13th October 2015 1st Dec 2011 Cardiff Magistrates Harassment Conviction Failed Disclosure contrary to Criminal Procedure Rules While I continue to scour the country for a solicitor, to accept instructions for simple disclosure of court records, I will list again what is needed to clear my name of six imprisonments, amounting to three years of my life, deliberately concocted by the South Wales Police simply to prejudice our multiple civil proceedings. 1. Full magistrates court records of the twelve hearings and especially those of the clerk of the court. 2. Copies of all of the prosecution exhibits especially the ones slipped in, on the day of the substantive hearing, suggesting a missive was sent by the victim to Caswell Clinic, Bridgend's police chief psychiatrist. 3. Why was their victim repeatedly denied copies of the magistrate's court exhibits needed to fight the appeal? 3. Full court records of 1st April 2012 Cardiff Crown Court appeal against harassment conviction. 4. Evidence relied on by 4th May 2012 trial judge (1st 'breach of a restraining order') when informing the jury, following their jury note to him, that the magistrates' records were 'not available'. 5.Evidence before Their Lordships, in March 2013, when their reason to refuse the appeal was because no evidence was sent from the Cardiff Crown Court, in the first place, that the jury had asked to see the clerk of the court's notes. Jury had specifically asked for clerk's contemporaneous notes following his hiding in a cell. 6. Full copy of the original court records obtained by the Crown Prosecution Service on, admitted, at least three occasions following alterations to them, each time, by others. 7. Full copy of the magistrate's court records, by February 2012 when copied to the Criminal Cases Review Commission following the victim’s complaint that he had no knowledge of any such 'retaining order ' having been handed down yet alone served on him! 8. Full copy of the victim's immediate 'gate arrest' police records following his release on 1st December 2011 from the Cardiff magistrates' cell that will also record no ‘restraining order’ was given to their prisoner. 9. The identity and full records of the Geoamey Custodial Services officers, on duty that day, who can each give evidence to clear this police victim's name. Why is it, time and time again in our British judicial system, where HM Partnership individuals get ‘found out’ but are privileged to be immune to prosecution, their victims, instead, are made to suffer all the more? Busy day for me, yesterday, in Parliament committee rooms- First there was 'child abuse' meeting and then 'whistle blower' almost a riot of over a hundred fearful followers and victims as persecuted 'whistle blowers'. Then, if not sublime to the ridiculous, in the very same room was NOMS with entourage including the new Justice Minister, Mr Michael Gove.......the discussion covered lawyer greed , would you believe? . . Outstanding Criminal Allegations to be Withdrawn to avoid Statutory Disclosure of Police Conspiracy Evidence 10am Cardiff Crown Court

Applications today will be made for the transfer of all my outstanding court cases to be properly heard well out of South Wales, it being exactly what the Crown Prosecution (Wales) have done with me, in the past, when the 'truth' is even too embarrassing for that 'shower' of reject attorneys to stomach. (ex police officer Derrick Hasan, working for HMC&TS Welsh manager, Luigi Stranati, pushed me down a flight of Cardiff Crown court steps to break my leg).

7. The Claimant be allowed all civil and criminal Cardiff cases to be, within seven days, transferred to any other courts within their jurisdiction but not in South Wales

8. The Claimant be immediately granted court protection from the continuing criminal conduct and threats to his life by still some within the South Wales Police

Nothing New Under the Sun,

where the South Wales Police is Concerned!

Yesterday’s Recorder of Cardiff Crown Court hearing was squeezed in between Her Ladyship’s heavy and far more serious agenda than Chief Constable’s Peter Vaughan’s oh so predictable continuing harassment of one of their too fast ageing victim.

Since his predecessor, Barbara Wilding, signed her Dolmans solicitor’s fabricated affidavit, to hide what triggered or contributed to extreme bullying, the incident of her Chief Inspector Brian Genner’s daughter’s miscarriage all blamed on me, police HQ’s conduct lately has worsened.

The changing of the machine gun’s paintwork , just to try and fool the jury, may be one out standing incident for Peter Vaughan to now address or Cardiff Cabal’s refusal to even return all my lawfully held antique guns, to the value of £10,000, confiscated purely out of shear spite, may be another but while the stay on all ‘Kirk v South Wales Police’ is in place for, so far 99 witnesses having given evidence, this current ratchetting up of their multi facetted conspiracy will show us all, at least, ‘just what really goes on in our UK law courts’.

Yesterday, for example, if you get in to the public gallery it is designed that you hear little and while not being allowed supervised tape recording for your own use, unlike elsewhere your time there is almost futile.

If you are in the Dock then forget it as it is even worse even if handed an audio loop to use. Bullet proof glass meant, in one of my recent cases, that it became so ridiculous I pushed off to my cell to have a cup of tea and read the paper while they ‘got on with the verdict (already laid down by written instructions by the then recorder of Cardiff , HHJ Llewellyn Jones QC. In that case the District Judge, John Charles, ordered I was not allowed to cross examine anyone, not just the rogue psychiatrist and Caswell Clinic staff that sanctioned the fabricated paperwork to have me registered MAPPA level 3 to get shot.

