Dear Case Worker,

Breach of Restraining Order Appeal
Further to our telephone conversation I am anxious to obtain copies of the jury notes used in the trial in my absence, refered to by the judge and the list of defence witnesses sent to the judge, from my cell, during the closing stages of the 4th May trial.
One specific defence witness, the prosecuting barrister in the original 1st December 2011 magistrates hearing, who drafted versions of the Restraining Order in dispute as ever served,, informed the judge he had to confer with the Bar Council first. (see transcript).
I write with ugency as they are needed for the pending JR CO/6357/2912 where I am not represented and my witnesses, currently preparing affidavits and those in the public gallery are tellling me some names on my list, diven to GEOamey Custody Services were not even called out by the court usher!
I have already purchased much of the transcript for website and JR application but no all of it.
I wish this appeal to be expedited,
now that I hope to have legal representation and preferably to be heard in conjunction with the JR application.
I will not accept the documents being sent to anyone else in Wales but my self or they will be nobbled.

Much time has been wasted by police having me jailed for nearly three months and dropping all charges, just to harass me for the imminent three month civil trial, there being no effective way in Wales for sueing the blighters.
This is coupled with Cardiff Crown Court, of course, refusing me entry into the building for them, as allowed in the past, despite my winning the 'common assault' appeal in Bristol Crown court only because the Cardiff Crown court prosecution witnesses were now "reluctent to give evidence", as the CPS stated, knowing, in England, I will be allowed to cross examine prosecution witnesses, have my depositions from my cell below and even, would you believe, be allowed to call my own defence witnesses.
Today I was told by a HM Cardiff Crown Court official these copies of jury notes would not be released to me but had I been represented by a barrister in court, during the trial, of course he or she could have seen them!
It stinks, doesn't it?

Dear Sir,
CONTINUED POLICE HARASSMENT
Late last night four South WalesPolice swooped on me with the clear intention of securing my arrest.
The paddy wagon dispatched, I noted, took a mere few nano seconds to arrive following the phone call(s) from the gang of youths gathered in the Macdonalds' car park, Barry.
I request and will have the incident number, please, officers names and numbers who were in attendence and why?
I particularly need to know the name of the senior officer who issued the harassment and to which lodge he belongs and by what standing orders remain in place at your station following my MAPPA level 3 registration.
It may be just another example of his evil devil worship but push me much further and your inherently corrupt Cardiff law courts will hear of a whole new meaning to the meaning, 'modus operandi', where one of your victims is concerned.
For what was clearly, from the start , a hoax call and your subsequent conduct please take this letter as pre action protocol for still further civil litigation for damages.

Judge finds: To issue a private summons would be unjustified and outrageous!

Barry's "flying vet" fails in legal bid. That's the headline of the short and punchy article in today's Barry & District News. In good old mainstream media style, it focuses on the extremes in Maurice's life rather than the complexity of his interwoven legal actions.

Judge Martin Brown refused the application to issue a summons, saying he saw the application as one borne out of "delusion" and "paranoia". Who is he to know and judge?

Has he spent 3 months in a psychiatric clinic because of false medical reports?

Has he spent 4 months in prison for possessing a replica of a machine gun where the Police lost their case?

How much time has he spent with Maurice to appreciate his commitment to being a "chronic litigant" - as the alternative to being a vet that was forced upon him?

The whole legal drama enacted by South Wales Police and all the various allies in the judiciary is more complex than any Shakespearean theatre, and we can only hope that more and more people realise what a farce and comedy it is - except for the person who has to suffer the injustice and costs from endless bullying and harassment, besides all the other claims...

'Starship Cessna's' madcap captain

Here is an article that appeared in the Guernsey Press on 22 March 2011. It shows Maurice in a Nazi uniform entering the magistrates court.. He put in on his files to be downloaded with the comment: ' the *** never left the island, they just changed uniform'...

He also makes a few observations on this modern form of journalism written for other purposes other than to inform the general public:

At least six facts are deliberately wrong but, as Americans say, “any publicity is good, just spell my name right”

The reason for the appropriate uniform for magistrates court was because Maurice was the only one prosecuted and who succeeded in winning this criminal case for housing temporary UK hotel workers, just for the holiday season, following requests from the island's hotel owners!

