours to prolect any prope.iy which comes into their control and in particular to protect any stolen properiy 10 ensure that it is not damaged or vulnerable to further theft.. Further or in the furlher alternative, the Defendants, once their investigations are concluded, have a duty io provide to the injured party relevant information concerning the results of such investigalions including, in particular, the identity of any person suspected of having caused wrong to the injured party.

The statutory and/or common duties and obligations herein mentioned are owed by the Defendants to the Claimant as the person directly affected and/or wronged and they are negligent breach of those duties and obligations or have assaulted him and/or have ommitted trespass to his person or property and the Clajmant has suffered loss and damage.

Particulars of Claims

The Defendants failed in their duty to properly, if at all, investigate and/or apprehend the perpetrators of crime.

The Defendants failed to prevent or limit loss for the Claimant.

Any one of the 100 or so incidents cited below, taken either in conjunction with the 40 or so incidents already in current Case numbers 85614159, Cf101741 & F20414 (eligible for jury trial) or not indicate malice and/or a failure of duty of are by the Defendant.

Here are my summarising observations:

This is the "mantra": The Claimant (Maurice) suffered loss due to defendant's (Police) conduct. It is being repeated across pages 5 to 10 as well as page 15 which lists 41 crime reference numbers, which is, however, not complete. The complete list would contain 130 malicious criminal charges.
Other claims are: The Defendant's conduct was unlawful.
Failed Disclosure with intent to deceive and delay.
Claimant applies that this action is heard by Trial by Jury.

Cessation of harassment and the righl to practice veterinary surgery was concurrent

Compared to the many other victims I've come across, the only thing missing is bankruptcy...

This document is, of course, highly relevant to the current action and its 40-page "judgment on preliminary issues".

Is it a matter of "packaging" the documents? I fear, it's long beyond a matter of logic as long it's up to the discretion of a single judge...