I have to fight for my custody records but, sure enough, my passport was listed in my property but when I was ejected from the prison it was nowhere to be seen!

Why snatch your passport, my friends in the public gallery asked? Your legal papers from your prison cell is obvious and the blocking of access to lap top and CDs but why the passport, so unlawfully?

That is an easy answer

1. His Honour Judge Seys Llewellyn QC’s 4^th September 2013 Judgment, staying ALL my civil proceedings against the South Wales Police, following their latest ‘knee jerk’ flair up of ‘activity’, to have me gaoled for the seventeenth time, since 2010, without achieving a conviction, means the Crown Prosecution Service (Wales) has had to employ a barrister from outside the area. The Bristol based barrister’s task is to secure my next unlawful incarceration in South Wales signifies just how desperate the Cardiff Cabal is becoming.

2. Mark Davenport was a witness, earlier this year, to the South Wales Police having me arrested in Brittany, sectioned and locked up in a French psychiatric hospital. I only escaped further sectioning because a passing nurse, who looked after me two years earlier, recognised me and set the alarm bells ringing. I had been in Pontivy hospital for my hip replacement as my NHS Caswell Clinic diagnosed ‘significant brain damage’ excluded my being able to be operated anywhere in the UK. Further evidence of the ‘entante cordiale’ police ‘cross border’ conspiracy could only be gathered by my personal complaint to the French IPCC, in person.

3. Without my passport in my pocket I could be arrested again, snatched off the street, as ‘ non identifiable’ and sent back to Cardiff prison just as Cardiff police had been done before from the very same two police stations dealing with this current scenario.

4. Her Ladyship asked that I put into writing reasons why I needed all criminal cases to be heard well outside South Wales before considering the possibility of ordering put in writing

5. Her Ladyship asked that I put it in writing why my last year’s incarceration before dropped indictment , following two Caswell Clinic doctors lying to the police that I had been around to their home harassing them, was relevant to this present list of charges.

6. Easy, I thought to myself, it is my legal submission that last year’s conspiracy with the two doctors to jail me, without trial, IS within this court’s jurisdiction BUT more to the point, it is relevant to His Honour Judge Seys Llewellyn QC’s civil stayed case. I might serve the full content of the hundred or so lever arch files of evidence during the 27^th Sept? proposed management hearing in order to finally get that jury promised me 20 years ago when I first started fighting this cess pit of evil in South Wales.

7. I was, incidentally, again refused a copy of my custody video as defendant interview, under caution, as it is so crucial, each time, to expose police conspiracy.

8. The exclusion of the video is the first positive indication of the CPS proposing to drop the charges as no judge in Wales will get you the proof of the conspiracy on depositions once the case is buried. It stinks, doesn’t it?

9. Often, just like in many of my previous cases, none of the relevant CCTV footage, under the care of the police/CPS/courts or ‘apparent ‘victim’ making the complaint appears to be disclosed, despite my demanding as soon as the hand cuffs clip on. Just as HHJ John Curran QC said to the 2012 ‘Breach of Restraining Order’ jury, in reply to their note, for court and custody records and cell CCTV, ‘unavailable’! Deja Vu

My twenty year running three month civil damage trial, for police bullying, trundles on again this week portraying my general incompetence and serious loss of 'short term memory'. I am, simply, far too old and tired for regurgitating the police's scandalous day to day conduct of the 90s, supported by a thoroughly corrupt HM Crown Prosecution Service and those running the HM courts.Their joint scandalous conduct, however, is slowly but slowly surfacing from this South Wales cesspit based on inherent deceit. eg Adrian Oliver misled the court , a few weeks ago, by withholding the following section 9 police statement by Ely police sergeant , Robert Nelson Roe, served on Dolmans, about six or seven years ago, along with some 52 bulging lever arch files , by me as every page a 'prosecution court exhibit', created by my then long suffering secretary, Mrs Dianne Graham, who has now appeared to have disappeared off the map! .......Reward for her contact details..... But Anthony was 'shacked up' with now retired Chief Inspector Jenner's daughter Alison, so I wasn't going to get much action from him or anyone else! Roe 'knew nothing about me and had not gone to Barry police station to interview me under caution.....the custody tape, of course , being buried with all the rest.

THAT TV PROGRAMME ON GUERNSEY'S HOUSING LAWS

I had up to 40 itinerent hotel workers, primarily Englsh, Irish and a lot of Welsh, during the summer months, living in my house, all hard working and only needing a bed for the night.

Accommodation included tents in the garden , each with a television and even the occasional Transit or Thames van!

As for second hand cars and motor bikes I was selling them off my front lawn, like there was 'no tomorrow' and known under the name, which was on a big sign spread across the house as reading:

"Onest Harry"

"All Cars Guarrenteed to the End of the Drive"

I remember, once a week, at midnight , going around the skips, especially up in the 'Open Market' housing districts, of St Matins, featured on the film, and dragging out TVs , freezers and washing machines which often only needed a fuse in the plug to get them to work!

And, of course, there was the huge accumulation of house rubbish, blocked loos and vomit, all needing my personal attention at 6am on most days! I found a new use for wearing a long sleeve rectal glove.