One other obvious ommission, in the article, was that Maurice was nearly successful in the 1985 islands' election, missing by just 32 votes for a seat in thei Insular government.

This, obviously, triggered a vindictive media campaign, under HM control, it always being the case in both Guernsey and Jersey when he or she 'dare raise their head above the parapet' and question the authority's integrety.

The Guernsey's maffia, seriously under threat with the dreaded 'human rights' issue being explained to the locals and Maurice starting up the Guernsey Legal Aid Association and campaigning for equal pay and conditions for workers, from outside the island, clearly succeeded in influencing the pathetic few that voted which is why this newspaper article has been published outside their incestuous environment as a warning to any of you out there if you also get too close to the enemy.

Take an adverse publicity it as a compliment, as Maurice did and continue to wage the war with the blighters and expose their behaviour with every opportunity that comes your way.

FINALLY: Proper Health Treatment in France instead of Wales

As reported earlier this year, Maurice J Kirk BVSc found protection from the bullying of South Wales Police, by obtaining asylum in France¹. Since then he has also managed to obtain surgery for a replacement hip, despite the falsification of his Welsh medical records by Dr Tegwyn Williams of Caswell Clinic, Bridgend.

Cardiff Crown Courts had repeatedly accepted the doctor’s evidence, which stated that Maurice suffered from ‘paranoid delusional disorder‘. This was apparently complicated by ‘significant brain damage’, a possible brain tumour and therefore considered him too dangerous to be released from a psychiatric prison. Supposedly, Maurice believed he was being bullied by South Wales Police and had been separated out for special treatment.

To clarify, his French surgical team arranged for a brain scan and physical examination neither of which Maurice could obtain from either the Welsh area NHS or Dr Tegwyn Williams. For almost a year now on crutches and latterly on significant levels of morphine and other strong analgesics, Maurice has been battling for disclosure and clarification of his records. After all, they were used in ten or more Cardiff Crown Courts, to oppose his bail applications while in prison and psychiatric clinic for seven months. And they were the basis for his Welsh surgical team refusing to operate.

Leaked police memos² revealed that South Wales Police had meetings with both, the Independent Advisory Group (IAG) and those agencies covered by Multi-Agency Public Protection Arrangements (MAPPA). In 2009 these resulted in ‘Operation Tulip’ to try and have him sectioned under the 1983 Mental Health Act and imprisoned for an indefinite period. But having been found not guilty in trading in machine guns, Maurice had obtained his liberty in February 2010.

Therefore, Maurice reverted back to the Welsh courts to get his medical records released. But that failed. However, he discovered that Professor Roger Wood of Swansea University had re-written his own medical report and back dated it, given that Maurice was in liberty.

Then Maurice attempted disclosure under the Freedom of Information and Data Protection Act, but the Information Commissioner refused to intervene. In his support, an online campaign³ yielded over 230 signatures and more than 4,000 page views, but did not make a difference either. Cardiff Crown Court continues to refuse the disclosure of the medical information on court logs or let Maurice hear the court tapes of hearings that took place while he was left locked in his cell. His civil action for damages against South Wales Police is currently being adjourned. But his claims comprise the continuous harassment that stopped as soon as South Wales Police had succeeded in getting him struck off the Register of Veterinary Surgeons in 2002.

Dogged with his poor health condition, Maurice now had to withdraw from his action for damages against the Royal College of Veterinary Surgeons, thereby losing all the proceeds of recently selling his house. He says ”If someone had told me nine years ago that the College is immune to prosecution under its Royal Charter⁴, I would never have been as stupid as to commence legal proceedings. Now I just hope to regain my health such that I can cope with the legal action against South Wales Police. Since it was lodged in 1996, it has been delayed for long enough, deliberately of course. As a bullying case, it is unusual, extreme and indefinite. It’s time to close that chapter of my life, and I’m glad my brain is normal while I’m looking forward to a new hip.”

HM Court Service v Maurice Kirk at Cardiff Magistrates at 10am on Tuesday 22nd February

Outcome of Tuesday Hearing

The district judge said he would not interfere with the previous district judge's 2nd November decision, in ignoring the medical evidence from my GP, that my current state of health plus medication, accepted by four other courts to adjourn, including the Criminal Court of Appeal in London.

Therefore the application to set aside the conviction, obtained in my absence, by my solictor, was refused leavingt the arrest order outstanding.

