Extracts of the defendant's speach that was never needed, as the jury told us in the Cardiff resturant afterwards, the end of the first day of evidence was enough for them!

"You have, may I suggest , just heard twelve days of yet another example of our current judiciary system exploiting a personal vendetta, at your expense, this time due to a pending civil action for 'malicious prosecutions and false imprisonments' requiring well over one hundred South Wales Police officers, many retired, being made soon to swear, on oath, as to their reasons behind why, for ten years, I was harrassed whilst working as a veterinary surgeon in the Vale of Glamorgan".

"Losing well over one hundred charges and winning about twelve is only just part of their agenda to have me deprived of income and and the right to practice veterinary surgery".

"Evidence has shown they knew, from the start, that the 'Lewis machine gun' had been decommisioned by Viv Bellamy well over thirty years ago and had been one of several he had placed on his beautiful WW1 replicas I had had the honour to see being built at Lands End aerodrome back in the early seventies".

"In June, last year, the twenty odd, many armed, police surrounded our home, in St Donats, on the Sunday, whilst Kirstie and I were drinking tea in the garden. With the police helicopter overhead they aborted the one million pound "Operation Challice" raid "as you had to be arrested 'away' from the premises" the police officer admitted during cross examination".

"Next day they tried again and succeed but refused to admit they found my sixty four page defendant's statement waiting for them, weighted down by deliberately planted 'ammunition', the very allegation at my arrest as my phones had been tapped for years as a 'MAPPA level 3 terrorist', level 3 for the top 5% of the most dangerous villians let loose in our society!".

"The chap who sold me the gun was NOT arrested. The purchasing display pilot, like myself, my having been personally invited to fly the DH2 at 2000 Farnbough Air Show by Captain Trubshaw of 002 fame, was also NOT arrested even though he had 'modified' her and painted her multicoloured".

"So why was his 'black and siver' paint not on the gun in court, why was I and nearly all the others, giving evidence, not allowed to examine her, why did she dissappear to South Wales police forensic labs in her two thousand miles of peramulations around the country with, purportedly, only one police officer in the car, if they had not considered, for one moment, she was really a prohibited weapon?"

"And that arrogant Dr Tegwyn Williams of Caswell Clinic, South Wales Police Forensic Gulag in Bridgend, telling the judge I had brain damage, by being a long time drinking companion of Oliver Reed and off to Broadmoor I must go! And wicked 'Tom Thumb' Thomalow, HM prosecutor, telling the judge I had a brain tumour as I smouldered in the cells beneath that cess pit, Cardiff Crown Court. What do you make of that if not a conspiracy driven by avarice?"

[And why did my very own Cowbridge Health Centre family doctors repeatedly refuse to have me examined or refered when asked both during and after my acquittal? Why did I have to go to doctors outside Wales?]

"Reliance Custodial Services refusing me my medicine throughout the trial and my fifty two lever arch files for most of the first week of the trial. Vermin caught in the head lights?

"HM Prison once again deliberatly refusing me access to interview witnesses/legal papers during seven months of my incarceration. Relevant to a jury, do you ask? No wonder they want to do away with magistrate and jury systems, our last remnant of the Magna Carta".

It stinks does'nt it but the ring leaders will get away with it again, that is our current British custom.

Newport Court 19th Jan

Maurice appeared at Newport Court 19th Jan 2010 not knowing what he was there for until he walked in. It was a further bail application presented by others. The prosecution were taking advice from South Wales Police but especially Dolmans, the police solicitors acting on their behalf whose senior partner, Andrew Oliver, Maurice is suing along with the SWP in the Civil Court at the same time!

The prosecution had to speak first but they have run out of arguments and so said that there was no change of circumstances since Judge Bidder heard the case on 17th December 2009.

The application failed.

The previous week at the Civil Court the Judge, His Honour Judge Seys Llewellyn QC instructed the Police to release to Maurice over 52 lever arch files. Now the Prison are refusing him access to them. This is the evidence he has been fighting to see for over ten years .