And do you remember the Sunday night parties run on illicit houch? Well, not sure if legal but Ollie and Josephine Reed often arrived with an appropriate bottle tucked under his arm.

Drinking was not allowed on Sundays so pubs were closed and only residents of hotels and the locals, at home, were allowed alcohol to pass their lips. This was the reason for my riotous Sunday night parties, run on two dustbins full of home made beer, brewed to twice the strength and sold at half price!

The island's housing census, hotel inspectors and planning inspectors proved to be a slight irritation but the 'Insular Authorities' had already shown their venom on so many honest Brits, just wishing to come to the Channel Islands to work. So well portrayed during the German occupation was their true conduct, below the thin veneer to impress incoming millionaires, many known, openly, to be drug dealers, insider dealers and what had most angry ...Guernsey was known as an IRA 'safe house'.

Harassment and bullying was what the police did as soon as I set foot on that island to work with an old college mate and exactly what the South Wales Police set about duplicating the moment I crossed the Seven Bridge in 1992

As for their small minded incestous environment, run by no more than some two hundred inbred famillies across the Channel Islands, where nepotism totally dominated 'Noddy Land', this weekly income of mine needed to be maintained as expensive boarding schools needed to be paid for back in the UK

Some £1,500 in cash, in the hand, on a Friday night for rental, some five or six cars sold and a half dozen or so kitchen appliances sold, minimum, every week and there was the rental of motor bikes, I almost forgot, meant, with my veterinary income the authorites were determined to quash, life was'nt so bad at %10 fixed rate income tax, quietly arranged with one of my many English born 'supporters' in the Tax Office senior management!

As for the huge accumulation of rubbish I had dug a 'gurt hole' in the garden, while applying to build a nuclear fall-out shelter and sold the top soil, burnt and burried the rest while advertising in the Island's news paper remaining space for 'time share nuclear fall out shelter' and actually received genuine replies!

Just as with the Welsh police I was regularly prosecuted for trumped up criminal charges and jailed not less than twenty one times despite a 75 % success rate in the so called 'Norman Law' courts with no appreciation on the word. 'disclosure of evidence or the phrase, 'human rights'.

Before I beat them in their own 'Royal Court' to get an essential worker's housing licence I bought a 60 ft French tunny boat, in Brittany, ran her up St Samson's harbour beach, exactly to the minute on the highest Spring tide, openend the 'sea cocks' for three feet of sea water to flood into the fish hold, bought 200 yards of electric cable and ran it throgh the water to the 'fishman's frre elctricity source and squatted for two years.

As for being prosecuted for housing essential wokers who were not guernsey born I dressed appropriately for that to watch the trial collapse in ridule and ignimoy, every thing they deserved for what they did in the War or didn't do.

DeVic Carey , the prosecutor featuring in the film had a grandfather who was Bailiff during the 2nd World War.

Sir Winston Churchill wanted the traitor to be hanged but lost the General Election and so Atlee had him knighted, instead.

Entering, suitably dressed for a Guernsey Magistrates hearing, that later collapsed in farce.

I was charged over their iniquitous under hand methods of administering their housing laws. I was the only one prosecuted who had failed to fill in the Island's census form...I think I was away that day!

During my regular incarcerations in their1811 prison the police made full use of the opportunity and often raided my surgery, in the early ours of the morning , Nazi style, with a sledge hammer and crow bar, (Deja Vu?) to break into each bed room if the terified occupant would not unlock the door.

I recall one such English lady, a Marianne Fanshawe, who refused to open the door. So the police swung the sledge and smashed the panel door in sufficient for her to be able to crawl out on her hands and knees and stand to recieve a summons.

This morning, in Cardiff Civil Justice Centre we started what is to become protracted legal arguement over current and future planned publication, on this website, of the day of the apparent cavalier behaviour of DOLMANS, solicitors, Cardiff.

In order to bleed and suck out of the tax payer's pockets simply huge sums of quite un accountable cash it is dependant on a now questionably outdated adversarial legal system, itself driven by greed, whilst also using the excuse 'it is for the greater good'!

Police, next week, are to be cross examined over my being stopped and arrested by police officers in cowbridge main street, Bickerstaff and Holehouse, no doubt denying even knowing who I was or knowing anything about the almost weekly adverse experiences I and my familly had suffered under their constant bullying almost from the very first day, in1993, following my buying a veterinary general practice in Barry.

I was arrested in Cowbridge, Vale of glamorgan , for about the eighth time, for 'driving whilst disqualified' and then seriously assaulted by police officers Bickerstaff and Holehouse I WAS NOT DISQUALIFIED

I was then de arrested, following 'their enquiries', only to be re arrested for 'a public order offence' as I argued the need for their new bright idea for me to waste more time and visit the police station with all my driving documents!

I then dropped pamphlets over Cowbridge , 'from a great height' and did door to door 'pamphlet delivery' from the Eastgate traffic lights to the West gate road off to Llantwit Major offering £1000 reward but the environment is what is and always will be.

