Maurice Returning to The Real World

A few days with the The Horseshoe's landlord (Marcross, Vale of Glamorgan), 'let loose in Brittany' and my damaged brain appears to be returning to "normality" despite those three horrible months, last year, in the 'gulag of Bridgend', Caswell Psychiatric Clinic, part of big brother's South Wales Police penal servitude. I will address the jury, shortly, on what really happened in Cardiff Crown court.

Police Helicopter Chase near Highgrove

I would not miss the 24th Feb Barry Magistrates hearing for 'all the South Wales Police Pention Fund' the court heard when quashing the police restrictions refusing my leaving the country. It was therefore of no surprise to be detained at Portsmouth docks on Tuesday night by my refusing to disclose ' registered police fixed residence for bail'.

I eventually get away only for my 'cut away speed model' aging Fiat Panda to 'blow up' o the M4 motorway in the pouring rain. Hitching, walking luggage and aching joints gets me to Lea's Pub in Malmsbury and anotherr Lea driving me, Stirling Moss style, past Prince Charles's residence to catch the last train, by mere seconds remaining, for Cardiff long after midnight.

Around 1 am I recieve a call on my new mobile. " Wiltshire police hear, where are you?" " You know perfectly well exactly where I am, I have just (stupidly) put the battery back into my phone." " You were last seen dragging two large bags across a field near the motorway so, concidering your welfare, we launched the police helicopter".

I reach Barry settee by 3.30am and arrive at court 10 minutes early! The District Judge fixes 14th April date to argue witness summonses for Drs Tegwyn Williams, Professor Roger Wood and Ruth Bagshaw of Caswell Gulag to disclose the redacted 'damaged brain' reports for all day trial on 28th April.

I remind the judge that Crown Prosecution barrister Tom Thumb Twomlow told HHJ Bidder QC, in front of Dr Tegwyn williams that I had cancer and therefore must be legally represented. I, meantime, was smoldering in the cells beneath but the power crazy lot had failed to notice the court tape recorder had been inadvertantly been switched on.

It was their last 'throw of the dice' to scupper the trial and obtain the IPP and one way ticket to Broadmoor, for indeterminate prison sentance, Williams et al having found no other forensic level 12 psychiatrist for the mandatory Section 41, 83 Mental Health Act 2nd signature. Apparently the cabal had abandoned the earlier argument of brain damage due to my having been 'drinking pal of Oliver Read, ditched in he Caribbean and had flown to Australia withouut a map'

BUT HOW MANY PERFECTLY SANE BOYS AND GIRLS DID I LEAVE IN CASWELL GULAG WHEN I ESCAPED?

Due in Barry Magistrates 24th Feb to face a changed 'attempted burglary' charge to a Section 5 Public Order (UK Sus Law) and 'obstruction' charge whilst asking again for my FOA and DP Acts paid for medical records.

Caswell Clinic, despite attempting with the aid of the Dr Tegwyn Williams' Report, which was created with the sole intention of obtaining an indefinite prison sentence in Broadmoor, continue to withhold Professor Roger Wood's report, for December Cardiff Crown Court, saying I had 'brain damage' as a 'drinking companion of Oliver Read', 'crashed in the Caribbean in Liberty Girl' and 'flew to Australia without a map'! Could Enid Blyton have done better? Also witheld are reports from Dr Sylvester, Dr Ruth Bagshaw and many more in the South Wales Mental Health Laboratory operated by the cabal consisting of Cardiff University, Swansea University, MAPPA, Cardiff prison, South Wales police.

Enjoying peace in France having, at least, rescued my car that had been left on the quay for eight months...After changing the flat tyre, removing the Gendarme stickers I waved down the next motorist off the boat. Tim had remembered the farmer's eighty year old mother's birthday , lighting my cigar and a quick flip around the Vale with me in my C172.

I quietly told Tim I had just this week, met the same press photographer who had taken that photo for the Somerset County Gazette. This time he was taking post prison snaps for the Sunday Telegraph! Oh and another coincidence on the ferry, whilst talking to a couple over breakfast, who had just bought a property in France, she remembered my borrowing her husband's horse, from the Royal Core of Transport stables, for a days hunting, again at least 35 years ago!

Maurice back in Court on 16th Feb

I left 8 months of sheer terror, culminating in a wicked sham of a British trial and went back to Caswell Clinic to demand my FOA and DP ACTS paid for medical records.

I was arrested for 'attempted burglary'!

The police kept me the maximum time allowed and at 11 at night 2 psychiatrists and a social worker of suitable rank arrived in my cell and proceeded to interrogate me for well over an hour with the view of a Section to a lunatic assylum without trial....deja vu?

Near 1am I was informed I had, effectively, won that round.

I was later released and charged with Public Order, Sect 5 and 'obstruction'! I had to agree to report twice a week at Barry police station live at 52, Tynewydd Rd Barry , currently for sale and attend Barry hearing for 24th Feb 10 am.

I was originally given unconditional bail by Barry magistrates, in June 2009, for 'possession of a machine gun', only for it only for my freeedom being reversed by 10 successive Cardiff Crown Court judges each using a different excuse, each time, following my proving each of their arguements were based on a sheer pack of lies. The gun charge, like the proverbial 'lead Zeppilin', had no way to go but down, as the rule of law (1988 Act and 1968 Firearms Act etc etc) was obvious to the lot of them in the first place.

What did the french man say? "when the government is wrong, it is dangerous to be right"

The whole issue arose from the Chief Constable's erroneous 25th Feb 2009 sworn afffidavit denying court cases and police break ins to my veterinary surgeries had ever taken place.