Civil Court Judge has ordered the South Wales Police to produce the 52 files for Maurice but when they eventually arrived the Prison Authorities refused to give any to him. At last, with more delay, they have allowed him access to 6 files at a time (so no cross-referencing possible) and each batch available every day or so thus meaning he has no time to prepare for his criminal case which starts 25^th Jan. He is still being denied his laptop on which he has filed evidence.

Because he has recently won a case for excessive physical restraint against Reliance, the firm employed to move prisoners from Prison to court, hospital etc, they have seen to it that he has even more restrictions placed on his visiting rights.

Civil Proceedings Lodged

Maurice started his Civil Proceedings against the South Wales Police this morning in the County Court. The Solicitors, acting for the Police, admitted in court that they had no copy of their complaint to the Police against Maurice which led to his arrest on 22^nd June. He had been accused of threatening to throw the bundle of witness exchange papers into the building as he was not allowed in and they would not accept them.

Further, the Judge has ordered the Police to identify the police officers involved over the last 20 years in over 100 incidents where they have proof of which ones were involved.

APPLICATION TO EXTEND CUSTODY TIME LIMITS

I am in receipt today of CPS Application to extend my prison sentence, of indeterminate length, into 2010.

The 5 pages of fairy tale nonsense was to be as expected. In a week when some purported Psychiatrist, at least the 9th so far, featuring in this case, before we count up all the physiologists, psychotherapists, doctors, social workers and South Wales Policemen who sat around Multi Agency Public Protection meetings each month, I was half expecting a paddy wagon of men in white coats to take me away, away, away.

I am into the last chapter of Bloch and Reddaway’s ‘Russia’s Political Hospitals’ and about to start on ‘Gulag a History’, by Pulitzer Prize winner Ann Applebaum. The similarity to the conduct of the last 6 Cardiff Crown Court Judges, HM Court Service and HM Prison, Cardiff and Caswell Clinic is frightening.

26 Oct 2009 CPS letter states South Wales Police ‘Reveal’:
Date of offence came to light – 27/05/09 – Bloody Liars.

CPS do not disclose sequence of correspondence, taken from my laptop during it’s custody, in anticipation of this expensive smokescreen to screw my 16 year running civil action for damages now coming to a head with Barbara Wilding, Chief Constable, knowingly signing the 25 Feb 2009 false affidavit for actions CF6141159- MC65, CF101741 and CF204141.

His Honour Judge Seys-Llewellyn QC has read, or should have read, my sequence of documents lodged on Cardiff County Court.

Eg. 24 April 2009 17 page Position Statement of Plaintiff to Court
or 8 May 2009 10 page document headed Police Surveillance to Adrian Oliver, Barbara’s private solicitor, who had me arrested on 22 June 2009.

But what is ‘new under the sun’, when dealing with the privileged few running our Law Courts, immune to prosecution and answerable to none?

PS Where are all communication records between You, County Court, Caswell Clinic, Police, CPS and Prison?

Regina v. Kirk

Dear Sir,

The Recorder of Cardiff, His Honour Judge Cooke QC., has given an order that I be further sectioned under Art. 35 of the 1983 Mental Health Act and thereby refusing me bail.

His Honour Judge Bidder QC, along with around six other Cardiff Judges have also refused me bail so far, only on the basis of Psychiatric Reports, it appears, if one only reads the transcripts.

Cardiff Court has indicated ‘subject to the Legal Services Commission', and independent psychiatrist etc., ‘all of these things are available to him at public expense,' should I instruct a solicitor.

I therefore request you nominate a London Firm of Solicitors to obtain bail as transcripts, so far obtained, clearly indicate both transcripts and medical reports will be paid for under Cardiff Judges orders at the tax payers' expense. I do not believe a word of it.

To date, I have been refused all specific disclosure, independent medical attention, and sight of the Cardiff Court Log in order to establish if my letters arrive. Who else appears to have an interest in my imprisonment and has there been appropriate steps taken to expedite my release from the eight court judges refusals since 22^nd. June 2009?

Upon release from prison my likely residence will be in London as I have a number of ongoing court actions against the South Wales Police, both at the Royal Courts of Justice and Privy Council.