Friday 5th April

Today, during this three month trial, started 20 years ago for punitive damages against the South Wales Police for bullying, with total press blanketed censorship, Adrian Oliver, senior partner of Dolmans, solicitors, one of the prime movers in 2002 in having me struck off as a veterinary surgeon, effectively for life, complained!!

He has destroyed my marriage for advising the local police it was safe to have me jailed for nearly eight months, registered MAPPA level 3, trading in machine guns and also orchestrated my being sectioned under the 1983 Mental Health Act, using a similarly attuned villian, a Dr Tegwyn Mel Williams of Caswell clinic psychiatric prison, Bridgend, complained!!

The Welsh 'shrink' had not even examined his victim!

In The Cardiff County Court Maurice Kirk v South Wales Police

Retired Police Officer Robert Osborne’s 2^nd Day of Cross Examination

The South Wales Police, at the time, had an overall policy to ‘Get Kirk’ which was routinely spurred on from the Guernsey police, during the nineties, they also having been exposed to excessive adverse publicity. With this history and following numerous ignominious encounters, over the years, with Kirk and his various aircraft the local police set about a harassment campaign consisting of bullying or deliberate in activity using any conceivable means possible.

Unlike the majority of targeted victims Kirk was particularly vulnerable to abuse by any authority because he not only had the usual driver’s licence, he also had professional ones for his chosen vocation, being a veterinary surgeon, requiring both a fire arms certificate and a shot gun licence. Added to this he had the need of a pilot’s licences all of which, as with his veterinary qualifications, all could so easily be revoked following any spurious complaint from a senior police officer.

The police campaign was hatched within months of Kirk’s arrival to South Wales to inflict criminal acts on both Kirk and his property, coupled with the concerted policy to include ‘inactivity’, should he complain, revealing:

‘Evidence of similar fact’

Provoke him by delaying his going about his veterinary business and to arrest, on the road side whenever possible, by using: a faked ‘refused breath test or faked ‘positive breath test’ or he is in possession of a stolen car or his vehicle is un roadworthy or he is a banned driver.

ANYTHING

to get him into custody to further provoke for him to ‘retaliate’, ‘lash out’, ‘clench a fist’, anything in order that he can be further detained and charged with something that could finally ‘stick’.

Following the trial judge’s instructions the remaining ‘cross examination questions’ need to served on the court in writing, AT 2002 RCVS Disciplinary Enquiry:

Who, on 5^th April 2000, took this victim to Roath police cells?
Who failed to secure an open windowed parked veterinary surgeon’s car, outside and full of dangerous drugs when parked just a few feet from a public high way?
Why were Roath custody tapes tampered with to hide the officers’ faces who dragged the victim around the cell floor?
Why were both police custody and overhead road videos not disclosed until a year after the victim had applied for them by letter, in magistrates, in Crown Courts and in several Judicial Review applications in London despite original numerous Crown Court orders so to produce?
Could Chief Superintendent Collin Jones, in over all charge of this incident, have answered as to why the videos had been tampered with in such a significant manner relevant to your current oral evidence?
Why, do you think, this victim’s main witness, the chief inspector, in all twenty odd subsequently generated court hearings across the country, was always refused by all courts if not a typical Masonic manoeuvre ?
Why, later that day and still in custody but now at Rumney police station, after the victim had given zero/ zero readings on the alcohol definitive breath test machine did he then receive still further threats to provoke retaliation, by further detention, until next day if need be, he dared to refuse to be examined by a doctor for the remote likely hood he was under the influence of drugs?
Why was victim’s threat to sue, if not immediately released, as on 2002 RCVS transcript, see D3/54 p243 & D3/55 p244 C, not just one more example of ‘evidence of similar fact’?
Who, if not Osborne, caused further detention for a doctor examination re illicit drugs?
Why was the drugs procedure, a further and unnecessary abuse, carried out in the way it was done?
Why if not to further attempt to try and provoke the victim to ‘retaliate’?
What is the true reason for Osborne never asking the victim to ‘produce his driving documents’/
Was it because court was fixed within 6 days, see D3/57 p246A, or already police had details from 24/7 surveillance?

a) Why was this supervised video tampered with by police either ‘post editing’, once the June 2000 court order for its release had been given or when the original camera operator wobbled or redacted footage at the critical time of the incident?

b) Why, if not to attempt to cover up the full the extent of the unlawful assault?

c) Why was there a need for such an unprovoked assault on the victim, quietly sitting at the wheel of his car, just for having failed to give a breath test if not to provoke their prisoner?

d) Why was this detained person, just recovering from an assault by his captor, considered then to be in an appropriate ‘state of mind’, ‘men rea’, to be capable of comprehending a request, from that same captor, Osborne, requiring the carrying out of road side breath test?

e) Why was the victim driver then left alone in the police van with no hand cuffs on or inside a ‘cage’, with van doors left wide open?

f) Why were you all expecting your victim to ‘run away’ if you had not been receiving directions from senior management?

Evidence of similar fact is in all incidents?

In Cardiff County Court this Month

Lantwit Major's police sergeant 'Killer' Kilberg, one of many in the 1990s police force, who had my name removed from the veterinary register is caught out lying to the currently presiding judgere along with a few others already heard and shortly to also give evidence.