The 18 year civil action for damages, needing over 100 police to give evidence, due to be starting 11th Jan 2010, was dependant on 'mutual exchange' of witness statements at 10am on 22nd June 2009 at Cardiff County Court so I had to be jailed that morning.

Maurice Not Guilty Verdict

News just in that Maurice has been freed by a majority not guilty verdict. The jury fully aquited Maurice on all charges at Cardiff Crown Court today. He's currently being processed and will be released shortly.

Court Update

Maurice is on trial in the Crown Court for possession of a gun which can fire two or more bullets on one pressure on the trigger and for trading in the same, (10 yrs sentence) Maurice, who is regularly denied his defence papers, unless he goes through various hoops, and then denied a pen and paper in court by the Reliance Security Firm controlling the Crown Court of Cardiff and on Friday denied his suit from the Prison and so had to appear in shorts and tee-shirt in front of the jury recently had sight of two statements taken from his wife.

The first statement on 22nd June 2009 was taken when her home was being raided by over 20 policemen which constituted two seperate search teams. During this tramatic event she was interviewed by a male policeman who proceeded to ask her nothing about a gun, nothing about ammunition and nothing about malicious damage (the reasons given for his arrest) but instead probed and questioned her about initimate details of their marriage and asked about Maurice's mental history.

It can be shown that MJK was already under MAPPA 3 investigation at least 6 weeks before he was arrested and that staff from the South Wales Police, the forensic psychiatrist from Caswell Clinic, Bridgend (Dr. Tegwyn Williams), the social worker Elizabeth Paul and others had all been present at a meeting to discuss Maurice long before the arrest on 22nd June.

Police, without M knowing, took a second statement from his wife on 2nd December 2009. This was served to Maurice this Thursday, 4th day of the trial! It indicated that the Police again searched the property . A further 70 odd 'items of investigation' including witness statements taken Dec'09 and as late as Jan '10 of Aircraft Engineers asking about the aeroplane before, during and after MJK owned her including the 'prohibited live ammunion' as described by the CPS firearms expert.

Where Was the Defence?

Only at 1430 were documents served on Maurice which the Judge had agreed to let Maurice have the day before. These had been listed as undisclosed on the schedule that arrived at M's 'hotel' 2 days before the start of the trial. These included 'e's initiated by CPS to Brian Woodford who is on the run from the CIA and who sold the DH-2 aeroplane in 1997 to MJK.

These omitted the CPS parts but due to MJK's persistence, HHJ Thomas ordered the CPS to release the RAF Lynham 'e'mails too which confirmed what their expert forensic gun expert said in questioning from MJK that: under the '68 Act the responsibility rests with the Military if a firearm is passed to a civilian that a) the civilian is a licence holder andb) that the item is appropriately certified.

These 'e' mails were dated 12th August and 26th August. It was obvious that the South Wales Police maliciously withheld this evidence. Before they were released the Judge had discussed them in chambers with the Prosecution Council but where was the
defence? In a cell under the court.

Regina v. Kirk

I humbly ask that my brother's medical records since June 2009 are released. They have been refused by the Caswell Clinic despite the Freedom of Information Act. I am in the process of arranging a private appointment with an E.N.T. Consultant in Bristol and thus need the reports from Professor Roger Wood, Dr. Ruth Bagshaw and Dr. Silvester. These are the reports which were not available to Dr. Silva when he had been required to write a report on Maurice and which were referred to by Dr. Silva in his ‘e' mail to the CPS when he explained that he could not finish his report without a full medical background.

It appears that the start of my brother's drop in hearing acuity dates from his stay at Caswell Clinic.

Dr. Tegwyn Williams stated in his final report that Maurice Kirk was fit to plead as long as he was legally represented because he was suffering from paranoid delusional disorder. The fact that Dr. Silva disagrees with Dr. T. Williams report supports the urgency for releasing these other reports.

It appears that successive judges have relied on Dr. T. Williams report to deny my brother bail. Each time he has been refused the right to challenge the report.

Crown Court Day 1 & 2

Maurice is still battling for his rights in the case in the Crown Court Cardiff. He has had huge difficulty accessing his papers whilst in the Prison, again in the custody suite when he wishes to consult and also in court where documents such as witness statements are producd by the CPS at the last minute . The acoustics are so bad in the court that it is hard to hear every word spoken. It is clear that this is always the case in that particular room, Court 8. Maurice is still requiring the medical reports from Caswell Clinic which form part of the evidence which has caused several judges to refuse him bai. Without them how can he rebut the evidence.

Newport Court 19th Jan

Maurice appeared at Newport Court 19th Jan 2010 not knowing what he was there for until he walked in. It was a further bail application presented by others. The prosecution were taking advice from South Wales Police but especially Dolmans, the police solicitors acting on their behalf whose senior partner, Andrew Oliver, Maurice is suing along with the SWP in the Civil Court at the same time!

The prosecution had to speak first but they have run out of arguments and so said that there was no change of circumstances since Judge Bidder heard the case on 17th December 2009.

The application failed.

The previous week at the Civil Court the Judge, His Honour Judge Seys Llewellyn QC instructed the Police to release to Maurice over 52 lever arch files. Now the Prison are refusing him access to them. This is the evidence he has been fighting to see for over ten years .

News From Prison

Civil Court Judge has ordered the South Wales Police to produce the 52 files for Maurice but when they eventually arrived the Prison Authorities refused to give any to him. At last, with more delay, they have allowed him access to 6 files at a time (so no cross-referencing possible) and each batch available every day or so thus meaning he has no time to prepare for his criminal case which starts 25^th Jan. He is still being denied his laptop on which he has filed evidence.

Because he has recently won a case for excessive physical restraint against Reliance, the firm employed to move prisoners from Prison to court, hospital etc, they have seen to it that he has even more restrictions placed on his visiting rights.