My numerous applications to preserve evidence, to the Court of Appeal (civil and criminal division) and administrative courts these past six months have proved futile.

Update On Maurice

The 11^th and final Psychiatric Report on Maurice, carried out by Dr. Silva from Ashworth, has been followed up by removing him from the possibility of permanent exclusion from society by use of Article 35 of the 1983 Mental Health Act. A VICTORY for sanity and Maurice!

Maurice has also been removed from the MAPPA surveillance system but the authorities have refused to indicate when he was placed on the list and when he was removed from it and, indeed, who ordered him to be under such extreme (and expensive) scrutiny. Another VICTORY for Maurice.

These two procedures have meant that he has been ON REMAND since 22^nd June 2009 being locked away from society with £12 a week phone money but sometimes only minutes a day access to a phone which is shared by many, so always in a queue and overheard and monitored. It took 16 days for him to contact a lawyer with whom he had a limited conversation. The phone is only available for a brief time after breakfast. Not many Law Offices are open before 0830! As someone endeavouring to conduct his own defence he has access to pen and paper, envelopes and some stamps but that is all. He is still on remand in Cardiff Prison.

1. Subject to £50,360 from HM 23 October 09 judgment against HM, enclosed, being paid into my prison canteen, I will be ‘in funds’ to instruct you immediately. By Sunday I have no canteen or easy access to private cash, due to HM nonsense.

2. The First instruction will either be for;

a) Drafting the changes under the 1977 Criminal Law Act e.g. ‘Conspiracy to do acts tending to corrupt public morals or outrage public decency’, maybe or, Section 1(1) and/or 1(3), perhaps for the 11 December Private Criminal Prosecution of the Chief Constable of the South Wales Constabulary, Barbara Wilding, at Cardiff Magistrates

Or, maybe in the light of HM having failed to section me on 02 December to an indeterminate prison sentence, (Imprisonment for Public Protection) in their proposed Ashworth High Security Psychiatric Hospital, Liverpool, you may suggest I leave this HM dominated jurisdiction to live elsewhere before HM dream up some other scam to fuel the gravy train with tax payers money.

His Honour Judge Seys Llewellyn QC is the trial judge for my 17 years running litigation for South Wales Police false imprisonments, was the Crown Court Judge for a minor motoring offence that led to my being struck off the Veterinary Register, was one Judge to delay my £50,360 HM judgment from being obtained 2 years ago and is aware, I hope, that this 2nd HM Judgment for false imprisonment by HM, delayed due to his commitment under the 2006 Extended Civil Restraint Order (ECRO) now updated this year, with MAPPA surveillance, admitted in the court room, on 15 June in the Royal Courts of justice.

It would be a bit of fun if you could arrange for His Honour to be the trial judge in February trial for the mandatory 5 year prison sentence for once being in possession of the remains of an original World War 1 aviation modified Lewis Machine Gun, that may have haven the very weapon used by 24 Squadron of the Royal Flying Corps to bag Wales’ first Victoria Cross.

On a more sober note the Recorder of Cardiff, Judge N Cooke, was minded to give me bail (see transcripts on website), but considered my 26 April 2009 letter to the Chief Constable for disclosure and £10,000 reward for retired police officers home addresses, to serve the 100 or so witness statements, as tantamount to ‘high risk’ to the general public, the very sign, in red ink, that was then put on my cell door as I was returned back to prison.

The £50,000 can be spent immediately for you to organize the 60 or so policemen and civilians I already know about, for attendance at both Criminal and Civil Trails.

As with the 5 previous Cardiff Crown Court White Hall farces, I have only been able to win on the laws of sufficient ‘DISCLOSURE’.

That is your job and you must get on with it please.

The South Wales Police have been known to tamper with evidence in my cases, and no doubt, that is a reason Barry Magistrates gave me unconditional bail to preserve evidence and for me to trace defence witnesses. Another job?

The previous owner of the De Havilland Biplane, the Royal Air Force at Lyneham Airfield, and countless south Wales Police who played ‘pass the parcel’ around Bridgend HQ, are all vital witnesses to give evidence.