Enclosed is a 90s Barry police station custody video of Kilberg lying to the custody sergeant that I was in breach of a public order offence despite the custody sergeant specifically asking for that clarification.

His Honour Judge Seys Llewellin QC or the police QC, during the three months civil action currently in session in the Cardiff Civil Justice Centre, asked for clarification on exactly the same point with the South Wales Police sergeant qualifying the issue by stating the custody sergeant made the mistake when writing down the facts.

South Wales Police, out of shear spite, reported this 'failure to supply a specimen of breath' to the Royal College of Veterinary Surgeons because, since 1993, the police had lost around eighty criminal allegations against me out of ninety but in this case,using their influence on the judges to ban my web site for fear this video other proof of bullying would be broadcast world wide, doubled their wickedness by repeatedly ignoring His honour Judge Vosper qc's orders to disclose custody records.

Thank you for your letter 20 March 2013. My 22 January 2013 letter is to vary “all” conditions. I understand that the CPS previously proposed the following sorts of conditions in 2011 and so it follows we vary the past CPS draft proposals to seek a proportionate response:-

I can agree not to contact Dr Tegwyn Williams. [I have instructed private detectives to locate Drs Williams and Hillier’s home in order that there may not be a repeat of my last summer’s vindictive imprisonment following his false ‘victim’ statements].

I agree not to disseminate any untrue information with regards to Dr Williams.

That the Order end on………Date?

As Dr T Williams is not at Caswell Clinic and has not been there for a very long time it would seem wrong to deny me my rights and liberty of access to my NHS clinic.

It is also normal NHS procedure, after being an inpatient (sectioned or otherwise), that if he is confused, unhappy or seeks reassurance regarding what has occurred and/or is written, that the patient is to return to the same clinic to discuss issues with the same ‘group’ of clinicians.

Under the Data Protection Act the same clinicians are to update the records to make all that they have ever written to be fair, true and accurate. Clinicians not at Caswell in 2009 cannot address data. It must be the team at Caswell. There were over twenty writers in the three months of my team assessment or forced unnecessary and unlawful incarceration.

Dr Williams and his lawyers are accused of abuse of power and workplace bullying where the Caswell team wish to build a relationship with me. If I name a good genuine clinician, who will help me, will Dr Tegwyn Williams and his lawyers then bully that clinician not to help?

I cannot now name any helpful good clinicians for fear of them receiving a repeat bullying.

You mention that Morgan Cole, solicitors, say that there is no facility to conduct tests for brain damage at Caswell Clinic when Dr Tegwyn Williams seems to say there is, in that Caswell Clinic is the host to commission and deal with investigation of specific issues of brain damage effecting behaviour relevant to MAPPA level 3 forensic psychiatry.

Why, then, did Dr Williams ask the Crown Court to section me first to Caswell Clinic and then to Ashworth Prison if not to determine the presence or absence of brain damage?

Why does Dr Williams avoid clarifying whether I have significant irreversible brain damage?

His last summer’s false ‘victim’ statement, police countersigned, means the CPS recognises Dr T Williams is not without blame when dropping all charges. So is the CPS now proposing to vary my Restraining Order to that of a more proportionate one or do I appeal to Europe?

As usual it is all about 'disclosure of evidence' so if the police can withhold names of witnesses, custody records and police personal note books etc then they usually have you 'buttoned up' and 'up a creek without a paddle' in any subsequent criminal or civil proceeedings.

I have been unable to open the ZIP files which you have sent and have asked my IT team to investigate the same. Attendance at our offices

I refer to your and anticipated attendance at our offices at approximately 4:55 pm on Friday, 22 March 2013. I record that you entered the reception area of our offices despite having previously been advised that your license to attend our premises had been revoked and that you would be trespassing if you entered our premises.

This decision was not taken lightly, but was based upon our previous reasonable requests for your dealing with matters by e-mail and correspondence and the fact that it had been necessary to ask for police officers to attend our offices due to your refusal to vacate the premises on a prior occasion. In addition, you have made several unwarranted indications of your intention to effect a citizen's arrest upon me personally. I have no wish for my staff to become embroiled in any issues relating to your expressed intention. I am also aware that you have distributed leaflets relating to myself which are inappropriate and inflammatory.

I would be grateful if you would abide by the indication which has been provided to you. If you continue to seek to enter our premises, then it will again be necessary for us to involve the police.

Your purported reason for attendance at our offices

You indicated to the person who dealt with you that you are seeking to attend regarding VHS cassettes and a DVD and that you are seeking to draw attention to discrepancies between the same.

The person who dealt with you indicated that he would not be able to assist in this regard, but you indicated that he would be returning to our offices at 4:00 pm on Monday, 25 March 2013.

Your need to comply with a court direction

A direction was made by the court on 13 March 2013 that you were required to produce by 4 pm on Friday 22.3.2013 the videos which you have in your possession by email and that those which you did not have in digital form, were either to be supplied to the court in digital form, or if not practicable, to be lodged with the Court by that date, for the particular attention of Mrs Rosie Pahl.