Situation on Monday

1. HM Crown Prosecution Service and HM Cardiff court refuse to reply to my letters for outstanding disclosure, overhead video in Crown Court, for example, of the incident and both the Cardiff Magistrates and Cardiff CPS contemporaneous records of November 2010 hearing, that took place in my absence, despite adequate medical evidence before it.

2. The last hearing received my GP's 1st November 2010 medical certificate faxed, the surgery me,before the hearing started. Is this, then, a Welsh HM conspiracy?

3. My current inability to conduct litigation has been accepted in various English courts.

4. Medical evidence of my incapacity to stand trial is currently being withheld by both HM CPS, the prosecution and Cardiff HM Court Service, the administrators of Cardiff courts..

5. An HM Court Service staff member, an ex policemen, is the complainant and HM CPS is prosecuting reliant only on witnesses employed by HM Court Service, based in Cardiff.

6. It is for these reasons I request all my outstanding cases to be heard outside South Wales.

7. My medical evidence, recorded in both2nd December 2009 and 24th June 2010 Crown Court logs are needed for this Tuesday hearing, to support my police doctor's evidence.

8. Could the court ask for copy of these logsto be faxed to you, before Tuesday, please?

9. My current incapacity to defend myselfis supported byevidence given to HHJ Bidder QC and Judge Cooke QC by both the HM CPS with Dr Tegwyn Williams, both concerned about my welfare, then incarcerated in HM Cardiff prison.

.10. Caswell Clinic staff told me I have significant brain damage and a possible brain tumour.

11. Director of this South Wales Police forensic laboratory informed the proposed trial judge, on 2nd December 2009, my medical condition was irreversible and likely to get worse, recommending to at least five Cardiff judges, over 6 months, that I be refused bail.

12. He stated I was so dangerous that he recommended I be transferred to a High Security Psychiatric Prison, IPP, Imprisonment for Public Protection, possibly for life. I was on remand in prison, incidentally, winning a 10 year mandatory incaceration, without the need for calling evidence for trading in prohibited machine guns, actually one World War1 decommissioned relic attached to my 1916 DH2 replica biplane sold a year earlier!

13. Letters, requesting my medical records, are already with the court, these records also needed in order that first my Welsh and now French anaesthetist, as I have obtained asylum here, may expedite my long overdue elected surgery for a total hip replacement.

This is a marvellous post, as it shows the poster that Maurice used when he stood for election in Guernsey some 20 years ago. He nearly made it to make a difference on that tax heaven!

The post also shows the video interview that was taken while he was on Jersey: a nice summary of where he is at in these "exciting times"...

It is blindingly obvious that the reason they will not produce your medical records is that you do not have a brain tumour, & never did have: That it was a complete fiction by that evil man 'Doctor' Tegwyn Williams to give an excuse to lock you away for life, at the behest of then Ch. Constable Barabara Wilding who, as Chairwoman of a Big Lottery Fund, was able to hand out large sums of money to Williams. In Cardiff Crown Court on October 1st 2009 I stood up & likened him to the Nazi Dr. Josef Mengele. That is NOT an exaggeration. Nobel Laureate Solzhenitsyn said "To put a sane person in a madhouse (his word) is worse than the gas chamber: the torture is more cruel, death takes longer". So it was for Andy McCardle.

Please forgive me if I now mention my own case, but it IS relevant. After four years in prison for a NON-EXISTENT 'crime', I had 'paid my debt to society' & was due to walk free. Instead I was unlawfully carted off to Newton Lodge Gulag 'Hospital', Wakefield, a most evil place. When I asked the Home Office by what authority I was taken there, they said 'Two Doctors' had said I was suffering from some (un-named) 'mental illness'.

For more than five years I have been asking for the names of those doctors, but without success. Nor have I been allowed to see my medical records during that time, in spite of many requests. The reason is of course, the 'two doctors' do not exist. There are in fact THREE doctors who DO exist, all of whom said I was NOT suffering from any mental illness!

Tegwyn Williams could not take action against me for what I said in Cardiff Crown Court, but he can now that I have repeated it outside. He can either sue for defamation, or apply for an injunction to stop me repeating it. I invite him to do so. To their shame, the GMC are as bad as Williams, protecting the evil ones among them, just as they did with Harold Shipman.

Welsh Resident Granted Protection from Extradition to the UK