Statements need to be obtained immediately before they are knobbled.

Then there are all the people that have also been ‘in possession’ of the aircraft since the 80’s who, rumour has it, have not yet been interviewed.

I need a lawyer who is prepared to obtain the evidence from Barbara’s own lawyers, defending her in my 7 civil damages claims, as it is they that had me jailed on some pretext or other of ‘threats of criminal damage’, now buried with HM’s blessing.

This leads me to another touchy subject for a lawyer and that is whether you are prepared to be a party to a ‘sting’ as I described it in court yesterday, my being rather ‘light headed’ and apparently discourteous to the 7th Cardiff Judge to refuse me bail, my having just avoided a potential imprisonment for life without trail, or even on the 30 odd doctors examining my case in the court room! Northern Ireland’s equivalent?

I was surprised it was conducted in English.

As the helicopter circled overhead our house and ‘Operation Chalice’ launched still more police officers with sophisticated search equipment, sniffer dogs, psychiatrists and countless vehicles, I placed appropriate ammunition to be found on video later, to prove malfeasance.

Interestingly, the arrest for being in possession of ammunition and current possession of a fire arm was dropped, nor would the 30 odd search team dig where they were told they might find more evidence, contrary to the 1968 Firearms Act.

‘WHEN THE GOVERNMENT IS WRONG, IT IS DANGEROUS TO BE RIGHT’

Dear Sir

Just why is my 28 October Bail application replied to on 9 November and only handed to me on 23 November, stating I had to use a lawyer?

The prison refused to process a ‘statutory declaration’ as to my identity in order to obtain a lawyers services, independent of your incestuous little world of deceit and avarice.

I have, at last, made you lot admit I am classified as a Level 3 Multi Agency Public Protection Arrangements prisoner, settled by the defendant, no less, in my 16 year running action for ‘Malicious Prosecutions’, the South Wales Police.

Just how long did you know this, Mr Cooke?

You continue to conspire by refusing to allow me access to CPS evidence to keep my locked up, evidence of a conspiracy to which I am entitled, but you are now directly interfering with my civil court cases.

MY 11TH PSYCHIATRIC REPORT

My apologies for the brief ‘examination’ through my cell door but no one gave me proper notice of your identity, arrival or purpose of visit. I believe you were someone I could trust.

It is still a mystery to some as to just where you feature, as you are my 11th physiatrist while the Cardiff Crown Court continue to refuse to release to me those reports from:

Texas State Psychiatric Hospital – May 2008
Fixed Threat Assessment Centre, Whitehall, January 2009
Princess of Wales Hospital Bridgend, April 2009
Abertawe Bro Morgannwg University NHS Trust, June 2009
Multi Agency Public Protection Arrangements Meetings, June – November 2009
ABM Caswell Clinic, Bridgend, August – October 2009
Whitchurch Mental Hospital, Cardiff, October 2009
12th Psychiatric Report requiring no examination or consent etc etc.

His Honour Judge Cooke went so far as to spring a court hearing on me at 9.30am on 13 November with just 1 hours 35 minutes warning, to enjoy his repeated refusals to disclose the previous psychiatric reports favourable to me, for the purpose of being ‘fit to plead’, or CPS disclosure.

His Honour uttered the usual court ‘niceties’ such as a ‘free transcript’ and ‘legal aid’ knowing full well he was lying again, especially when he again refused to seize the Lewis Machine Gun, before the police further tampered with it, refused me a couple of tablets for a severe headache, or order the Crown Prosecution Service to provide evidence I was ‘unemployed’, of ‘no fixed abode’, would ‘interfere’ with witnesses or ‘abscond’, their reason for remand.

6 Judges and the CPS are attempting to withdraw the machine gun case now it has succeeded in well and truly screwing up my civil action against the South Wales Police in early January 2010.

Cooke et al, are now attempting an indeterminate prison sentence under IPP Emergency Procedure and 1964 Criminal Procedures (Sanity)Act so I may see you shortly in your High Security Lunatic Asylum.