It is clear from this direction that the intention was that you should lodge any relevant tapes or digital copies with the court, rather than this practice. In particular, we are alert to the fact that you have suggested to the court that this practice cannot be relied upon to produce appropriate copies.

The court has made it clear that the court is to take control of any documents which you produce. You are therefore reminded of your obligation to provide any relevant material to the court as directed by the court.

Yesterday, 28th March, I returned before 4pm and attempt to serve videos, they already have, in a different format but was blocked at the door with no one accepting the videos causing me to haildown a police officer to witness it for the trial judge on wednesday.

14th March 2013 Criminal Court of Appeal, whilst sitting in Cardiff, refused Maurice Kirk both legal representation and clarificationion as to whether he had 'significant brain damage’ and 'possible' cancer reported to 2009 Cardiff Crown Court, by a South Wales police psychiatrist, whilst recommending his victim be incarcerated in Ashworth High Security Prison for the doctor’s own safety, from an interested third party, an elderly Norman Scarth Esq.

JUDGE CURRAN: Do you intend give evidence?

MR KIRK: It depends on whether you let me get my legal papers that are down stairs.

JUDGE CURRAN: Mr Kirk, I am not going to let you get at what you call your legal papers.

(The Appellant was not allowed to be present or allowed to call any defence witnesses)

The jury was misdirected

Jury note(s) to the learned judge they received a response, in the forced absence of the Appellant, that there was ‘no evidence’ from both the custody manager and court clerk’s contemporaneous notes and CCTV footage stored from GEOamey Custody Services cameras positioned both in the Appellant’s cell and in the long custody suite corridor or from the HM court’s controlled cameras at both exit of the custody suite and building.

LEE BARKER, the custody suite manager said, both on oath and in his witness statement, that he ‘served’ the ‘restraining order’ in the cell after he had to first unlocked the cell door.

MICHAEL WILLIAMS said, both on oath and in his witness statement, that he saw served on the Appellant the ‘restraining order’ whilst the Appellant was on crutches in the corridor returning from the toilets. Potential weapons, such as crutches, are not allowed in that area.

CCTV cameras recorded the part hand written ‘restraining order’ remained in BARKER’S hand , whilst in the cell and recorded the Appellant literately being dragged out and thrown out of the suite by no less than five angry custody officers who then threw his crutches onto his head as he lay on the floor of the public corridor. The camera at the exit of the building recorded defence witnesses, called to give evidence, seeing the Appellant both in hand cuffs and in a wheel chair.

The jury was subjected to a ‘An Abuse of Process’

The psychiatrist subjected the Appellant to the NHS (Wales) zero tolerance policy thereby seriously prejudicing current civil litigation from 20 years of persistent police bullying by

a) Causing the Appellant to be registered, in Barry police station, on 8^th June 2009, a MAPPA level 3 victim, to be one of the 5% most dangerous so registered and then

b) On the 22^nd June 2009 caused the Appellant to be arrested and remanded in custody on dreamed up fire arms charges over a WWI antique Lewis machine gun and then

c) had the Appellant, on 7^th august 2009, sectioned under the 1983 Mental Health Act, without even examining his own patient and then

d) without the appropriate qualifications and contrary to others with appropriate qualifications, recommended to a Crown Court, on 2^nd December 2009, that the Appellant be further incarcerated into Ashworth High Security Psychiatric Prison for the doctor’s own safety (see para39 of 19^th October 2009 psychiatric report) and then

e) The psychiatrist wrote that the Appellant had ‘significant brain damage’ with the court being told, in the forced absence of the Appellant, that he possibly had cancer’

f) The Appellant has NEVER been supplied with the evidence, clarification or retraction of such nonsense despite this Appellant’s last application before this very same Criminal Court of Appeal for that very same purpose

g) The mischief by Dr Tegwyn Mel Williams continues

Last July he signed a ‘victim’ statement that the Appellant had harassed him at his home with his wife, Dr Janis Hillier, also of Caswell Clinic, to such an extent that they are now both on ‘extended sick leave’. The lies continued in that he also stated police had to be called to the scene but with Appellant’s subsequent imprisonment ending by all charges being dropped.

4 Section 1 (3) of 1997 Harassment Act provides a DefenceThe Appellant was not allowed at the1^st December 2010 summary hearing, while facing ‘harassment’ allegations of the police doctor, at its subsequent 1^st March 2013 appeal or even at the 4^th May 2013 jury trial to put a legal argument that the police doctor had knowingly committed crime, due to police black mail and therefore the Appellant was permitted

a) that it was pursued for the purposes of preventing or detecting crime

b) that it was pursued under any enactment or rule of law or to comply with any condition or requirement imposed by any person under any enactment

c) that in the particular circumstances the pursuit of the course of conduct was reasonable

I broadcast a taste of last time I was in front of Their Lordships, in the Royal Courts of Justice, on another futile appeal, having served yet another prison sentance caused by Dr Tegwyn Williams, re a Cardiff judge daring to suggest, ney insult my intellegence, that he would order and obtain, bloody liar, for the NHS (Wales) to produce the evidence I was to be sent to Ashworth ipp as a public hazard.

Who filmed this, quite without my knowing and definitely without my approval , I do not know but had I known I would not of been so subservient......and the rest.

Dr Tegwyn Williams' wrong doing?

The Appellant believes Dr Tegwyn Williams is an unaccountable Clinical Director who can call on NHS lawyers and NHS chiefs to cover up his wrongdoing. It is in papers, that were not before the Courts in this case, that Dr Tegwyn Williams is that unaccountable that he calls on the support of the Chief of local NHS and Welsh NHS to use police to stop complaints about him going to the General Medical Council

Dr TW to help his associates (some local police) in a civil dispute, Sectioned the Appellant, without first assessing him, when the Appellant was not a patient of those kinds of services.

Dr TW then entirely made up that the Appellant had significant irreversible brain damage and made application to indefinitely Section the appellant to High Security Hospital. He failed in his attempted to indefinitely Section as no other medical doctor would support him.

The point is that Dr Tegwyn Williams is not medically qualified to interpret brain scans, as that is the job of the neuro-radiologist who has training and qualifications so to do. Dr Tegwyn Williams does not use or invite anyone who was medically qualified.

The Clinic team wrote in the team assessment from the three monthly Sections at the Caswell Clinic, that they wanted to build a relationship with the Appellant as an outpatient and draw him in.

But each time the Appellant would attend Caswell clinic Dr Tegwyn Williams would arrange that Police were called to arrest him.

In the end, to prevent the General Medical Council acting on what Dr Tegwyn Williams does wrong, he brought zero tolerance prosecutions by claiming, in short, that lawful accurate comments that were not defamatory, made him feel harassed.

Changes in law and interpretations.

Does it matter that what the Appellant says is accurate and not defamatory and now changes in the law (reform of public order Section 5) also means that an insult is no longer meant to be harassment ?

Also Courts have decided to recognise playful or eccentric comments as not malicious and with the example of a jovial threat to blow up the airport as meaning to be light hearted.

That light hearted meaning is very relevant to the Appellant as his ‘Wanted posters’, were clearly meant to be light hearted comment from a man well now as a harmless eccentric.

Where is the proportionality in wanting to imprison a 67 year old man for making accurate, reasonable, eccentric, light hearted but entirely justified and necessary comment ?

Stafford NHS scandal, the Need for Freedom of Expression and Appellant’s course of conduct and alleged Breach, can stop suffering and worse.

Mr Jeremy Hunt, the Coalition Health Minister encourages the need for people to be able to speak out when things go wrong in the NHS and that no gagging Orders should exist on NHS conduct. Especially as around 1200 people needlessly died at Stafford as there was no where to complain and little way to speak out

There are said to be at least fifteen other hospital Trust like Stafford.

The Protection from Harassment Act 1997 and “incompatibility”

The Appellant would be raises whether the Criminal Court of Appeal would grant permission for an application to ague “incompatibility” on how the Act is not compatible with Human and Fundamental Rights and that Parliament could not have known the effect that it’s legislation would have.

As we are aware it is for the Higher Courts to declare incompatibility and for Parliament to remove that incompatibility, if it so wishes.

It is said that the ‘course of conduct’ in the Protection from Harassment Act 1997 is unique to the UK. No other country has it. Other countries make do with stalking laws and other like measures. One reason why all other countries do not use ‘a course of conduct’ as a criminal offence is that it is said that this kind of law is open to too many problems and abuse.

One of the four cornerstones of EU law is that a person must be able to tell that their conduct would be a criminal offence. The UK law interprets that as would know with advice of a lawyer.

Yet full time Judges decide on if a course of conduct amount to harassment in ways that the best lawyers in the UK cannot predict how Judges will interpret what amounts to harassment in for example the zero tolerance, white collar, neighbour or family disputes. The appellant believes that means that the Protection from Harassment Act is clearly not compatible with EU law, and that is but one example.

With the Malicious Communications Act 2003, a new stalking law and various other measures and that the Harassment Act is know to be so widely over used and miss used, many call for the 1997 Act to fade away, in favour of expanding the scope of other laws

Their Lordships, together with the documentary evidence that Dr Tegwyn Mel Williams knowingly falsified, in the presence of South Wales Police officers, his Sect 9 countersigned witness statements, to obtain my false imprisonment, are to consider the 'ramifications' of the enclosed transcript from part of 4th May 12 'Breach of Restraining Order' conviction hearing, now the subject of their deliberations.

The transcript clearly indicates, just as in the 2010 'machine gun' scandalous jury tria, l was refused even my legal papers and personal court exhibits even in thew court room!

On 4th May2012 His Honour Judge Curran QC, whilst I was forced to be absent due to requiring urgent medical attention, had refused me Dr Williams or any others, named, to be either my 'character witness' or as a 'witness of fact'.

On 1st December 2011 District Judge John Charles had done exactly the same, in my absence, when he convict me for 'harassment' of Dr Williams following the publishing of further falsifed documents by Dr Tegwyn Williams, namely, my series of NHS (Wales) Caswell Clinic psychiatric reports culminating, on 2nd December 2009, at Cardiff Crown Court, that I be further sectioned under the 1983 Mental Health Act, due to 'significant brain damage' and 'possible cancer', in Ashworth High Security Psychiatric Prison.

Closer scutiny of my Casswel Clinic, Bridgend, medical records, discloses, as in his October 2009 psychiatric report, his other and most pressing reason as to why I had to be moved to Broadmoor or Ashworth was because of 'veiled' threats , he told me, of 'reprisals' by an old gentleman by the name of Norman Scarth!

Experts in the field confirm there was no sign of relevant brain damage BEFORE Williams even writes the report without appropriate qualifications.

Claimant Position Statement

Applications for Consideration

1.       Defendant ordered, to be produced today , the 27 written complaints, as a written list, currently in possession of Defendant and referred to by former Inspector Sydney Griffiths during his cross examination.

2.       Result from those written complaints, identified on the list, to be disclosed.

3.       Claimant awaits the findings of his other complaints, mainly of non disclosure, not being identified by the Claimant, such as court cases with Claimant being the successful victim and police instigated ‘break ins’ to his various veterinary surgeries and places of residence.

4.       Incidents, referred to in paragraph 3., are absent from Barbara Wilding’s 25^th February 2009 sworn affidavit, prepared by Dolmans and signed six weeks late by her, then as Chief Constable, despite the specific court orders by His Honour Judge Nicholas Chambers QC.

5.       Identification required of which Defendant witness relates to which of Claimant’s 52 leaver arch files given to Defendant,, to copy and so expedite proceedings, as there is now total confusion deliberately caused by Dolmans, solicitors, by having masked out the Claimant’s indices on each spine on every file!

6.       52 files were originally prepared and marked by Claimant’s secretary before they were disclosed as Claimant exhibits for South Wales Police to copy and to ‘settle out of court’.

7.       Claimant is seeking a ‘Medical afternoon’ before or after 3pm’, at the court’s convenience, this week, in order to find a GP, with which to register, well out of South Wales.

8.       The Claimant cannot proceed with cross examination until Crown Prosecution Service (Wales) and the Defendant produce both male psychiatrist’s falsely written and his Dr wife’s section 9 statements created, to adversely affect the Claimant, since 2009, in this trial.

9.       Following orders from Barbara Wilding , to cause the forensic psychiatrist(s) to attend Barry police station, at very short notice , to attend and contribute in the 8^th June MAPPA level 3 meeting, not to inform their victim, the Claimant was so registered and should the Claimant approach the Defendant again, to attempt ‘witness statements exchange’ he was ‘likely to be shot’ ‘.[quote from MAPPA contemporaneous notes taken at the time]

10.   The doctor’s 2012 victim MG 11witness statements are partly dictated and counter signed.

11.   That , alone, has caused the Claimant to be detained in numerous police stations, law courts and HM prisons due to one doctors and NHS (Wales) facing my million pound damages claim citing Barbara Wilding and her agents in the conspiracy.

I was originally awarded a jury trial by His Honour Judge Nicholas Chambers QC, nearly 10 years ago, against the bullying South Wales Police over our currently hotly contested 35 mainly motoring incidents being heard, NOW, before His Honour Judge Seys Llewellyn QC, at Cardiff’s Civil Justice Centre.

But only, His Honour said, if I chose any eight from the list.

I did and Swansea High Court judge promptly overturned it as too ‘document heavy’ for a jury to ‘comprehend’ so I suggested one jury for each incident!

[My gut feeling told me, now proved, as in my Royal College of Veterinary College ‘HM Partnership’ controlled trial and Lynette White murder trial scandal, also fiddled in Swansea and also refused to be heard out of Wales, no local judge was ever going to give me a jury unless the Welsh appointed judge could ‘get away’ with using case law, eg ‘Hill’, the murdered girl by ‘Sutcliffe’ ‘Jack the Ripper’ allowing police, effectively, ‘no duty of care’.

What I considered, for compromise, was say, four or five incidents for a jury, at a time.

But my old inherited gift of ‘premonitions’, from Mum or Dad, told me to forget it, that has kept me alive, so far, on ‘terra firma’, in ‘terra aqua’ and even after 14 ‘donkey stops’, having ‘broken the bonds of Earth’ only to suddenly finding myself running out of height , airspeed and ideas, all at the same time!

While I was about to set off from Biggin Hill, with 51 other aircraft, senior South Wales police officers were scheeming to have my name removed from the veterinary register all planned for shortly after my return from Australia.

It was obvious that if I could not get these cases out of Wales, early on or get a jury, then I was now doomed as it was now far too late, fiddled and pre planned by the Taffia, Cardiff’s Cabal, 20 years on, as still further obscene costs would have been inflicted.

As it has turned out, for the whole World now to witness, only due to cyberspace, by no other media, four times they have further delayed these Actions, against their ‘extreme and unusual malicious behaviour, first successfully appealing against a jury, then the ‘machine gun’ conspiracy, then the ‘Dr Williams’ et al playing the ‘Gulag Card’ and MAPPA card, the subsequent ‘fabricated ‘harassment of someone who is a criminal ‘on the run’ to this 14^th March fiasco, as fiasco it will surely be, the Criminal Court of Appeal hearing of my stitched up ‘Breach of a Restraining Order’ when no order was ever served!
